The fees are adopted by the Council by resolution on a yearly basis. . Presented for Council consideration are the 1998 fees and the proposed 1999 fees. If a change is recommended by staff, the 1998 fee will have a line through it and the new proposed fee will be indicated in red. Listed below is a general explanation of the proposed fee amendments. AudiolVideo......Dubbing audio and video tapes takes several hours per tape. The Police Department has been charging the proposed fee of $20 for audio tapes and $30 for video tapes. Staff is proposing to increase the fees being charged by the administrative department to be consistent with the police department. Video Eauipment/Operator.....An increase is proposed to cover the cost of upkeep and maintenance of the audio video equipment. Currently four hours of use would cost $125. Four hours of use at the proposed increase would cost $160. Building: Permits...See attached memo from Cliff Skogstad. Documents....It is proposed to add the copying of plat maps and maps from the Map Maker Xerox machine to the fee schedule. . Liauor...It is proposed to add a Premises Extension Permit to the fee schedule. Park Reservation Fees.....It is proposed to restructure the way in which deposits are made to reserve park shelters. The current structure charges certain organizations different fees. The new structure will be based on the approximate number of individuals at the site. Deposits are returned if the site is cleaned of refuse and debris after the event. It is also proposed to add the Gazebo to the Park Reservation Fees. Parkine: Fines.....It is proposed to increase the parking fines by $5. Surface Water Manae:ement Impact Fee... This fee is increased 3% annually which is consistent with Resolution 97-110 (attached). Tobacco... The City's tobacco ordinance was amended last year. Due to State mandates it was necessary to increase the tobacco fee to cover the cost of compliance. . River MEMORANDUM TO: Mayor & City Council FROM: Pat Klaers, City Administrator DATE: January 25, 1999 SUBJECT: 1999 Fee Schedule Annually, the city clerk discusses fees with other municipalities in order to ensure that our fees are in the appropriate ranges. Additionally, the League of Minnesota Cities annually provides a license and fee survey for municipalities. Regarding the 1999 fee proposal, I would like to comment on three areas of concern and interest. Most of the other proposed changes are rather routine. . PARK DEDICATION FEES The fee resolution proposal includes no change in the park dedication fee. A request for this increase will be coming in the next few months, and the council can consider this issue separate from the attached fee schedule. The reason for the delay is that the city is awaiting the results of a survey done by a consulting firm on behalf of the city of St. Cloud. The survey will hopefully help us justify a proposed change. The council should note that a substantial change is being proposed based on the preliminary information that has been obtained on what other cities are charging residential development on a per lot basis. The more difficult issue that the Park and Recreation Commission is trying to work through is how to obtain appropriate park areas in plats, and equate this land area to a dollar value that is consistent with the per lot fee. Currently, almost all developers want to pay a per lot fee rather than give land for parks. The current ordinance calls for up to 10 percent of the land being dedicated for parks. This 10 percent guideline is almost universal with municipalities. . A substantial increase in park dedication fees is a tough issue for all parties. The city needs adequate funds to make improvements, and also needs adequate land in residential developments for parks. On the other hand, the fees cannot be so high that it is detrimental to the development. TDD & Phone: (612) 441-7420. Fax: (612) 441-7425 . SURFACE WATER MANAGEMENT IMPACT FEE The city has wrestled with how to fund surface water management (SWM) improvements for the past six years or so. The issue really came to a head when the city financed large storm sewer pipe improvements for the upgrade of the Highway 101110/169 interchange. Other major SWM improvements have followed along with the adoption of a city wide surface water management plan. The city's system is interrelated with the county ditch system, and the pipes underneath Highway 169/10 are actually part of the county ditch system. As an additional note, the city and county have had special legislation passed which allows the city to take over county ditches upon mutual agreement by both parties. We have not needed this law to date, but we have done things with the county such as the work on Ditch 10 west of 169 (Hohlen property), whereby the ditch was abandoned and the surface water was channeled through a system of pipes and a relocated ditch under city jurisdiction. . The city finances the vast majority of its SWM expenses with tax levy money. A relatively small portion of the total SWM money comes from developers and development projects. However, developers and development projects are required to finance their own internal SWM system which, ultimately, feeds into the trunk system. Information that the city has obtained from other developing municipalities indicates that our charges to developers are much lower than comparable communities. This simply means that the taxpayer has to fund more for the city SWM trunk system. The resolution approved a few years ago calls for an annual 3 percent increase in the fees on development projects. Once, a few years ago, the council jumped that to 10 percent, but since then it has reverted back to 3 percent increases. Based on the East Elk River SWM