Overview
The proposed planned unit development and preliminary plat is an extension
of the Hillside Estates development along 193rd. The proposed plan includes
plating 43 acres into 61 single family lots and the extension of 193rd to the
eastern limits of the plat.
The proposal is consistent with the concept plan approved in 1992. That
conept plan showed 193rd extending to the east boundary of the plat with
Existing Conditions
There is a Northern States Power Company easement running diagonally
across the northeast portion of the site, a Northern Natural gas easement
along the east boundary of the plat and a United Power easement along the
west boundary of the plat.
The site is rolling wooded terrain except for the area included in the NSP
easement. There are several isolated wetlands on the site
Wetlands
There are several wetlands located throughout the site. These will have to be
identified and delineated. The extension of 193rd will require filling one of the
wetlands. The development Lots 17 and 18, Block 4 will be impacted by
wetlands; options to address this issue include adjusting the lot lines or
filling the wetland. The applicant will be working with the City regarding all
necessary wetland permits.
Streets
As part of this project 193rd is proposed to be extended through the plat to it's
eastern boundary. 193rd is proposed to be a boulevard design with a median
down the middle. Two small eye brow cuI de sacs will installed along 193rd.
By doing this, driveways on 193rd will be greatly reduced. All but 3 of the 10
lots fronting on 193rd will have access from these cuI de sacs. The median
will have to be designed so it does not impair visibility and is easy to
maintain.

A second access into this project will be a connection to Auburn Street
through Hillside Estates 4th. This street will connect to 193rd and also to a
proposed cuI de sac. There are 4 cuI de sacs proposed.
Lots
The lots in this plat range in size from about 14,000 square feet to 49,000
square feet with an average lot size of 20,779 square feet. Some of the lot
lines should be adjusted so they better line up and eliminate odd corners. The
property within the NSP easement will be platted as outlots and will contain
a drainage pond and trail corridor. Most of the gas line easement on the east
boundary of the plat will also be an outlot and will contain a trail corridor.
There are 6 lots with double frontage and 3 lots with triple frontage. A
landscaped easement on 193rd should be provided for those double and triple
frontage lots. It appears from the grading plan that a 50' to 120' wide strip of
existing trees will be maintained along the north side of 193rd except for a
small area at the northeast corner of the cuI de sac and 193rd. This small area
will have to be reforested. A similar situation exists on the south side of
193rd.
. Grading, Drainage and Utilities
The City Engineer will address grading, drainage and utility issues in his
memo. I would like to point out the developer is proposing an unusual
location for a drainage pond; he is proposing to construct a drainage pond in
the right-of-way for 193rd at the east boundary of the plat. It might become
an issue when the time comes to put in a street and the residents loose what
they thought was a pond
Rezoning
For this project to proceed as proposed, the applicant is also requesting a
rezoning from R1e (Single Family Residential) to a PUD (Planned Unit
Development). The PUD allows for more flexibility is design of streets and
lots. All the lots will meet the minimum dimensional requirements of the
original zoning district (R1e). The PUD also allows for a comprehensive
review of the project.
Planning Commission Meetin{!s

The Planning Commission spent several months reviewing this project. Most
of the issues related to grading and drainage and tree preservation. At the

public hearings there were seven residents that offered comments. Most of
those comments related to traffic on Auburn Street. Several residents
expressed concern about the loss of trees and existing problems in other
phases of this development.
Recommendation
The Planning Commission recommended the City Council approve the
rezoning request from Rle (Single Family Residential) to a PUD (Planned
Unit Development) based on the following findings:
1. A PLANNED UNIT DEVELOPMENT ALLOWS A COMPREHENSIVE REVIEW OF DEVELOPING
THE PROPERTY.
2. THE PROPOSED REZONING WILL BE CONSISTENT WITH THE CITY'S COMPREHENSIVE PLAN.
3. A PLANNED UNIT DEVELOPMENT ALLOWS FOR FLEXIBILITY IN SUBDIVISION DESIGN.
The Commission recommended the City Council approve the conditional use
permit and the preliminary plat with the following conditions:
1. A DEVELOPERS AGREEMENT BE PREPARED OUTLINING THE TERMS AND CONDITIONS OF
THE PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS BE PREPARED AND
EXECUTERD PRIOR TO RELEASING THE PLAT FOR RECORDING.
2. A PLANNED UNIT DEVELOPMENT AGREEMENT IS PREPARED AND EXECUTED PRIOR TO
RELEASING THE PLAT FOR RECORDING.
3. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% OF THE COSTS
OF PUBLIC IMPROVEMENTS.
4. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM ACCEPTED BY THE
CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE IMPROVEMENT COSTS SHALL
BE SUBMITTED TO THE CITY FOR A ONE YEAR PERIOD.
5. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME
OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING WITH SHERBURNE
COUNTY.
6. A SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY ENGINEER BE PAID TO
THE CITY PRIOR TO RELEASING THE PLAT FOR RECORDING WITH SHERBURNE COUNTY.
7. A GRADING AND EROSION CONTROL PLAN AND DEVELOPMENT PLAN BE SUBMITTED
AND APPROVED BY THE CITY ENGINEER PRIOR TO THE ISSUANCE OF BUILDING PERMITS.
8. ALL GRADING WILL NEED TO BE CERTIFIED PRIOR TO ISSUANCE OF BUILDING
PERMITS.

