Overview
In October 1994, the applicant was granted a conditional use permit for a
mineral excavation operation (CU 94-32). The applicant is subject to yearly
inspections and licensing of the operation. As part of the conditional use

permit, a reclamation plan has been submitted with yearly reclamation
required.
The applicant proposes an amendment to the conditional use permit to allow
a temporary building to be used for the processing and storage of peat soils
and vehicle storage. The building is being considered as a temporary
building, as it lies within the reclamation area and in close proximity to a
possible county road connection between Brook Road and County Road
No. 33. On April 19, 1993 The Council adopted an ordinance allowing
temporary structures in the light and medium industrial zones (See attached
minutes).
Building Location
The location of the building was chosen because it is in a low area, out of the
wind and generally screened from adjacent properties by existing vegetation.
Two residences to the north will have an unobstructed view of the building.
The Ronallo residence is roughly 700 feet to the north and the Lemmon
residence is roughly 1000 feet to the north.
.
Due to the temporary nature of the building and the distance from
neighboring residences, staff is not recommending any screening of the
building from the north.
County Engineer Comments
The County Engineer, Dave Schwarting was asked to comment on the
location of the proposed because of the proximity to a possible County Road
connection between Brook Road and County Road No. 33. The County
Engineer expressed no concern regarding the proposed location because the
building is temporary and the road being a only a long term possibility.
BuildinI! Department
The Building Department has concerns with the building proposal in regards
to ventilation, irrigation, restrooms and septic, and access to the building.
Approval will be contingent on the building meeting the Uniform Building
Code and the concerns of the Building Department (See attached letter from
Cliff Skogstad).
Planning Commission
At the February 23, 1999, public hearing, John Weicht spoke on behalf of the
. applicant and answered questions of the Planning Commission. Mr. Lemmon,

one of the neighbors close to the proposed building spoke and said that he has
no problem with the building. The Planning Commission was concerned
with the unresolved building code issues, the classification of "temporary"
building, and whether or not to allow the building to vary from the Elk River
Architectural Standards. The Commission approved of staffs recommended
conditions with the following addition:
· THAT THE BUILDING CONFORM TO THE ELK RIVER ARCHITECTURAL
STANDARDS.
Recommendation
Staff recommends that the Planning Commission recommend approval of a
conditional use permit amendment to allow a temporary storage building
with the following conditions:
1. THAT THE BUILDING CONFORM TO THE UNIFORM BUILDING CODE AND
THE RECOMMENDATIONS OF THE ELK RIVER BUILDING AND ZONING
DEPARTMENT.
2. THAT THE BUILDING BE ACCESSIBLE BY EMERGENCY VEHICLES AND
THE ACCESS BE CONSTRUCTED TO SPECIFICATIONS RECOMMENDED BY
THE CITY ENGINEER.
. 3. THAT THE BUILDING BE LIMITED TO THE PROCESSING AND STORAGE OF
SOILS AND VEHICLE STORAGE.
4. THAT THE BUILDING BE CONSIDERED TEMPORARY AND CAN BE
REMOVED FOR RECLAMATION OR ROAD CONSTRUCTION PURPOSES
ONCE THE MINERAL EXCAVATION HAS CEASED.
5. THAT THE BUILDING CONFORM TO THE ELK RIVER ARCHITECTURAL
STANDARDS.

Re: Plaisted Companies New Building
Dear Mr. Weicht:
As per the review of the plans you submitted to me, my concerns that will need to be
addressed prior to submittal of the final plans are as follows:
1.
State plumbing code does not allow the floor drain in a commercial establishment
to be run to daylight and because of equipment being stored in this building, all
floor drains shall go to a flammable waste trap.
2. Mechanicals will be a concern since' we will be dealing with a combustible
product and because this product is a dry substance airborne combustibles will be
a concern as to how they will be eliminated, such as a bagger or exhausting, etc.
3. Heating will also be a concern because of the airborne product.
4. Even through this building will be there for a minimum of20 years, a unisex
bathroom should be installed because of employees working there for bagging the
product.
5. Provide information as to the storage of all products in this building. If this peat
will be stored outside or inside bagged or stockpiled.
6. A structural engineer will be required to sign off on this building.
7. A mechanical engineer will be required for all mechanics.
.
8.
If a bathroom is required, a septic system and design will be required with the
plans submitted.
If you have any questions regarding my findings, please don't hesitate to call me at 441-
4903.
Sincerely,
Clifford M. Skogstad

SLlbject: Spontaneous Combustion of Peat
Dear Todd:
. Thj~ let~er follows up on our l'ecen~ telephone con'iersution regarding sp('mlllneous combustion
(sclf-hetlting) of peat. As you know. this phenomenon only occurs under very special
circumstances when mc)isture content, supply, of air (oxy~cn). density of peat, and volume of peat
are ideally suited for seJf-heating. Thi5 huppen.s most often when peat is loosely put intO piJes ,
that are marc than 60 cubic yards. In these piles, $c.lf-hcatil1J can be &reutly reducoo by driving
heavy equipment over the piles. . This significantly reduces the available oxygen for self-heating.
Regardins packaged peat (loose-filled or compressed). there: bas never been; to my knowledge in
2.5 years of working witfl peat products. self-heating of peat in packages. Packaged peat,
. especially if it compressed. dramatically reduces the available oxygen needed for self-heating. .l
know of!IO examples of self-heating pack:lged peat, regud!ess of whet~et' it is stored inside a
heated or unheared building Of oluside in the elements. '
I hope this infonnation is helpful to you in h.mdliTlg )lour peat. Pleuse feel free t" call me at
(218) 120-4324 if you would like to further diliCUS$ this matter.
Sincerely.