needs, the city will either have to do a 20 year bond to finance activities and/or look at a significant increase in the annual SWM tax levy. This issue is really a capital improvement program discussion item, but I wanted to let the council know about my on-going concern regarding adequate funding of our trunk SWM needs and this low development SWM fee. BUILDING PERMITS The city has always followed the state building code and, when appropriate, formally adopts the updated version of the state code. Municipalities are usually 2 to 3 years behind in the adoption of the state code. For example, in . late 1996, the city adopted the 1994 code. Today in 1999, we are looking at . . . adopting the 1997 uniform building code. The "delay" has to do with the timing for state approval of the updated codes. Consistent with city adoption of this code, for the past 10 years or so the city has also been adopting the permit pricing schedule. This eliminates any issue of being arbitrary when dealing with builders, and puts us on an even basis with our neighboring development communities such as Ramsey, Andover, Champlin, Maple Grove, etc. As noted in the building official's memo, this will be the first increase in three years in the permit pricing schedule, and the increase will be approximately 11 percent. In very general terms, this cost is typically passed on the new homeowner. The building permit and other growth related revenues (especially plan check fees) are at the highest level ever in the 1999 municipal budget. The city is gradually becoming dependent on these revenues to finance our building inspection department. Without the adopted increase in the permit schedule, we run the risk of falling short of our budgeted amount, therefore causing the taxpayers to pick up this expense for building inspection (plus some engineering and planning) services. Once again, the City Council may have a concern regarding the cost of development in the community, and whether or not higher fees impact the quality of residential development or has any impact in slowing down the rate of residential development. From a municipal finance point of view, it is important for us to adopt the scheduled permit pricing fee which is an 11 percent increase over the existing schedule. The adoption of this fee schedule allows us to be consistent with neighboring communities. . . . This adoption process takes place approximately every three years. The reason for these code changes is to update all applicable codes to today's technology. Provided for you with this memo is a list of codes staff is recommending to adopt. This list of codes is all part of adopting the Minnesota State Code. The only change from the previous code change is the use of the 1997 Uniform Building Code and having the re- roof chapter part ofthe body of the code and not an appendix chapter. . With the adoption of the 1997 State Code a couple of changes will take place. The first change will be that the 1997 code will allow designers a broader field of code design such as sprinkling a building and exiting related issues. One of the significant changes will be the adoption of Table lA in regards to permit pricing. Using the 1994 Table lA for a $100,000 home, the permit price is $1,476.75. Using the 1997 Table lA with that same valuation, the permit fee would be $1,639.69. This illustrates an increase of $162.94, which is approximately an 11 % increase. After talking with several municipalities, I have found that all of them have adopted the 1997 Table lA. The areas that have not adopted the 1997 table are the out state or non- metro areas. The last substantial increase for permits was on October 16, 1996 when the City adopted the 1994 building code. The next perceived code change will be approximately in the year 2001. I might add that this will be the last time we will be adopting the Uniform Building Code. The next time codes will be adopted we will be using the International Building Code. This will be a significant change for building officials and designers. Therefore, at this time staff is requesting council approval for the adoption of the State of Minnesota Building Codes as outlined in this memo. WHEREAS, the City has determined to fund the surface water management improvements through a variety of funding sources including a Surface Water Management Impact Fee; and WHEREAS, the City has determined that this Surface Water Management Impact Fee should be collected from the property owner at the time of platting, or in the case of existing lots, at the time of issuance of a building permit. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Elk River J\1innesota: 1. The Surface Water Management Impact Fee for all rural (non-city sewer and water) single-family residential lots shall be $60.00 in 1994. On January 1 of each succeeding year, the rate shall increase three percent (3%). 2. The Surface Water Management Impact Fee for all urban (city sewer and water) single-family residential lots shall be $120 in 1994. On January 1 of each succeeding year, the rate shall increase by three percent (3%). . 3. The Surface Water Management Impact Fee for all non- single-family residential property shall be $720 per acre . . . in 1994. RESOLUTION 99-_ A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ADOPTING FEES FOR SERVICES FOR 1999 WHEREAS, the council reviewed the fees charged for services on a yearly basis to ensure that the fees charged reflect services rendered; and WHEREAS, the costs incurred to process various licenses, services, zoning, and planning requests have been reviewed by the City Council. NOW, THEREFORE, BE IT RESOLVED that the attached fee schedule reflects the fees charged for services rendered by the City of Elk River in 1999.
