Box 490 Elk River, MN 55330 RE: EAST ELK RIVER RAILROAD CROSSING Dear Mr. Klaers: As you are aware, we have completed the negotiations with the railroad company on the agreement to open a new railroad crossing at 171st Avenue. The final piece of information that the agreement calls for is a resolution by the City Council stating that the crossings at 173rd Avenue, and the private crossing south of 171st Avenue, will be closed as soon as the 171st Avenue railroad is open and operational. In addition, the railroad company wants the easement for the 173rd Avenue crossing, which will be closed, vacated within their right-of-way. I have attached a draft resolution for the City Council's consideration, which will accomplish these items. If you have any questions regarding this issue, please call. Sincerely, HOWARD R.