Dear Planning Commission Members:
Since last month's Planning Commission meeting when the commission reviewed the HillSide
Ninth Addition, we have had a chance to meet with the developer and his engineer to discuss
changes to the grading plan. The revised grading plan is included in this month's planning
commission packet. It reflects a much more realistic plan of what needs to be graded initially
and what grading can be left to the discretion of the homebuilder, depending upon the size and
style of home to be constructed on the lot. Most of the deficiencies that we noted with the
grading plan presented at last month's meeting have been changed. Most notably, the house
pads at the north end of the plat that were below grade have been raised and the house pads in
the southeast corner of the plat that appeared to be too high and have steep driveways have
been adjusted. The developer has also adjusted the grade on 193rd Avenue providing for
landing areas for the intersecting street.
The current grading plan shows a heavy line indicating the approximate mass grading limits.
We would suggest that in four areas these be expanded to a somewhat larger area. We make
this suggestion because in these areas there is cross lot drainage that needs to be established
prior to any homes being constructed. The areas in question would be in phase 2 Lot 16 and
17, phase 3 Lots 3 and 4 and phase 4 Lots 25 and 26 and 29 through 33. With those minor
adjustments to the mass grading limits, we would recommend approval of the revised grading
plan.
Because of the effort to minimize the removal of vegetation, there are still a number of areas
where cross lot drainage does not specifically follow lot lines, therefore, would not be within
normal drainage and utility easements required on the plat. In these areas, the developer will
need to provide additional drainage and utility easements to accomplish this drainage.

The drainage and utility comments contained in our letter dated February 19, 1999 are still valid.
As of this date, we have not seen any revised drainage calculation. The one change that has
been made is the water main is now shown to looped between phases 1 and 4. However, the
other cul-de-sacs referenced in our previous letter are not shown to be looped at this time.
If you have any questions regarding any of these comments, I will be in attendance at your
March 23, 1999 Planning Commission meeting.

RE: AUBURN STREET INFORMATION MEETING MINUTES

Notices were sent to all residents of Hillside Estates 3rd, 4th, 5th, 6th, and ih Addition
regarding the informational meeting held at City Hall, Thursday, March 25, 1999, at 6:00
p.m. The sign-up sheet is attached and contains approximately 46 names. There may
have been others in attendance that did not put their name on the sign-up sheet. Also in
attendance were Council Member Daryl Thompson and City Engineer Terry Maurer.
City Engineer Terry Maurer presented a brief history of the Hillside Estates
Development. An exhibit was presented showing the concept of the whole development
approved in early 1992. Highlighted on the exhibit were the seven additions currently
developed. It was indicated that the first seven additions of Hillside Estates have
followed reasonably close to the approved concept plan from 1992. The preliminary plat
of Hillside Estates 9th Addition which was recently approved by the Planning
Commission, was also discussed showing that it is the future development of the
southeast corner of the Hillside Estates area.
Terry Maurer went on to discuss the history of concerns and comments relevant to traffic
on Auburn Street. Terry indicated that last year the City Council, based on a
recommendation from the Police Department, approved installing speed bumps along
Auburn Street. Due to neighborhood objection, the speed bumps were never installed.
A group of Auburn Street residents continue to meet with Terry to discuss other options
and hit upon the concept of potentially cul-de-sacing Auburn Street from both the north
and south in the power line easement. In 1998, the City Council directed staff to hold
this informational hearing as the next Hillside Estates addition moved forward. It was
clearly stated at the informational hearing that the developer was not opposed to this but
was unwilling to pay for it and that the City Council last year had also shown the
willingness to help the neighborhood but stopped short of agreeing to pay for any
improvements. Therefore, it was indicated at the hearing that the purpose was to
discuss the concept and if there was a desire to move forward by both the residents and
the City Council, the next step would be to discuss options for funding and implementing
the proposed improvements.

