Action Requested
Recommend, by motion, approval of the zone change from Business Park to Planned Unit Development,
with the following conditions:
1. A PUD agreement must be approved by the City Council prior to recording the Zone Change.
Recommend, by motion, approval of the Conditional Use Permit establishing a residential Planned Unit
Development, with the following conditions:
1. A PUD Agreement shall be developed and signed by both parties prior to issuance of a building
permit.
2. Landscape plan must follow all standards described in Sec. 30 -994 (h)
3. Continue to work with the city to ensure compliance with fire lane access requirements.
4. Update utility and grading plans to include grading elevations, emergency over flows, and
additional storm sewer at the existing curb line of 183 Td Circle and the private street entrances.
5. Update final plans with current Engineering details and standards.
6. Submittal of building plans to verify a garage size of at least 584 square feet or through a
combination of garage and storage areas.
7. Approval of a parking diagram illustrating a minimum of 1 off -street (Public ROB parking space
per two units.
8. A homeowners association must be established, subject to review and approval of the city attomet,
and shall be responsible for all exterior building maintenance, landscaping, snow clearing, and
regular maintenance of private drives and driveways.
9. Submit elevations of townhome exteriors which demonstrate variation in building materials.
Twenty -five percent of the front building facade shall have an exterior finish of brick, stucco, or
natural /artificial stone.
10. All mailboxes shall be clustered.
Recommend, by motion, approval of the Preliminary Plat for The Pines at Elk River.

Background /Discussion
The applicant, Roger Derrick with the Pines at Elk River, LLC, purchased two adjoining parcels on 183rd
Circle NW and is proposing to develop both parcels as 26 detached townhome units. The project will be
similar to the West Oaks project, which was also developed by Roger Derrick. Some units will have the
option for a walkout basement. Kliever Lake Fields and Miske Meadows have also included detached
townhome units similar to those proposed with this project.
Comprehensive Plan
The Comprehensive Plan guides this area as Mixed Use which allows a mixture of housing, jobs and /or
retail services uses within close proximity to each other. The area also provides another setting for high
density residential land uses. The proposed use and rezoning is supported by the comprehensive plan.
The applicant had hoped to develop the area with higher density residential uses, but the road network
does not support the traffic generated by such a use.
Site Plan
The 26 townhome lots are laid out along two private streets, both of which access 183rd Circle NW. The
parcels and placement of the homes have been planned to minimize impacts to existing trees on the site,
buffering the homes from view along Twin Lakes Road and 183rd Circle. Each home will have driveway
access to a private street, and no additional access points to public rights -of -way are proposed.
Townhome standards require one -half guest parking space per unit in an off -street parking lot or private
drive. The private streets appear to provide this standard, but an exhibit demonstrating compliance must
be submitted.
The existing drainage pond on the south side of the site will be utilized for the development. The wetland
was not delineated as there is not any proposed development south of the drainage pond.
Engineering and Utilities
In conjunction with the tree preservation goals, minimal grading to the site has been proposed. Most of
the grading will take place in the center of the site, and the perimeters will be minimally changed.
Properties are graded to direct runoff to the private streets, which collect stormwater via catch basins, and
to the rear of the property. Stormwater collected in the streets is directed to the existing stormwater pond
which was constructed as part of the previous plats.
All homes will be served by city sewer and water.
Landscaping
The proposed landscape plan shows a number of trees along the private streets, and between the
townhomes. An updated landscaping plan demonstrating compliance with Sec. 30 -994 (h) must be
submitted.
Parks
Park dedication was satisfied with previous plats in this area, and will not be collected as part of this
project.

Applicable Regulations
Zone Change
In review in a proposed amendment, consideration shall be given to existing conditions avithin the area directly and in
affected by the proposal, the conservation of proper ty values, the use to avhich the property affected is being devoted at the time,
and relevant provisions, if any, in the land use plan.

