Overview
.
The applicant requests a vacation of a portion of the drainage easements on
Lots 4, Block 8, in the Brentwood subdivision. The existing drainage
easement contains both high and low areas and the request is to remove the
high ground from the easement. The applicant believes the location of the
easement is an error of the Brentwood plat. The applicant will be granting to
the City, 5 foot drainage and utility easements along the common lot lines of
lots 3 and 4 to improve drainage from a low point on 195th Avenue NW to the
low land in the rear of lots 3 and 4 (See the attached memo from Howard R.
Green).

. Recommendation
Staff recommends that the City Council approve the applicants request to
vacate the drainage easement with the following conditions:
1. THAT THE APPLICANT GRANT FIVE (5) FOOT DRAINAGE AND UTILITY
EASEMENTS ALONG THE COMMON LOT LINES OF LOTS 3 &4, BLOCK 8,
BRENTWOOD.

EASEMENT VACATION REQUEST
Dear Councilmembers:
We have reviewed the request by Rivers Crossing, Inc. for the vacation of drainage and utility
easements in Lots 3 and 4, Block 8, of Brentwood Addition. I have discussed this issue with
Gary Santwire. He has indicated that he would like to rework some of the drainage and utility
easements to provide a more reasonable building site on Lots 3 and 4 of Block 8, Brentwood
Addition.
This addition was platted in approximately 1980. Back in that time frame, the City did not require
specific drainage calculations for large rural plats such as Brentwood, but rather looked for
sufficient drainage and utility easements to cover the low areas where runoff would naturally
flow. As a result, Brentwood Addition has significantly more area under drainage and utility
easement than is likely necessary for the runoff from any storm event. Mr. Santwire has
indicated his willingness to work with City staff to provide the necessary new easements for
drainage purposes. Therefore, we would recommend approval of the request to vacate the
drainage and utility easements conditioned up~n Mr. Santwire providing adequate new drainage
and utility easements as determined by the City.
If you have any questions regarding this issue,l will be in attendance at your May 17,1999, City
Council meeting.

RESOLUTION 99 -
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING A DRAINAGE EASEMENT
Case No. EV 99-1
WHEREAS, the property owner abutting the drainage easement has requested
the City Council in a petition dated April 14, 1999, to vacate such
easement according to law; and,
WHEREAS, a public hearing was held on May 17, 1999, before the City Council
at the Elk River City Hall on such petition after due published and
posted notice had been given as well as personal notice to affected
property owners on April 28, 1999, and all persons interested were
given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage, and utility easement described as follows is hereby
vacated:
The drainage and utility easement as shown on Lot 3, Block 8,
Brentwood Addition, Exhibit A
Adopted by the Elk River City Council this 1 ih day of May, 1999.

That part of Lot 3, Block 8, Brentwood, according to said plat on file and record in the office of
the County Recorder, Sherburne County, Minnesota, which lies Easterly, Northerly and Easterly
of the following described line:
Commencing at the Northwest corner of said Lot 3; thence Easterly, along the North line of said
Lot 3, a distance of 125.00 feet, to the actual point of beginning of said line to be hereinafter
described; thence Southerly, parallel with the Westerly line of said Lot 3, a distance of 150.00
feet; thence Easterly, parallel with the North line of said Lot 3, a distance of 30.00 feet; thence
