The existing parcel is mostly wooded and all but the proposed Parcel A, lie
within the Mineral Extraction Overlay District. The existing parcel is
physically divided by the City Railroad Trail and the realignment of 221 st
Street NW. The applicant proposes to legally subdivide the existing lot along
these physical divisions to create Parcel A, Band C.

The applicant is likely to sell Parcel A to be developed as residential property
and sell Parcel B to the quarry that lies to the north and east. Parcel C was
to be adjoined to the applicant's adjacent property by means of a Subdivision
Exemption, however, the County does not allow a property to cross section
lines. Parcel C will be a separate property and owned by Richard Bury.
Minimum Lot Size
The Al district requires a minimum lot size of 10 acres or a density of 3 lots
per 30 acres. The applicant selected the density option. The 36.19 acre parcel
can be subdivided into three lots, with a minimum lot size of 2.5 acres. All
the lots will be legal and conforming to the Elk River Zoning Ordinance.
Access
Each parcel will have access to 221st Avenue and Parcel A will also have
access to Quinn.
DrainaI!e and Utility Easements
Typically, the City requires that 10 foot drainage and utility easements be
placed along the front and rear property lines, and 5 foot along the side
property lines and that they be granted to the City prior to recording with the
County. Since Parcels Band C are in the Mineral Extraction Overlay
District and are to be adjoined to adjacent mining land, 10 foot easements will
be required only along 221st Street NW. Parcel A is likely to be residential
and will be required to have a 10 foot easement along Quinn and 221st and a
5 foot easement along the north property line. The City Engineer is not
requiring drainage and utility easements along the City Trail as there is
adequate space for drainage there.
City Council MeetinI!. December 21.1998
At the December 21, 1998, Public Hearing, residents Doug Gibson and Steve
Erickson challenged the validity of the survey provided by James R. Hill,
Inc. for the applicant. The residents claim that they own a 7 foot strip of land
between Quinn and the Bury property. Terry Maurer, the City Engineer,
studied the situation and maintains that the Bury Survey is valid regarding
this matter.
Also at the Public Hearing, the Bury Survey showed a discrepancy regarding
the City Trail location and the location described in Sherburne County
Document No. 236928. The easement location appeared to be misaligned
. with the actual trail location. Terry Maurer and the applicant resolved this

issue, however the applicant's survey, revised 1/6/99, shows a trail width of
100 feet rather than the actual 200 feet. The applicant indicated that he will
have his surveyor prepare a revised survey and have it available at the City
Council meeting. (See attached Howard R. Green Co. memorandum)
Park and Recreation Commission Recommendation
The Park and Recreation Commission recommended a cash dedication in lieu
of land to satisfy the park dedication requirements for the two new lots being
created. They also recommended that any trail easement issues be resolved
prior to subdivision. The City Engineer has resolved the issues related to the
City Trail.
Recommendation
Staff recommends that the City Council approve the request by Richard Bury
for and an Administrative Subdivision to create two new lots from a roughly
36.19 acre with the following conditions:
1. THAT TEN FOOT DRAINAGE AND UTILITY EASEMENTS BE GRANTED TO
THE CITY ALONG 221sT AVE NW AND QUINN, AND A FIVE FOOT DRAINAGE
AND UTILITY EASEMENTS ALONG THE NORTH PROPERTY LINE OF
PARCEL A.

2. THAT PAYMENT OF PARK DEDICATION FEE IN THE AMOUNT OF $650 FOR
EACH OF THE NEW LOTS BEING CREATED BE PAID PRIOR TO RECORDING
THE ADMINISTRATIVE SUBDIVISION.
3. THAT PAYMENT OF SURFACE WATER MANAGEMENT FEE IN THE AMOUNT
OF $137.50 FOR EACH OF THE NEW LOTS BEING CREATED BE PAID PRIOR
TO RECORDING THE ADMINISTRATIVE SUBDIVISION.

Dear Council Members:
Richard Bury is ,:;Jroposing an administrative subdivision of his approximately 40-acre parcel of land located
along 221st Avenl.le at the intersection of the City trail easement. Mr. Bury is proposing to subdivide the
pn;)perty into three parcels. One parcel is west of the City trail, the second parcel is east of the trail but north of
22151 Avenue. ar:j the final parcel is south of 22181 Avenue. This administrative subdivision was presented to
ta City Council at a meeting in December. At that meeting the land owner to the west of the Bury property
ed a concerr. regarding whether or not there was access from Quinn Street to Parcel A. The landowner felt
at he owned a 7.foot wide strip of land that would preclude Mr. Bury from accessing Parcel A from Quinn
Street. The City ':ouncil deferred any action on the Bury Administrative Subdivision and directed staff to
review the information the landowner to the west could provide relative to the survey of his property. That
sutvey was submitted and reviewed together with the survey of the Bury property. It is our opinion that there is
no strip of land precluding access to the Bury property from Quinn Street. Both surveys show the property line
in questions to b~; the same section line. If the landowner from the west feels he still has some right to
prc,perty in this area, he certainly has other remedies through the court system.
The one other is:.ue we noted in reviewing this revised drawing is the trail easement is shown to narrow.
There was some discrepancy in the previous drawing over the location of the trail. As that was cleared up, the
trail was shown ~l::: 100 feet in width, centered on the old railroad track alignment. In actuality. the easement is
200 feet wide antJ should be 100 feet each side of the old centerline of the railroad tracks. We have discussed
this issue with Mr. Bury and he has indicated that he will have his surveyor revise the drawing and have it
aVedlable at or before Tuesday evening's meeting. We would suggest if that drawing is not available Tuesday
evening. this matter should be tabled until the actual correct drawing is available.

Please include a copy of this letter of explanation with
the request I made for the division of the 34+/- Acre parcel
I own in your city.
The realignment three years ago of 221st Ave No. west of
U.S. 169 cut through this parcel basically dividing it into
three distinct pieces, a 7t acre lot lying north of 221st Ave,
west of the BN Trail and east of Quinn Street, an 18t acre parcel
lying east of the BN Trail and north of 221 st Ave, and about
eight acres located south of 221st Ave connected to the 60 acres
and the 53 acres I own also.
My request is for a variance application for the 7t acre parcel
between Quinn Street and the BN Trail because this land is alone
by itself and is surrounded on three sides by roads and trails
thus restricting its use to one lot at this time.
The 18t acre parcel has been sold to its adjacent property
owner and will be connected to his property in the near future.
The 8 acres south of the road also stands alone so I request it to
be connected to either one or both of the properties I own south
of it. Thus the overall density for the 34 Acres into 3 parcels
is equal to 11 1/3 acres per parcel.
Please refer to the survey I've included with this letter.
