Preliminary plat Overview This request is a continuation of the February 16th Public Hearing. This item was continued in order to resolve the issue of screening between Ridgewood Subdivision and Lafayette Woods Third Addition. . 13065 Orono Parkway · P.O. On June 19, 1995, preliminary plat approval was granted by the City Council for a 213 single family lot subdivision with approximately 30 acres of land donated to the City as a charitable contribution. On February 26, 1996, the City Council granted final plat approval for 75 single family lot, Lafayette Woods, and the construction of the necessary streets. On May 19,1997, the City Council granted final plat approval for 51 single family lots, Lafayette Woods Second Addition. The development was approved with sidewalks being constructed along the primary route through the development connecting County Road No.1 and Proctor. Lafayette Woods Third Addition includes the construction of three cul-de-sacs, 195th Circle NW, 196th Circle NW and 196th Court NW. The final plat conforms with the preliminary plat that was approved by the City Council on June 19, 1995. Tree Preservation Plan . The areas proposed for Lafayette Woods Third Addition were rough graded in prior phases and will require no tree removal at this time. Fence Adiacent to Rideewood During the preliminary plat review of Lafayette Woods there was concern from the Ridgewood subdivision to the north that there may need to be some type of fence or barricade constructed along the north borders of this plat to stop trespassing. As a part of the final plat approval in the first phase, the Council attached the following condition: A review of the possible need for a security fence between the proposed development and Ridgewood subdivision be made by the City Council prior to the final plat approval of that phase closest to Ridgewood subdivision. As part of the first phase of Lafayette Woods, the developer donated 30 acres to the City which includes an approximately 100 ft strip of land between the two developments to act as a buffer. The developer has expressed a concern regarding the fence such that the construction of the fence would require the clearing of trees with in the buffer strip. The developer and the former Mayor met with the homeowners association of . The conifer trees will be planted on lots 10 & 11, Block 1, and lots 1 & 2, Block 2 in locations where oak trees were removed because of oak wilt. Buffer A!!reement On February 24, 1999, the developer, staff, and representatives of the Ridgewood homeowners association again met on site to discuss the buffering issue. At that meeting, agreement was made that the developer would plant a combination of conifers and deciduous trees behind on lots 10 & 11, block 1, and lots 1 & 2, block 2 in locations where oaks were removed because of oak wilt and behind lots 7 & 8, block 1 in an opening near the sliding hill tow rope. The developer agreed to plant roughly 40-60 trees in the spring of 1999 with an average size of 10-12 feet. Staff believes that the landscape plan is an accurate representation of the buffer that was agreed upon (See Buffer Plan attachment). Draina!!e. Gradin!! and Utilities The City Engineer has prepared a memo regarding drainage, grading and utility issues associated with this plat (See attached Howard R. Green Co. Memo). Recommendation Staff and the Planning Commission recommend that the City Council approve Resolution No. 99-_ granting final plat approval for Lafayette Woods Third Addition with.the following conditions: 1. A DEVELOPERS AGREEMENT OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL AND NECESSARY IMPROVEMENTS BE PREPARED AND EXECUTED PRIOR TO RELEASING THE PLAT FOR RECORDING. 2. ALL THE COMMENTS OF THE CITY ENGINEER BE ADDRESSED. 3. A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF PUBLIC IMPROVEMENTS BE PROVIDED PRIOR TO RELEASING THE PLAT FOR RECORDING. 4. A SURETY BOND IN THE AMOUNT OF 25% BE PROVIDED TO THE CITY UPON COMPLETING PUBLIC IMPROVEMENTS FOR A ONE YEAR PERIOD TO GUARANTEE QUALITY OF WORK. \ \elkriver\sys \shrdoc \planning\stevewen \ccmmo \p99-4c3.doc . . . A SEAL COATING FEE BE PAID IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT AND PRIOR TO RELEASING THE PLAT FOR RECORDING. 8. STREET LIGHTS BE PROVIDED PER ELK RIVER UTILITIES RECOMMENDATION. 9. A GRADING, DRAINAGE AND EROSION CONTROL PLAN BE SUBMITTED AND APPROVED BY THE CITY ENGINEER. 10. ALL GRADING WILL NEED TO BE CERTIFIED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. 11. A WATER ACCESS CHARGE IN THE AMOUNT OF $300 PER LOT BE PAID TO ELK RIVER MUNICIPAL UTILITIES PRIOR TO RELEASING THE PLAT FOR RECORDING WITH SHERBURNE COUNTY. 12. PRIOR TO THE ISSUANCE OF BUILDING PERMITS, A DEVELOPMENT PLAN WILL NEED TO BE SUBMITTED AND APPROVED OUTLINING THE STYLE OF HOMES AND FINISHED FLOOR ELEVATIONS PRIOR TO THE ISSUANCE OF BUILDING PERMITS. 13. This includes the two cul-de- sacs at the very north end of the project and the cul-de-sac off of Vernon Street on 195th Circle. We find that the final plat follows the approved preliminary plat. The one suggestion we would make is the watermain looping issue and storm drainage to serve these areas has yet to be determined. These utilities might require wider side lot easements in the areas they are constructed. We would suggest that the concept of utility layouts for Lafayette Woods 3rd Addition be approved prior to recording the final plat to ensure that adequate easements are provided for utility purposes. RESOLUTION NO. 99 - CITY OF ELK RIVER A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR: Lafavette Woods 3rd Addition I Case No. P 99-4 WHEREAS, application has been made for final plat approval, pursuant to Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property legally described on attached Exhibit A and hereinafter referred to as "the Property"; and WHEREAS, the application for preliminary plat approval has been referred to the Planning Commission which has given its advice and recommendation to the City Council; and WHEREAS, a preliminary plat of the Property was approved by the City Council on July 21,1997; and WHEREAS, the proposed final plat is consistent with the preliminary plat as approved by the City Council; and WHEREAS, the proposed final plat complies with each of the conditions set forth by the City Council in its approval of the preliminary plat of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELK RIVER, as follows: 1. The physical characteristics of the site, including, but not limited to, topography, soils, vegetation, susceptibility to erosion and . . . siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. D. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required herein. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. G.
