I. Call Meeting to Order
Pursuant to due call and notice thereof,the meeting of the Elk River Planning Commission
was called to order at 7:29 p.m. by Chair Johnson.
2. Consider December 27, 2016, Planning Commission Agenda
Moved by Commissioner Konietzko and seconded by Commissioner Feinstein to
approve the December 27,2016, Planning Commission agenda. Motion carried 5-0.
3.1 Consider November 22, 2016, Regular Planning Commission Meeting
Minutes
Moved by Commissioner Larson-Vito and seconded by Commissioner Thiel to
approve the November 22,2016,Regular Planning Commission meeting minutes.
Motion carried 5-0.
4.1 Northern Tiny Builder, Inc.— 163'd Avenue NW
Conditional Use Permit to allow outdoor storage of vehicles, tiny homes; bus and trailer
maintenance and repair; and a residential use, Case No. CU 16-35
Zack Carlton stated that staff has requested additional information from the applicant and
has extended the review period to March 29,2017,in order to provide the time needed for
review of the updated information.
Chair Johnson opened the public hearing and continued this item to the January 24,2017,
Planning Commission meeting.

4.2 Chris Murray— 19262 Ogden Street NW
• Conditional Use Permit for Agricultural Animals, Case No. CU 16-34
Planner BrieAnna Simon presented the staff report. Staff recommended approval of the
Conditional Use Permit with the 12 conditions listed in the staff report.
Chair Johnson opened the public hearing. There being no comment,Chair Johnson closed
the public hearing.
Motion by Commissioner Konietzko and seconded by Commissioner Nicholas to
recommend approval of the request by Chris Murray for a Conditional Use Permit to
allow agricultural animals,with the following conditions:
1. If the proposed work described in the application and Conditional Use Permit
has not been substantially completed within two years of the Conditional Use
Permits date of approval,the permit shall expire and become void.
2. The Conditional Use Permit shall expire if the authorized use ceases for more
than six months.
3. The applicant must apply for and receive approval of all required permits before
any construction may begin.
4. No more than 6.26 animal units shall be allowed on the property.
5. All conditions approved by the Board of Adjustments on October 25,2016,for a
wetland setback variance (Case No.V 16-14) shall be met.
6. All conditions and best practices outlined by the Wetland Conservation Act—
Technical Evaluation Panel decision,dated October 14,2016,shall be met.
7. The Manure Management Plan shall be followed as directed and approved by the
Sherburne County Soil and Water Conservation District.
8. For the Conditional Use Permit to remain active, a valid Manure Management
Plan must be approved by the Sherburne County Soil and Water Conservation
District and filed with the City of Elk River for all future homeowners.
9. Any changes to the Manure Management Plan must be approved by the
Sherburne County Soil and Water Conservation District and filed with the City of
Elk River.
10. If manure is used as fertilizer,it shall be turned under immediately,or as soon as
the frost leaves the ground.Application of manure should be conducted in such a
manner so as not to permit runoff toward surface waters.
11. If the city finds that the manure and other waste materials create a nuisance by
attracting flies,other insects,rodents, or by creating offensive odors,the city may
order the manure and other waste materials be removed on a more frequent
schedule.
12. No on-site commercial activities such as breeding,boarding, or selling shall be
permitted.

4.3 Miske Meadows—Outlot D, River Park
Updated Preliminary Plat, Case No. P 16-21
Zack Carlton presented the staff report. Staff recommended approval of the revised
preliminary plat with the six conditions listed in the staff report.
Chair Johnson opened the public hearing.
Dwayne Sikich,representing Paxmar—stated he was present to answer any questions.
There being no one present to speak on the matter,Chair Johnson closed the public hearing.
Motion by Commissioner Konietzko and seconded by Commissioner Thiel to
recommend approval of the request by Paxmar,LLC for the updated Preliminary
Plat of Miske Meadows,with the following conditions:
1. Updated engineering and utility plans must be submitted to the city and
approved by city staff.
2. An updated Planned Unit Development agreement for Miske Meadows must be
approved by the City Council.
3. Staff approval of a standard landscape plan for all detached townhome units,
consistent with the R-3 townhome/multiple family residential design standards.
4. Parcels below 65 feet in width shall be included in a single home owner's
association.
5. All mailboxes shall be clustered.
6. All mailboxes and public utilities with parking restrictions (hydrants) shall be
located in a manor to reduce parking impacts.The facilities must be identified on
the development plan, and approved by staff.
Motion carried 7-0.
6. General Business
Planning Manager Zack Carlton thanked Councilmember Burandt for her time served as the
Council liaison to the Planning Commission.
6.1 City Council Liaison Update
Councilmember Burandt reviewed the December 19,2016, City Council actions taken on
the planning items from the November 22, 2016,Planning Commission meeting.
7. Adjournment
There being no further business, the meeting of the Elk River Planning Commission
adjourned at 7:46 p.m.
