Background/Discussion Council previously authorized certain ordinance amendments to allow license approvals by staff. The amendment allows for staff approval of kennel licenses and mirrors the other licensing ordinances already amended. If staff denies a license, an applicant would have an opportunity for a hearing before the City Council. That� 10-83, Kennel permit of the City of Elk River Code of Ordinances shall be amended to read as follows: (a) Required. No person shall own,harbor, or keep upon his premises more than three dogs or cats over the age of six months unless in a commercial or private kennel duly permitted under this section. If the premises are ten acres or more,the person may own,keep, or harbor up to ten cats over the age of six months as long as they have been spayed and neutered and documentation as to that fact is provided. (b) Issuance. No person shall operate a commercial or private kennel in the city without first obtaining a permit. Application for such permit shall be made to the city admintistrator office of the city clerk and shall be accompanied by the permit fee. Such a permit shall be issued b the office of the cioLclerk upon a showing of compliance with all laws and ordinances. (c) Term and renewal,-fee. Commercial and private kennel permits shall be issued oti an ,.fityua tris-- expireiag on December 31of the year issued followifig the first effective day of the kefinel peri . Licenses must be renewed annually. Application for renewal shall be made at least 60 days before the expiration and shall be in the form and manner required for the original license. Upon timely submission of an application for renewal, the office of the city clerk shall renew each license meeting the requirements for the issuance of the original license no later than 30 days before the expiration. Late applications shall be acted upon within 30 days of the application date. -The commercial kennel permit fee-fees shall be as established by ordinances and paid at the time of application..- (d) Maintenance of premises;inspections;revocation of permit. Commercial and private kennels shall be kept in a clean and healthful condition at all times and shall be open for inspection by duly authorized city authorities at any reasonable time. A commercial or private kennel permit may be revoked by the council as outlined in Section 38-35-by reason of the violation of this chapter or any health or nuisance order,law, or regulation. The city clerk shall follow the hearingprocedures outlined in article II of Chapter 38 regarding business licenses and business permits. SECTION 3.
