Request
Consider a request by Meadowvale Builders for final plat of Meadowvale
Townhomes, a 26 lot townhouse development.
Location

The property is located east of Meadowvale Road, south of 193rd Avenue and
north of the Burlington Northern Railroad tracks.

Overview
Meadowvale Townhomes is a 26 lot townhouse project located on
Meadowvale Road just north of the Burlington Northern Railroad tracks.
On May 17, 1999 the City Council approved the preliminary plat for
Meadowvale Townhomes, a rezoning to PUD and the conditional use permit
for the PUD. The applicant is now requesting final plat approval for the
project.

All the lots will have access from an internal private street. There will be two
access points from Meadowvale Road. The utilities will be privately installed.
Grading, drainage and utility issues will be addressed by the City Engineer.
The Park and Recreation Commission recommended park dedication fees in
lieu of land. A bituminous trail will be installed by the developer on the east
side of Meadow vale Road extending from the railroad tracks to 193rd Avenue
.
The final plat is consistent with the preliminary plat approved on May 17,
1999.
Recommendation
It is recommended the City Council approve the final plat for Meadowvale

Dear Council Members:
As requested we have reviewed the final plat for the Meadowvale Townhomes subdivision.
Based upon our review we would offer the following comments:
1. The final plat is providing a 46' wide drainage and utility easement along the road
corridors for the installation for the public sanitary sewer and water systems. It appears
that a hydrant located at the southeast corner of the development may fall outside of the
drainage and utility easement. If this is the case, additional easements should be
provided at this location.
2. It should be spelled out clearly in the development agreement that the storm sewer in
the subdivision is privately owned and maintained because the storm sewer will likely fall
primarily in the drainage and utility easement along with the publicly owned sanitary
sewer and water main.
3. The sanitary sewer to serve the subdivision will be coming from the intersection of 193rd
Avenue and Meadowvale Road. It will come along the east side of Meadowvale Road
adjacent to the proposed Hidden Creek subdivision just north of Meadowvale
Townhomes. If additional easements are not provided at this time along the proposed
hidden creek subdivision it will be impossible to install the sanitary sewer without
encroaching on private property. The sanitary sewer is proposed to fall under a
bituminous pathway adjacent to the right-of-way line. We would suggest that the
proposed Hidden Creek subdivision provide the typical 10' drainage and utility easement
along its western boundary in order to facilitate installation and ongoing maintenance of
the sanitary sewer system.
If you have any questions regarding these comments I will be in attendance at your June 21,
1999 meeting.

RESOLUTION NO. 99 -
CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Meadow Townhomes
Case No. P 99-5
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on May 17, 1999; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C.
The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and

siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
D.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
E.
The proposed subdivision will not cause substantial environmental
damage.
F.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
G.
The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
4. The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire one year from the date of this
resolution if the final plat is not recorded within that time.
The foregoing resolution was introduced by Council Member