The proposed improvements were discussed in general detail. It was indicated that two
back-to-back cul-de-sacs could be constructed in the power line easement. That some
type minor berming and landscaping would be provided between them to discourage any
kind of vehicle traffic between the two cul-de-sacs. It was also indicated that a
pedestrian trail would be constructed between the two cul-de-sacs. The pedestrian trail
could be designed to allow emergency vehicles to pass between the cul-de-sacs.
At this point, the informational hearing was opened up to comments and questions from
the audience. The following is a summary of the general comments and questions
received in no specific order.
. Speed limit signs should be placed on Auburn Street. There are no speed limit signs
within the Hillside Estates plat. (This has been passed on to the Street Department
and will be done this spring).
. If the cul-de-sacs are placed on Auburn Street, more traffic will be using 19th
Avenue. Several residents from 19th Avenue indicated a desire to have no more
traffic on that roadway.
. 19th Avenue should have a centerline stripe and edge markings painted on it.
. 19th Avenue is generally in pour repair and should be upgraded and expanded to
carry the current traffic and certainly should be improved beyond what it is now if
additional traffic is to routed that direction.
. A cul-de-sac should be placed on the north end of Wilson Street at 19th Avenue to
force all of the traffic from Hillside Estates plat to the south and also it would
eliminated the potential for cut-through traffic from 19th Avenue through Hillside
Estates to 193rd Avenue.
. The question was asked how many people from Hillside Estates 5th, 6th, and th
Addition generally exit to the north to 19th Avenue to leave their area. A show of
hands indicated four people normally use this route.
. There was a suggestion that there be a trial period with the Auburn Street blocked
near the power line easement with some type of temporary blockage and also a trial
with the north end of Wilson Street at 19th Avenue blocked to analyze the traffic
patterns with these two scenarios.
. There was a comment made that the power line easement near Auburn Street was
the potential future home of a park area for the Hillside Estates Development. It was
further questioned whether it would be a good plan to cul-de-sac Auburn Street near
a potential park.
. One resident commented that if Wilson Street were cul-de-saced near 197th Avenue,
that would eliminate the opportunity for the Hillside Estates area to exit onto 19th
Avenue and travel east to Tyler Street, a trip this resident indicated, he took often.
In addition to these comments received at the informational hearing, there were six
telephone calls and one letter received prior to the meeting. A copy of the letter is
attached. A summary of the telephone conversations is as follows:

. One telephone call indicated that they lived on a cul-de-sac in Hillside Estates, they
felt they paid a premium for a cul-de-sac lot and did not want to pay for the cul-de-
sacing on Auburn Street.
. One resident along 196th Avenue called to voice opposition to the idea of cul-de-
sacing Auburn Street.
. An unnamed person left a voice mail that they were opposed.
. Two different residents from 19ih Avenue telephoned to voice their concern
regarding increased traffic on 19ih Avenue if Auburn Street were cul-de-saced.
. A resident from Hillside Estates telephoned to suggest that speed limit signs be
placed within Hillside Estates Development specifically along Auburn Street.

I am contacting you in regards to the potential cul-de-sacing of Aubum St. I live on
the comer of lane CT and 196th LN. I feel that cul-de-sacing Aubum St. will put all
potential traffic on 196th LN W1en it is finished. I believe that altemative solutions
would be to add additional stop signs along Aubum. It appears that there are plans to
put additional roads off Auburn and stop signs can be placed at these locations at the
blind points of Auburn. Reduce the speed limit on the area streets and enforce these
laws.
Also, when 196th LN is completed this certainly will lighten the traffic on Auburn. The
problem is from people cutting through to 197th not by the people who live here.
Putting additional stop signs, patrolling the area with radar, and issuing citations will
certainly deter the people from the area. Cul-de-sacing will only be an advantage to
the people on Auburn and hurt the rest of the community. When we purchase the
house it was evident that 196th LN would be used as an inlet to the subdivision but
certainly should not be the only one. I hope that the plans for cul-de-sacing will be
eliminated.
Other issues other than road traffic is emergency vehicle time to get to the area will
increase if they have to start going around Menards area or 197th. I do sympathize
with the people on Auburn but feel that other alternatives can be done before drastic
measures of cul-de-sacing are even realistically considered.

I am writing to you again for our concerns of the cul-de-sacing of Auburn St. If a cuI-
de-sac does happen under the power lines. J would suggest that 1961h LN is cul-de-
saeed at the point where it is now. This would eliminate any potential problems of
1961h LN becoming a throuih street also. Now, we have one entrance into this part
on the sub-division at 197 Ave. All three cul-de-sacs would eliminate the traffic.

least divided evenly. I also was accessed on my 1998 taxes for improvements to
193rd Ave that I do not feel that I should have to pay if I am not going to have access
to use it into my sub-division.

