Issue

At the March 15th Council meeting the Council postponed action on the
preliminary and final plat. The St. Louis Park Sportsmans Club was
concerned about the plat's affect on the operation of their trap range. The
City's firearm ordinance does not allow the discharge of firearms within 500
feet of plated property. To address this issue the City Attorney drafted an
amendment to the firearms ordinance that would allow the Sportsmans Club
to continue to operate as they currently do.

Recommendation
It is recommended the City Council approve the preliminary plat and
Resolution No.99-_ approving the final plat for Star Light Estates with
the following conditions:
1. All comments of the City Engineer be addressed.
2. Comments in the letter from Sherburne County Public Works Department
be addressed.

RESOLUTION NO. 99 -
CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
STAR LIGHT ESTATES
Case No. P 99-3
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on March 15, 1999; and
. WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.

to, topography, soils, vegetation, susceptibility to erosion and

March 17, 1999
TO: THE ELK RIVER CITY COUNCIL
Reference: Case No. P 99-3,
Request by Art Peterson to subdivide a 16 Acre Parcel into a 2.5 acre
single family residential lot and a 13.35 acre outlot, "Star Light Estates".
At the City Council Meeting on Monday, March 15, a proposal was made to modify the
City's Gun Ordnance, Section 404.12.2.B as it refers to the 500 foot requirement.
My previous measurement of 250 feet ( as stated in my March 15 letter to the City
Council) was made last Winter when there was a lot of Snow on the ground and I paced
off the distance for an approximate measurement. In light of the proposed modification to
the Gun Ordnance, Merle Kratzke and I went out to the Range on Wednesday, March 17
and accurately measured the distance from our Shotgun Shooting Pads to the Art
Peterson's property line using a 100ft Tape Measure. The distance from the Club's
Shotgun Pads to the property line is "212 Feet" instead of "250 Feet" as previous stated
in my March 15 letter.
. The St. Louis Sportsmans Club is an Organized Gun Club and we only shoot inward
toward the center of our range. At no time will we be shooting toward the property
boundary. In addition, the Club permits "No Hunting" of any kind on the Range
Property.
If possible, I would like a copy of the Proposed Changes to the Gun Ordnance before the
Meeting on April 5. I could pick it up at the City Hall or you could E-Mail it to me at the
address below.
If I can be of any further assistance to you in regards to the Proposed Changes to the Gun
Ordnance, please call me.
