MEMORANDUM TO: Planning Commission FROM: Chris Leeseberg, Planner ~ DATE: February 23, 2005 SUBJECT: Case No. CU 05-02 Request by Amanda Hill for a Conditional Use Permit to Operate a Hair Salon Request The applicant is requesting a Conditional Use Permit to operate a hair salon out of her home. Location 19371 Zumbro Court Lot 30, Block 2, Nordic Hills Zoningl Land Use R1c (Single Family Residential) / UR (Urban Residential) 60 Day Rule In order to comply with Minnesota Statute 15.99 (60 - Day Requirement), action must be taken on this request by April 1, 2005. Planning Commission / CU 04-41 January 25, 2005 Page 2 Overview The planned hair salon will be for a single station providing hair services to an established clientele numbering around 150 persons. The applicant will have a small retail area for the selling of items such as shampoo, conditioner, styling products, and styling tools. Analysis The home is located on an approximately 2.3-acre lot with the majority of the site covered with a drainage and utility easement. The property is within the urban service district. The chemicals generated from a home salon operation will not have any adverse effect on the city's system. The amount of chemicals would be far less than a commercial salon produces. The waste water treatment plant is equipped to handle this type of product. The proposed salon will be located in the applicant's basement in a single room. The salon will be accessed via the front door of the house. The hours of operation, by appointment only, will be: Monday-Saturday: 9:00 a.m. - 9:00 p.m. It is anticipated that no more than two client vehicles will be on the premises at anyone time and clients will park in the driveway. There is sufficient parking available in the driveway to meet the parking needs of the business and the residents. Parking for the business shall not be allowed on the street. No signage is proposed. Standards for Issuance of a Conditional Use Permit The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, i,!jure or detrimentallY cifftct the use and ef!Jqyment of other propertY in the immediate viciniry or the public health, scifery, morals, comfort, convenience or general welfare of the neighborhood or the ciry. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderlY development and improvement of surrounding vacant propertY. 4. Will be sef7Jed adequatelY !?J and will not adverselY cifftct essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer .rystems, parks and schools; and will not, in particular, create trciffic congestion or inteiference with trciffic on acfjacent and neighboring public thoroughfares. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to a'!)! persons or property because of excessive trqlJic, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor importance. 1. Will fulfy compfy with all other requirements of this Code, including a'!)! applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the ciry. If denial of such a permit should occur, it shall accompany recommendations or determinations by fIndings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. Recommendation Staff recommends that the Planning Commission recommend approval of the request with the following conditions: 1. The salon shall comply with all Building Code requirements. 2. The applicant shall meet all state licensing requirements. 3. If additional work stations or equipment are to be added, the applicant shall apply for an amendment to the Conditional Use Permit. 4. There shall be no parking for the business allowed on the street.