Staff report by Scott Harlicker. Meadowvale Builders, Inc. has requested a
rezoning, preliminary plat and conditional use permit for a 27 townhome PUD
located east of Meadowvale Road, south of 193rd and north of the Burlington
Northern Railroad tracks. Scott reviewed the layout of the plat and issues
regarding the type of buildings to be constructed, landscaping, drainage,
grading and utilities and streets. Scott noted that the fire chief has stated that a
24 foot wide street with no on street parking would be acceptable. Staff
recommends approval of the requests based on the findings and conditions as
outlined in the staff report.

Scott indicated that the property north of the proposed plat is not included in this
proposal. Commissioner Kuester asked the road would need to be wider if they
would be used by any future development to the north. Scott indicated that the
property to the north would have an alternative access. Commissioner Kuester
questioned where the off street parking would be located. Scott indicated that
the proposal does not show off street parking and suggested possible locations
were a few stalls could be located. Commissioner Kuester suggested that she felt
guidelines should be established for off street parking.
Chair Cote asked what the height of the berm would be along Meadowvale.
Scott indicated it would depend on how much space there will be between the
buildings and the sidewalk.
Chair Cote opened the public hearing.
Dave Anderson, 14845 County Road No. 30, representative of the Park and
Recreation Commission, expressed concern that if a berm were required, staff
needs to make sure that it is of significant height to be useful. Mr. Anderson also
expressed his concern regarding the removal of the large oaks on the subject
property. He felt that the community needs to address the preservation of forest
remnants on a large scale, or they will evenutally all be lost to development.

Jay Hill of John Oliver and Associates, representing the developer, indicated that
if the city requires both a berm and a sidewalk, at least 7 additional trees will
need to be removed along Meadowvale Road. He cited the location of two
possible off street parking stalls. Mr. Hill explained that the gas company already
has a concern regarding the amount of blacktopping over the base easement.
He felt that the additional grading needed to create more parking will impact
the wetlands. Mr. Hill indicated that they will try to preserve trees were possible,
but he felt that many of the trees are at the end of their life and have become
hollowed out. He felt that some adjustments could be made in the areas
showing minimal grading to help preserve trees.

Terry Maurer asked that the grading plan be modified to show any changes to
save trees.
There being no other comments from the public, Chair Cote closed the public
hearing.
Scott Harlicker asked that a letter be made part of the official meeting record
from Laura Montoya, 13027 192 Y:z Lane, expressing her concern for the impact
this development would have on traffic, pedestrian safety and wildlife.
Terry Maurer indicated that city staff has expressed their concerns to the County
regarding the need for a pedestrian pathway continued south to Highway 10.
They will continue to work on this issue.
Commissioner Kuester was concern that there was no provision for off street
parking and suggested eliminating 1 building to provide additional parking.
Commissioner Mesich felt the entire area will be flattened during construction
and the development will not be an asset to the community. He was concerned
with the density of the project and felt if less units were constructed, some of the
contours and other natural features could be preserved to make it more
attractive.
Terry Maurer indicated that the density of this development is much less than
other townhome projects in the city.

Commissioner Chambers questioned if the trees being removed would be
replaced with new trees. Terry indicated that the landscaping plan shows tree
replacement.

Tom Ganz indicated that because of the restraints of the wetlands and the NSP
easements, it is not possible to put in more off street parking. Mr. Ganz noted that
a fence will be installed on the south to screen the property from the railroad
tracks and conifers will be planted along the county road.
Scott noted that an eighth condition be included, stating that all wetland
permits be obtained before commencing work in the wetlands.

to discrepancies, property owners within in 350 feet were re-notified by an
updated list from Sherburne County. Staff recommends approval of the requests
based on the findings and conditions stated in the staff report.
Terry Maurer indicated he is satisfied with the recently submitted grading and
drainage plans submitted by the developer. provided the changes which are
addressed in his letter dated March 18. 1999, are incorporated in the plat.

development. but he still had concerns with unresolved issues in his
neighborhood regarding the sidewalk and pond which the developer has not

