RE: CSAH 12/CSAH 13 UPDATE
Dear Council Members:
City Administrator Pat Klaers asked me to prepare this memo updating you on the status of the
CSAH 13/CSAH 12 improvements. As of the date of this memo, I have been unable to contact
Dave Schwarting, County Engineer, for a specific update. I will, however, continue to try to
contact Dave and have a more detailed update for you on Monday evening.

It is my understanding that the County is still working to acquire the necessary easements along
CSAH 12 for the completion of their project. As you are aware, the project has federal money in
it, much like Tyler Street. We completed the plans for the County several months ago, and they
have been submitted to MnDOT. I believe that at this point they are rather stagnant at MnDOT
until the County can document that they have the right-of-way necessary to build the project.
At the joint meeting between the City Council and the County Board, a brief discussion of the
financing was initiated, but was rather superficial since the County Board had not been
presented with the proposal that we had discussed with their engineer. Attached is a copy of
the information I had available for that joint meeting but did not distribute. This is the same
information that was discussed with the City Council at a meeting a couple of weeks ago, with
one addition. The last item on the list talks about the City's contribution for CSAH 12. As you
may be aware, the County developed and adopted a cost participation policy last year.
According to the cost participation policy, our estimate was that the City's contribution to CSAH
12 would have been over $300,000. We took exception to the policy and documented what we
thought were fair and equitable charges to the City, in the range of just over $100,000.
However, our objections to the policy did not stop the County from adopting it. The one change
that has transpired since the County adopted this policy is that Sherburne County was granted
more ISTEA monies for the CSAH 12 upgrade. After the County received additional ISTEA
money, the County Board made a policy decision that on federally funded projects, the ISTEA
money would be split between the City and the County. This essentially reduced the City of Elk
River's estimated cost participation for the CSAH 12 upgrade from over $300,000 to the
$150,000 range.

Pat Klaers and I have discussed this dollar amount with Dave Loch and Dave Schwarting. We
have indicated to them that we could support a contribution in this range for the upgrade of
CSAH 12. We, however, were very clear in that our support of this project did not indicate a
support for the County participation policy. In fact, we went so far as to state that we still object
to some of the components of the policy and reserve the right to question them on any future
County upgrade.
I provided this same attachment to Dave Schwarting after the joint meeting, and asked him to
present this information to the County Board at his earliest convenience. He indicated that he
would accomplish this in the near future and will let us know what the results were.
If you have any questions regarding this information, I will be available at the Monday, March 8,
1999, City Council meeting.

CITY OF ELK RIVER-SHERBURNE COUNTY
CSAH 12/CSAH 13 FUNDING AGREEMENT
The City of Elk Rivei' and Sherburne (jounty agree to the following conditions
regarding the funding of CSAH 12 and CSAH 13:
1.
Sherburne County will place its CSAH 13 designation on the newly
constructed road north of CSAH 12 and turn back to the City of Elk
River the existing CSAH 13 alignment. The existing CSAH 13 is in
reasonably good shape, having been overlaid in the late 1980's, however,
the new road will be in substantially better shape and will have a much
longer life cycle prior to needing any significant maintenance.
Therefore, Sherburne County will reimburse the City of Elk River, the
equivalent cost of a 1-1/2 inch overlay on the turnback portion of old
CSAH 13.
The City of Elk River agrees that the construction of the realigned
portion of CSAH 13 north of CSAH 12, including any land acquisition
necessary, will be funded entirely by the City of Elk River with no
contribution from Sherburne County.
The City of Elk River will overlay CSAH 13 from the point of the new
construction to the intersection of Tyler Street. This is approximately
1-1/2 miles. This again would be at no cost to Sherburne County.
The City of Elk River will install a signal system at the intersection of
old CSAH 13/CSAH 12/Main Street at no cost to Sherburne County.
When a signal system is warranted at the intersection of CSAH 12,
realigned CSAH 13, and Tyler Street, Sherburne County will fund 75
percent of the signal system and the City of Elk River will fund 25
percent of the signal system. This funding scenario is based on the
jurisdiction of the legs entering the intersection.
The City of Elk River will pay its fair share for the reconstruction of
CSAH 12, estimated at $150,0000 after the increase in ISTEA funding
is split between Sherburne County and the City of Elk River.
