SUBJECT: Renewal of Kennel, Cigarette,
Mechanical Amusement, Bow ling Alley,
and Therapeutic Massage Applications
KENNEL LICENSES

Commercial and private kennel licenses are renewed annually. The cost for a
kennel license is $75 per year for a commercial kennel and $50 per year for a
private kennel. All kennels are required to be inspected yearly prior to
license renewal. Cheryll Edinger of the Elk River Police Department has
indicated that all kennel license applicants have passed the kennel
inspection.

TOBACCO LICENSES
Tobacco licenses are renewed annually. The fee for a tobacco license has
been increased from $25.00 per year to $100 per year. The tobacco license fee
has been increased due to the State mandates placed on local government in
regard to the licensing of tobacco. Some of these mandates include required
compliance checks, partial ban of vending machines, and bans of single
packages of cigarettes. The cost to regulate these requirements has
necessitated the need to increase the license fees.

Listed below are the tobacco licensees who are requesting renewal of their
licenses. One requirement that must be met prior to granting a tobacco
license is that property taxes for the premises must not be delinquent. The
property taxes have been checked and all but one are current. The property
taxes are delinquent at the Holiday Station located at 13445 Business Center
Drive. This license will be considered at a later time on the agenda under
administration items.
Attached to this memo is a letter from Kevin Carter of the Elk River Country
Club explaining why he has chosen not to renew the tobacco license. This
letter is submitted to the Council at Mr. Carter's request, as indicated in the
letter.

Mechanical Amusement Device Licenses are renewed annually. Mechanical
amusement devices include video games, electronic dart boards, pool tables,
mechanical rides, and pinball machines. The license fee for a mechanical
amusement license is $35.00 per device per year.

Dear Sandra,
Thank you for your reminder in reference to our tobacco license. We have decided not to sell
tobacco at Elk River Country Club, and I wanted to explain to you and the City Council as to
why we made this decision. I want to be sure you understand up front that I wish the tone of this
letter to be respectful, and I am not attempting to create any problems with the relationship
between Elk River Country Club and the City of Elk River.
As you may be aware, we sold a pack of cigarettes to a minor who was working with the Elk
River Police department in doing compliance checks last spring. I feel the compliance check
program is very important and a necessary part of our programs for protecting our children. I
also feel the officers involved in the compliance check did their job very professionally. The
morning after the compliance check officer Vevea came to my office to discuss the matter with
me. I have a tremendous amount of respect for Officer Vevea, and I appreciated the way he
spoke to me about the non compliance in a very calm, professional manner.
At this point we at Elk River Country Club took this matter very seriously. I sent letters of
apology both to Mr. Klaers and Officer Vevea to let them know of our remorse and to assure
everyone involved that we were taking steps to insure this would not happen again. I felt at this
point that something on the order of a "Speeding Ticket" was going to be presented at our court
hearing, and we would move on. The court appearance of my staff member Judy Dallman, is
where I feel all reason and common sense ended...
The Judge let Judy know that she needed an attorney to represent her, as this was a very
serious offence. A new court date was set. Judy, a 50 something grandmother, was taken to the
basement of the courthouse and fingerprinted before she could leave. She was humiliated and we
left with Judy in tears. At the new court date Judy was given a fine and 3 years probation. If Judy
were to make this mistake again she will GO TO JAIL FOR A MINIMUM OF 90 DA YS.
Would anyone on this council take a chance of this happening to any of your staff members?
