Call Meetina To Order Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order at 6:40 p.m. by Mayor Klinzing. 2. Consider Resolution ADorovina a MnDOT Limited Use Permit for Pedestrian Bridae over TH 169 City Administrator Pat Klaers presented information from the 3/3/99 memo provided by City Engineer Terry Maurer. COUNCILMEMBER THOMPSON MOVED TO APPROVE RESOLUTION 99-24 APPROVING A MnDOT LIMITED USE PERMIT FOR THE INSTALLATION OF A PEDESTRIAN BRIDGE OVER TRUNK HIGHWAY 169. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. Council member Motin expressed concern as to where the pedestrian bridge will be linking up. He stated that he would encourage a process by which a determination or plan may be established to portray what is being achieved. COUNCILMEMBER MOTlN MOVED THAT THE CITY COUNCIL DIRECT THE PARK AND RECREATION COMMISSION TO ESTABLISH A TRAIL SYSTEM PLAN FOR THE EAST SIDE OF HIGHWAY 169 TO LINK WITH THE PEDESTRIAN BRIDGE WITH A VIEW TOWARDS COUNTY ROADS 12 AND 13. COUNCILMEMBER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 4-0. UDdate on County Road 12/13 Imorovement Proiect City Administrator Pat Klaers presented information from the 3/4/99 memo provided by City Engineer Terry Maurer. Pat indicated that the county is still working to acquire the necessary easements Glong CSAH 12 for the completion of their project. One addition has been made to the list of conditions regarding the funding of CSAH 12 and CSAH 13, this being that the City of Elk River will pay its fair share for the reconstruction of CSAH 12, estimated at $150,000 after the increase in ISTEA funding is split between Sherburne County and the City of Elk River. Pat stated that this compromise reduced the City of Elk River's estimated cost for the CSAH 12 upgrade from over $300,000 to the $150,000 range. He also indicated that this information will be presented to the County Board and the City Council will be updated following receipt of the results. aDen Mike No one appeared for open mike. Reauest bv Associated DeveloDers of the Twin Cities, Inc. for Preliminary Plat (Elk River CrossinaL Public Hearina Case No. P 98-8 Reauest by Associated DeveloDers of the Twin Cities, Inc. for Conditional Use Permit. Public Hearina Case No. CU 98-26 Assistant Planner Scott Harlicker presented the staff report for the preliminary plat and conditional use permit requested by Associated Developers of the Twin Cities, Inc. In absence of representation by Associated Developers, discussion was opened with the anticipated continuation to the March 15, 1999, City Council meeting. Elk River City Council Minutes March 8. 1999 Page 3 . Mayor Klinzing opened the public hearing. Kathy Swanberg, P.O. Box 130, Becker, MN, indicated that she recently learned that Associated Developers had declared tha't a private road will be constructed in her area, and was concerned that she (as part owner of that land) would be land-locked out of her own property. She also expressed dissatisfaction with lack of notifications for purchase and option agreements. Kathy continued to state her opinion regarding the developer's cooperation and business procedures, and informed the council of how those actions have affected her and her property. Council member Dietz requested that Ms. Swanberg state information pertaining to the plat being presented to the council, an9 take up unrelated issues with the appropriate parties. Council member Motin stated that although Ms. Swanberg's property is not part of the plat at hand, he too has concerns regarding the structure of the preliminary plat. and the indication of a possible private road. Councilmember Thompson stated that although he understands the concerns with a possible private road, and most likely would not approve of a private road, he concurred with Council member Dietz in that the issue at hand is the preliminary plat. and that it was not the appropriate time to present unrelated personal opinions. e Council member Dietz stated that the city has already set a precedent with the layout of Elk Park Center, and did not believe it to be likely that two cul-de-sac roads and a private road would be approved for this project. Kathy Swanberg pointed out that her discontent with the issue lies mainly with the developer, and the fact that she has never signed nor received copies of purchase and option agreements. There being no further comments, Mayor Klinzing continued the public hearing to the March 15, 1999, meeting at which representatives of Associated Developers of the Twin Cities, Inc. could be in attendance. Following council discussion, it was determined that it is likely that this project will be comparable to the Elk Park Center project. The council expressed interest in this project becoming another Elk Park Center, as it appears to have an excellent traffic flow. Councilmember Thompson stated that he would be open to recommendations provided that a private road would not cause land to the west to become land-locked. 7.1. Review Director of Plannina Selection Process . City Administrator Pat Klaers indicated that consultant Jim Brimeyer, Finance Director Lori Johnson, and he have selected fQur candidates for interviews. Pat stated that Planning Commission Chair Doran Cote and Planning Commissioner Louise Kuester have volunteered to sit in on the interview team. Pat requested that at least one council member also help in the selection process. Elk River City Council Minutes March 8. 1999 Page 4 . Council member Thompson stated that he would be interested in participating on the interview team, as he did during last fall's process. Council indicated that there is no need for the selected top candidate to be interviewed by the City Council, but that the top candidates may come before the council for interviewing if a selection cannot be made by the interview team. 7.2. Update on Liauor Store Manaaer Candidates and Interviews City Administrator Pat Klaers indicated that he and Finance Director Lori Johnson, along with Councilmembers Farber and Dietz, will be conducting nine interviews on March 17 and 18. Pat stated that all nine applicants are very highly qualified, and it may take the committee a second round of interviews to select a top candidate. Council indicated approval to proceed with the selection of the top candidate without council direction, and again welcomed bringing top candidates to the council if the committee cannot make a selection. 7.3. Anoka-Hennepin Technical Colleae Expansion and/or Relocation Plans e Mayor Klinzing indicated that the Anoka-Hennepin Technical College in the city of Anoka is considering options for its expansion and/or relocation. She stated that the two sites being considered are Coon Rapids and Ramsey, and that it is in the best interest of the city of Elk River for this expansion to be as close to Elk River as possible. Mayor Klinzing stated that she will attend a meeting on March 11 to provide input to the MNSCU Board on Elk River's position regarding expansion/relocation preference. Mayor Klinzing will provide an update to the council at the March 15 City Council meeting. 7.4. Call Special City Council Meetina for March 29 to Meet with Plannina Commission for Plannina Department Annual Report COUNCILMEMBER MOTIN MOVED TO CALL A SPECIAL CITY COUNCIL MEETING FOR MARCH 29, 1999, TO MEET WITH THE PLANNING COMMISSION FOR ITS ANNUAL JOINT MEETING AND FOR THE PRESENTATION OF THE PLANNING DEPARTMENT ANNUAL REPORT AS TIME ALLOWS. COUNCILMEMBER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 4-0. 7.5. Cancel 3/22 Special Meetina with HRA and Call Special Meetina with HRA for 4112, 5-6 p.m. COUNCILMEMBER THOMPSON MOVED TO CANCEL THE MARCH 22, 1999, SPECIAL MEETING WITH THE HRA AND TO CALL A SPECIAL MEETING FOR APRIL 12, 1999,5-6 P.M. TO DISCUSS THE DOWNTOWN FOCUS STUDY AND ACTION PLAN. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0. 8. Other Business There was no other business. e . e .
