RE: EAST ELK RIVER RAILROAD CROSSING
Dear Mr. Klaers:
As you are aware, we have completed the negotiations with the railroad company on the
agreement to open a new railroad crossing at 171st Avenue. The final piece of information that
the agreement calls for is a resolution by the City Council stating that the crossings at 173rd
Avenue, and the private crossing south of 171st Avenue, will be closed as soon as the 171st
Avenue railroad is open and operational. In addition, the railroad company wants the easement
for the 173rd Avenue crossing, which will be closed, vacated within their right-of-way. I have
attached a draft resolution for the City Council's consideration, which will accomplish these
items.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION OF THE CITY OF ELK RIVER
AUTHORIZING THE CLOSING OF THE RAILROAD CROSSING ON
173RD AVENUE AND THE PRIVATE CROSSING SOUTH OF 171sT AVENUE
WHEREAS, the City has worked with Burlington Northern and Santa Fe Railway to approve a
new railroad crossing at 171st Avenue; and
WHEREAS, Burlington Northern and Santa Fe Railway has made the opening of the new
crossing at 171st Avenue contingent upon closing the existing railroad crossing
on 173rd Avenue and private crossing south of 171st Avenue;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1.
At the time that the 171st Avenue railroad crossing is opened to traffic both the 173rd
Avenue crossing and the private crossing south of 171 st Avenue shall be closed and the
easement for the 173rd Avenue crossing within the railroad right-of-way shall be vacated.
