Revision to the Adoption of the MN State
Building Code
.
In February of this year I presented to you the adoption of the 1997 building codes. With
this adoption, chapter 1340 was the code to adopt for the accessibility code for the State
of Minnesota. This code was a very difficult code being it entailed three separate codes
for compliance to the handicap code. At the time of code adoption, the rules were
undergoing revisions by the division of the accessibility code advisory committee and
were not complete at the time of adoption which is the reason for this amendment to
chapter 1000. Staff is requesting a revision to chapter 1000 to take out chapter 1340 and
add chapter 1341. With this revision it will assist us in the enforcement process of the
accessibility code for all new and existing buildings.
Therefore, at this time staff is requesting that chapter 1340 be eliminated and replaced by
chapter 1341 as the new Minnesota Accessibility Code for the City of Elk River.

AN ORDINANCE OF THE CITY OF ELK RIVER
AN ORDINANCE AMENDING SECTION 1000 OF THE CITY CODE "STATE
BUILDING CODE"
Section 1. Section 1000.00 (1) (A) (x.) of the City Code shall be
amended as follows:
1000.00 - ADOPTION OF THE STATE BUILDING CODE
1. Those portions of the Minnesota State Building Code, as
amended, 1997 Edition, with Appendixes as set forth below are
hereby adopted as the Building Code of the City of Elk River as
follows:
The Minnesota State Building Code includes the
following chapter of Minnesota Rules:
i. 1300 Minnesota Building Code
11. 1301 Building Official Certification
iii. 1302 State Building Construction Approvals
iv. 1305 Adoption of the 1997 Uniform Building Code
including
