Adopt, by resolution, the following agreements with MnDOT for improvements associated with the
TH10 bridge and pavement replacement project:
1. Limited Use Permit for a nonmotorized recreational trail along TH10 from Gary Street to Simonet
Drive.
2. Cooperative Construction Agreement for signal system replacement to Joplin Street and stormwater
pond maintenance.
Background/Discussion
The agreements are necessary for improvements to be completed by MnDOT as part of their scheduled
2017 and 2018 TH10 project.
The Limited Use Permit allows for the placement of a recreational trail in MnDOT TH10 right-of-way.
This agreement covers the segment of trail that will be constructed by MnDOT with this project from
Gary Street to Simonet Drive. MnDOT will construct the trail on our behalf at their cost. Future
extension of the trail to Proctor Avenue and lighting will remain city costs and be constructed as planned
in 2020.
The Cooperative Construction Agreement details financial obligations for cost participation on the signal
system replacement at the intersection of TH10 and Joplin St. MnDOT, through their evaluation of the
location of the existing signal system, has determined in order to fit the rebuilt island locations the system
needs to be replaced. Our obligations for participation in the replacement costs are consistent with the
cost participation detailed in the Traffic Control Signal Agreement entered into in 1996 as referenced in
the Agreement. In addition to the signal replacement, the state will install flashing yellow arrows for left
turning movements. City stormwater obligations prescribed in the agreement are limited to routine
checking and debris management in the new basins.
Financial Impact
The Cooperative Construction Agreement details city-obligated costs of $148,324.00 for the portion of
the rebuilt signal system. This expense will be submitted for reimbursement through our State Aid
account.

A Resolution of the City Council of the City of Elk River Approving a State of
Minnesota and Minnesota Department of Transportation Limited Use
Permit for a Non-Motorized Recreational Trail
WHEREAS, a recreational trail will be constructed along TH10 from Gary Street to
Simonet Drive; and
WHEREAS, for placement of a recreational trail in a state right-of-way, the city must
approve a Limited Use Permit for a non-motorized recreational trail from the State of
Minnesota and Minnesota Department of Transportation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows: Limited Use Permit 7102-0017 for the use and maintenance of
a non-motorized recreational trail within the right-of-way of TH10 is hereby approved and
the mayor and city clerk are authorized to execute said permit on behalf of the City of Elk
River.

A Resolution of the City Council of the City of Elk River Authorizing
Agreement No. 1027153 with the State of Minnesota, Department of
Transportation for Signal System Revisions
WHEREAS, MnDOT is reconstructing TH10; and
WHEREAS, part of the work is the replacement of a signal system and construction of
new stormwater basins.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows: the City of Elk River enter into MnDOT Agreement No.
1027153 with the State of Minnesota, Department of Transportation, to provide for
payment by the City of Elk River to the State of Minnesota of the city’s share of the costs of
the signal system revision construction and other associated construction to be performed
upon, along and adjacent to TH10 from 388 feet west of Joplin Street to 146 feet east of
Xenia Avenue within the corporate city limits under State Project No. 7102-127
(TH10=003). It is further resolved that the mayor and the city clerk are authorized to
execute the said permit on behalf of the City of Elk River.