The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:

Additionally, Sec 30 -1564 describes the standards for establishment of a PUD district.
1. Land will be honed into the PUD -oning district only upon approval of a conceptplan for the PUD, pursuant
to the procedure set forth in this section. A PUD will be authorised on land in a PUD -oning district only upon
issuance of a conditional use permit, pursuant to the procedure set forth in this section.
A conditional use permit will be issued in accordance with the above standards.
2. The uses allowed in a PUD shall be limited to land uses consistent with the city's comprehensive plan and land
use map, and to those uses identified in the concept plan for the PUD Zoning district and the conditional use
permit for the PUD.
The comprehensive plan and land use map guide this area for mixed use, which includes
residential uses.
3. The area of land to be included in a PUD shall be in uniform control of the applicant.
The applicant will be in control of all parcels prior to recording the CUP and plat.
4. A PUD shall be designed to form a desirable unified environment within its proposed boundaries, including
uniform design elements, landscaping lighting and signage.
The PUD is designed as one project with uniform design elements throughout the project area.
5. A PUD shall not cause undesirable impacts on adjacent lands and land uses. In particular, uses on the PUD
perimeter shall be compatible with adjacent uses outside the PUD.
Adjacent land uses include single - family residential, commercial development, a senior facility,
and developable vacant land. All parcels are within the mixed use are guided by the
comprehensive plan. The PUD will not cause undesirable impacts on adjacent lands and land
uses.
6. A PUD shall be served b_ y adequate transportation, water, sanitary sewer and drainage systems.
The project area will be served by public services, and will not adversely impact transportation
networks within the area.
7. A PUD shall not adversely affect existing or proposed parks, schools, streets or other public facilities.
Existing public facilities are not impacted by the proposed project.
S. The council may establish varied and reasonable lot area, frontage, side yard, and setback requirements for a
PUD and may authorise a density which it determines to be appropriate under the circumstances. Any permitted
density shall be consistent with the city's comprehensive plan and not adversely affect the public health, safety and
welfare.
The proposal is consistent with densities described in the comprehensive plan, setbacks from
public rights -of -way, and design standards for similar developments within city code.
9. More than one principal building may be constructed on a lot within a PUD if authori .Zed by the council.
Unless otherwise permitted by the council, a PUD shall comply with the schedules of dimensional regulations set
forth in this article, except that individual lots shall have no less than 80 percent of the minimum area for similar
uses.

Preliminary Plat
City ordinance section 30 -375 outlines the required findings for approval of a Preliminary Plat.
1. The proposed subdivision is consistent with the honing regulations (article VI of this chapter) and conforms in all
respects with all requirements of this Code, including the honing regulations and this article.
The proposed subdivision requires approval of a rezoning application. Provided the zoning is
amended to PUD, the proposed subdivision is consistent with all zoning regulations.
2. The proposed subdivision is consistent with all applicable general and specialised city, county, and regional p lans,
including, but not limited to, the city's comprehensive development plan.
The subdivision is consistent with all applicable plans.
3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to
erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and
uses contemplated.
Specific concerns related to topography and density have been addressed through the design
process. Additional efforts to reduce impacts to existing trees have also been made.
4. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation,
erosion control and all other services, facilities and improvements otherwise required in this article.
The subdivision includes public utilities and stormwater infrastructure to meet city requirements.
Additional permits required to comply with erosion control standards are a required, and will be
secured prior to building permit issuance.
5. The proposed subdivision will not cause substantial environmental damage.

court.
The site includes existing easements which must be vacated prior to recording the current plat
application.

In reviewing the standards for approval of a Zone Change, Conditional Use Permit, Planned Unit
Development, and Preliminary Plat, the proposed project meets the standards, and is recommended for
approval.

