SUBJECT: Meeting Schedule
Everyone should please bring their calendar to the council meeting so that we
can talk about our summer schedule. It is important to have all
Councilmembers present for certain discussions (i.e. budget meetings) and,
accordingly, I would like to be advised as to planned vacations, meeting
conflicts, etc.

At this time we are planning to have budget meetings with the City Council
on July 26 and August 2. This timeframe will allow staff to present
information to the council and to receive feedback so that a final version of
the preliminary budget can be approved at a special meeting on August 30,
1999. I am not sure if the legislature changed the certification date of the
proposed maximum levy, but it has always been September 15, and the above
timeframe will meet that deadline.
Besides the normal business of the City Council, other meetings that need to
be scheduled include a capital improvement program discussion prior to the
budget meetings, a possible joint meeting with the Ice Arena Commission,
and another possible joint meeting with the Utilities Commission.
Additionally, we have traditionally had a City Council/MnDOT tour (which is
a special meeting), but such a tour has yet to be set up for this spring.

INDEMNITY AGREEMENT
This Indemnity is made thi~d'ay of 111; , 1999 by the CITY OF ELK
RIVER ("Elk River") and in favor of MIDWEST PHAL T COMPANY, a Minnesota
Corporation, ("Midwest").
WHEREAS, Midwest is the owner of that certain real property legally described in
Exhibit A attached hereto (the "Property"); and
WHEREAS, Midwest has authorized Elk River and its Police Department to utilize the
Property as a training location, including the use and discharge of firearms; and
WHEREAS, as a condition to Elk River's continuing use of the Property for those
purposes herein described, Midwest has requested that it be indemnified for any liabilities arising
out of Elk River's use of the property.
NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged by the parties, the parties agree as follows:
1. Elk River hereby agrees from the date hereof, to save, indemnify, defend, and hold
Midwest harmless from any and all liabilities, claims, counterclaims, costs, and expenses of every
kind and nature in connection with Elk River's use of the Property for the purposes described
herein, including all attorneys' fees and costs. It is the intent of the parties hereto that Midwest
have no liabilities or obligations whatsoever in connection with Elk River's use of the Property for
such purposes.
