vicinity or the public health, stifety, morals, comfort, convenience or general welfare of the neighborhood or the

2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderlY development and improvement of surrounding vacant properry.
4. Will be seroed adequatelY b and will not adverselY qffect essential public facilities and seroices including
streets, police and fire protection, drainage, refuse disposal, water and sewer !)1st ems, parks and schools; and
will not, in particular, create trcifJic congestion or interference with trcifJic on acfjacent and neighboringpublic
thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be
detrimental to atry persons or properry because of excessive trcifJic, noise, smoke, fumes, glare, odors, dust or
vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor importance.
7. Will fullY complY with all other requirements of this Code, including atry applicable requirements and
standards for the issuance of a license or permit to establish and operate the proposed use in the city.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
section 30-654.
Overview
.
The applicant would like operate a middle school at 555 Railroad Drive. The location of the
proposed facility will be within an existing building located on the site. They are utilizing three
rooms in the building, two class rooms and an office. The portion of the building was formally used
by a Montessori school. The building is shared by the Bishop George W. Speltz Middle School, a
credit union and a glass business. The applicant is presendy located at 19277 Vernon Street, near
Meadowvale School
Analysis
Floor Plan
The applicant is proposing to occupy three rooms located in the southeast comer of the front of the
building. The space includes two classrooms and an office.
Operation
Attached is the narrative of operational procedures submitted by the applicant. Classes will be held
Monday-Friday 9:30 AM to 11:30 AM and 12:30 PM to 3:00 PM. There is a fenced playground area
located on the west side of the parking lot. The fenced area was installed as part of the Montessori
school.

Site Impacts
No alterations to the site are proposed. The applicant will utilize the existing playground and parking
lot. No internal changes will be needed to accommodate the preschool.

. Recommendation
Staff recommends that the Planning Commission recommended approval of the request to operate a
preschool at 555 Railroad Drive with the following conditions:
1. The requirements of the Chief Building Official shall be met.
2. The applicant shall receive a license from the State of Minnesota prior to commencing
operation.
3. Signage shall comply with the sign ordinance.

FIRST STEP PRESCHOOL
I would like to request a conditional use
permit to house a preschool at 555 Railroad
Drive. Our preschool would utilize two
rooms and office space as outlined on the
enclosed site and building drawing. We
operate Monday through Friday, following
the public school calendar.
My preschool licensure authorizes me to
operate nine sessions per week, housing 20
children per classroom, for a maximum
capacity of 40 children.
I have owned and operated First Step
Preschool in Elk River since 1986.
Presently we are located at 19277 Vemon
Street in Elk River. Due to ownership
changes, I need to find new space. Enclosed
is a copy of my license, site and building
plan, brochure and application.