The Pines
NARRATIVE
May, 2017
Pines at Elk River, LLC, has purchased two adjoining parcels on 183r4 Circle NW. We are
proposing to develop the property into 26 detached townhome lots. The Pines will be similar
to West Oaks in that each townhome will be detached and will offer buyers a choice of the
Bridgeport or Wellington designs, with and without sunrooms. Buyers can also choose their
homes to be slab -on -grade or have walk -out basements.
The property is heavily wooded with towering pines. We have designed several lot
plans in an attempt to limit the number of trees that must be removed for construction. That
effort has reduced our original 31 lot plan to 26 lots. This allows us to keep the development
on the flat part of the property, away from the hillsides, and limit the amount of roadway
needed.
We are all very excited about The Pines development and believe it will be a valuable
asset to the community. Thank you for considering our proposal.

base and bituminous surfacing, stormwoter management, and turf
establishment.

The detail sheets indicate erosion nd sediment control BMPS to be installed on the

I. Infiltration area shall be staked off during construction to restrict heavy equipment
troffic from compacting native soils.
2. Install appropriate temporary erosion devices to prevent sediment from leaving
or entering the pr.ctice during construction.

4. Grading of the infiltration basin shall be accomplished using IDw— impost earth— moving
equipment to prevent comps lion of the underlying soils. Small hacked dozers and
bobcats with runner tracks are recommended.
5. Excovole the infiltration basin to the specified depth (elevation). It is recommended
that all sub material below the specified elevation shall be undisturbed.

TIMING EROSION CONTROL
Silt fence will be installed prior to construction
Riprop and tiller blanket will be placed at the outlets within 24 hours
of the outlet placement.
The contractor must stabilize the all exposed soil areas immediately
following construction wherever Construction will not occur for o period
greater than or equal to 7 days.
Stabilization work must be complete within 7 c.lender tloys after the
construction work in that ore. has temporarily or permanently ce.sed.
Arens that o within 2DD ft of o Public Water must be stabilized
within 24 hourrs of completing construction during periods of "Work in
water rest riclions" for time periods declared by the DNR.
The Contractor is esponsible to maintain the disturbed .re. until
vegetation in established.
Once vegetation is established and construction is complete, the silt
fence and any other temporary erosion control that is not
biodegradable shall be removed.
Street sweeping ill be provided on as directed by the Owner The City
may require the Owner to provide Street s eeping. If so the Sireet
sweeping must occur within B hours of of notice from the City.
Applying mulch, hydr.mul.h, t.ckifier, p.1y.cryl.mide or similar erosion
prevention practices is not acceptable stabilization in any port of o
temporary or permanent drainage ditch or ...le.
INSPECTION AND MAINTENANCE ACTIVITIES
The Contractor is to provide o trained intlivitluol responsible Tor the
implementation, inspection ontl maintenance of the erns n ontl setlimenl control
BMPS on the project. That individual is to be identified at the pre — construction
c onterence and listed in the minutes thereof.
The appointed individual is to perform o routine inspection of the entire site at
least once every seven days during construction operations and within 24 hours
otter o rainfall event greater than 0.5 inches in 24 hours.
A recommended inspection form will be provided to the Contractor of the
pr—construction conference. Any deficiencies in the erosion and sediment control
BMPS are to be noted on the inspection form and corrected by the end of the
next business day.
Perimeter control devices are to be repaired or replaced when they are no longer
effective or when the sediment reaches one —half the height of the device.
POLLUTION PREVENTION
Fertilizers are to be applied only in the amounts as specified and worked into the
soil to minimize exposure to stormwoter runoff.
Onsile refueling operations o e to be conducted with c Any inodvertenl spillage
of to el or chemicals is to be immediately cleaned up, removed from the site ontl
disposed of in accordance to State and Local Regulations. Major spills are to be
reported to the MPCA 24 Hour Notification network at 800 422 0798. All vehicles
nsite o e to be monitored for leaks and subject to routine preventive
maintenance efforts to reduce the likelihood of leakage and or spills.
Portable sanitary waste facilities are to be provided onsite and emptied on o
bi— weekly basis.
Concrete botch trucks will not be .11—cl to discharge drum and chute ..shout
directly on the ground. A portable ..shout receptacle is to be provitletl by the
Contractor at the location as provided by the Owner.
FINAL STABILIZATION

uniform, permanent vegetation.
