BackIlround
Phoenix Enterprises is requesting preliminary and final plat approval to
subdivide 6.62 acres into 2 commercial lots. The two lots exceed the
minimum requirements for highway commercial with lot areas of 4.23 acres
and 2.40 acres. The property was originally platted with Hillside Crossing
Two and then again in Hillside Crossing Five.
Site Plan
The applicant is proposing a 26,438 SF Commercial building to contain
Goodwill Industries and Sherwin Williams. Goodwill Industries will include a
retail space, loading and sorting area, and offices. The site plan shows a two
lane drive-thru donation drop-off area with garage doors to the north of the
building. Both Goodwill and Sherwin Williams have loading docks in the
rear of the building.
Vehicular Access
Two access points off Evans St. NW are being proposed. The northern most
entrance presently doubles as an access to Culvers Restaurant. A second
access point is proposed roughly 60 feet north of Coburns access. There is no
access from the Cob urns lot to the proposed lot.
Parking
The required parking for the 2080 SF of office space, 13,884 SF of retail
space, and 9336 SF of warehouse space is roughly 82 parking spaces, or if all
considered retail the requirement would be 133 spaces. The applicant is
proposing 171 stalls, which is more than sufficient to accommodate the
proposed uses and future expansion. The applicant has 12 handicap
accessible parking stalls for the use of Goodwill Industries, which is more
than required.
Signs
A monument sign is proposed for the boulevard adjacent Evans Street. The
location of monument sign is between a 10 foot and a 20 foot drainage and
utility easement.
Proposed building wall signs are shown on the elevations (A4), but are
unspecified at this time. All signs are required to meet Elk River Sign
Ordinance and the PUD Agreement and will require a sign permit.

Pond Area
The pond area to the rear of the site will be fenced off from the commercial
area and left open to the residential area to the east. The fence will be of
wood construction similar to Cob urns with a gate to allow for maintenance
and access in case of emergencies.
Lighting
The site plan shows 2 light standards in the parking lot and 4 in parking
islands. Locating of lights in parking islands can conflict with locating shade
trees in them. Staff requested that deciduous overstory trees be planted in
the parking islands to provide shade over the parking lot; the applicant has
proposed ornamental trees instead.
The building lighting is unclear at this time.
Dumpster Enclosures
The needs of the individual tenants are uncertain and no dumpster location
or structure has been indicated on the site plan. The applicant will be
required to enclose any garbage in a structure to be constructed to match the
principal structure.
DrainaF!e and Utilities
The plat reflects all the required drainage and utility easements.
The Elk River Fire Chief has requested that three additional fire hydrants be
installed as directed by the City Engineer.
Landscapinf[ Plan
The landscape plan appears to conform with the City landscape ordinance.
The landscape ordinance requires 30 overstory trees, 15 ornamental trees,
and 15 conifers. Not more that 50% of those required overstory and
ornamental trees shall be comprised of one species.
All landscaped areas including tree islands require underground irrigation.
All trees or shrubs in lawn areas should be mulched to the drip edge at the
time of planting to prevent damage to the trunks during maintenance and to
enhance moisture retention.

Staff requested that deciduous overstory trees be planted in the parking
islands to provide shade. The applicant felt it best to keep the lights in the
parking islands and provide ornamental trees rather than deciduous.
Park and Recreation Commission Recommendation
On February 10, the Park and Recreation Commission reviewed the plat for
park dedication and recommended a fee in lieu of land to satisfy the park
dedication requirements.
Planning Commission
On February 24,1999, the Planning Commission recommended approval
siting staffs memo with the following additional condition:
. THAT THERE BE NO OUTSIDE STORAGE OF DONATED ITEMS.
Other Planning Commission comments included concerns regarding
screening from the proposed Hillside Estates 8th Addition.
At the public hearing no one spoke for or against the proposal.
. Recommendation
Staff recommends that the Planning Commission recommend approval of the
request by Phoenix Enterprises for the following:
A) Preliminary and final plat of approximately 6.62 acres into 2 commercial:
lots with the following conditions:
1. THAT DRAINAGE AND UTILITY EASEMENTS BE GRANTED TO THE CITY
AS DIRECTED BY' THE CITY ENGINEER, PRIOR TO THE RELEASING
THE PLAT FOR RECORDING.
2. PARK DEDICATION BE PAID IN THE AMOUNT REQUIRED BY THE CITY
AT THE TIME OF FINAL PLAT AND PRIOR TO THE RELEASING THE
PLAT FOR RECORDING.
3. SURFACE WATER MANAGEMENT FEE BE PAID IN THE AMOUNT
REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT AND PRIOR TO
THE RELEASING THE PLAT FOR RECORDING.
4. A WATER AVAILABILITY CHARGE IN THE AMOUNT OF $300 PER LOT
BE PAID TO ELK RIVER MUNICIPAL UTILITIES AT THE TIME OF FINAL
PLAT AND PRIOR TO THE RELEASING THE PLAT FOR RECORDING.