Dear Planning Commissioners:
As requested, we have reviewed the revised submittal for the Meadowvale Townhomes. This
project is located on the east side of Meadowvale Road just north of the railroad tracks. It
consists of 27 townhome units. There are 18 two-unit buildings proposed and three three-unit
buildings. The submittal was prepared by John Oliver & Associates and consisted of a
preliminary plat, preliminary grading plan, preliminary utility plan, and preliminary landscape
plan. Based on our review, comments received at the staff review meeting and a meeting with
the developer and his engineer, we would offer the following comments.
A. PRELIMINARY PLAT
. The preliminary plat should show a 10-foot drainage and utility easement around the
entire perimeter. ~4)-r
. There is a large wetland complex on the jIesf side of the preliminary plat. This entire
complex should be provided a drainage and utility easement to protect it. The
grading plan also shows two storm drainage sedimentation ponds, these also need
to fall within drainage and utility easements.
. The proposal for this development is to have public sanitary sewer and water main
and private streets and storm drainage facilities. Therefore, a drainage and utility
easement needs to be provided for the public utilities. These public utilities would
include the sanitary sewer, water, and other utilities such as gas, telephone, electric
and cable TV. There are a couple of different ways this can be accomplished. One
is to write the drainage and utility easement that essentially covers the corridors,
these utilities will fall in. A second alternative would be to take the common lot and
provide a blanket drainage and utility easement over its entirety.

· Sherburne County has reviewed this plat and written a letter dated February 17,
1999. They approve of the accesses onto County Road 44 with the conditions that
the southern access be aligned with Elgin Drive as it is shown on the preliminary
plat. The northern access is permitted contingent upon eliminating it in the future, if
and when future phases of this plat provide for an access to 193rd Avenue.
. The County review letter also requested that 50 feet of right-of-way be provided
along Meadowvale Road. The plat does show this additional right-of-way.
. The developer should be required to provide a 10-foot wide bituminous trail along
Meadowvale Road. Recently, the City Council increased park dedication fees. At
this point, no decision has been made on the bituminous trail credit. Up to this point,
a credit of $10 per lineal foot has been granted against the park dedication fee for
trails constructed by the developer. With the increase in the park dedication fee, this
credit needs to be reviewed and determined whether or not it will also increase.
. At the southeast corner of the development where the internal road dead ends a 20-
foot deep "hammerhead" turn around has been provided.
B. PRELIMINARY GRADING PLAN
.
. Steve Rohlf will be reviewing the small amount of filling of the wetland to determine
whether or not this can be done under the expectation in the wetland law. One point
to make, however, is that the wetlands have not been officially delineated at this
time. If the delineation in the spring changes the wetland boundary significantly, this
issue may have to be revisited.
. It has been the City's practice to require a 20-foot relatively flat area at the rear of
residential building units. This in an attempt to provide some semblance of a usable
backyard. Several of the townhome units located adjacent to the wetland complex
have less than 20 feet of usable area out of the back of the unit. We would
recommend that each townhome unit be provided with a minimum of 20 feet of
usable backyard area.
. The grading plan shows grading within the gas line easement. However, it does
appear that most of the grading will maintain or slightly raise the existing elevation.
A permit will be needed from the Gas Company for this grading.
. A new 42 inch culvert is shown crossing Meadowvale Road at County Ditch 31. A
permit from Sherburne County will be necessary for this installation and also it will
likely be necessary for the developer to prove that this installation does not impact
the flood elevation up stream.
. No drainage calculations have been provided at this time. It will be necessary to
submit drainage calculations, have them reviewed and approved prior to final plat
approval.
C. PRELIMINARY UTILITY PLAN
.
. There is an existing 10-inch water main loop running in Meadowvale Road. It is
proposed to connect to this water main at the two road locations and extend lateral
water main into the development. Three hydrants are proposed internal to the
development. Their number and location have been reviewed and approved by the

Fire chief. The two connections to the existing 10-inch water main should be shown
as wet taps. Two additional valves need to be added internal to the development.
One located at the southeast end of the water main system just prior to the last
hydrant. The second one needs to be provided just south of the intersection with the
south access road. It is assumed that the other two hydrants shown in. the
development will be provided with hydrant valves. No where is the size of the water
main noted on the plans. The water main should be eight-inch.
. Sanitary sewer to service the development needs to be brought from the existing lift
station located in the southwest corner of 193rd Avenue and Meadowvale Road is
proposed to be extended along the east side of Meadowvale Road until it gets to the
development and then it is continued internally. The sanitary sewer along
Meadowvale Road will fall under the bituminous pathway so that the manholes will
be located in the bituminous pathway and the pathway can be utilized by sewer
department maintenance vehicles when necessary.
. Permits from Sherburne County will be necessary for the crossing of the sanitary
sewer, the two connections to the water main, and construction of sanitary sewer
along Meadowvale Road within the County right-of-way.
. This plat should pay a trunk sanitary sewer and water assessment along with a
lateral water assessment. There will be no lateral sewer assessment since they are
constructing the sanitary sewer themselves.
