Horton for final plat of Trott Brook Farms First, Second, Third and Fourth Additions. Location . Horton is requesting final plat approval for the first four additions to Trott Brook Farms. Trott Brook Farms received a rezoning to PUD, preliminary plat approval and approval of the conditional use permit for the PUD from the City Council on August 17, 1998. The portion of the project which is to be final platted at this time includes the townhouse development in the southwest corner of the site and the single family lots located to the south, east and west of the proposed park. Overall the final plats are consistent with the preliminary plat approved by the Council. An overview of each addition will be included as part of this memo. The City Engineer will be addressing grading, drainage and utilities for all four additions in his memo. Trott Brook Farms 1st Addition and 2nd Addition The First Addition includes 108 townhouses in the southwest corner of the site. A portion of Street R and all of Street S will be included in the First addition. The layout of the townhouses is mostly consistent with what was approved. The difference is in the middle of the loop. On the approved layout the townhouses were layed out with an 8 plex in the center and a single loaded 4- plex on either side. On the final plat the layout has been modified to two 8- plexes. . The 1st Addition also includes platting the park and trails as outlots. The city will be developing the park. The developer will receive credit for the park land and the trail land towards the park dedication fees. Trott Brook Farms 2nd Addition includes the eastern 28 units of the same townhouse development. A private cuI de sac will be installed as part of this addition. These townhouses are single loaded 4 plexes. The layout has changed somewhat from what was approved by the Council in the preliminary plat. The preliminary plat included one double loaded building. The overall number of townhouse lots in the 1st and 2nd additions has been reduced from 142 to 136. There are 108 lots in the first addition and 28 in the second. Trott Brook Farms 3rd Addition The 3rd Addition includes 47 single family lots, the platting of Street Q, a cuI de sac (Street U) and a portion of Street R. This addition is located on the main entrance from County Road 12 and includes lots on the east and south of the park. The final plat for the 3rd addition is consistent with the preliminary plat. . This addition is comprised of lots located to the west of the park and north of Street R. The 4th Addition is consistent with the preliminary plat. Recommendation It is recommended the City Council approve the attached resolutions granting final plat approval for Trott Brook Farms, Trott Brook Farms 2nd Addition, Trott Brook Farms 3rd Addition and Trott Brook Farms 4th Addition with the following conditions: 1. ALL COMMENTS RAISED BY THE DEPARTMENT OF NATURAL RESOURCES BE INCORPORATED INTO THE PLAT. 2. EACH SINGLE FAMILY LOT SHALL RECEIVE 1 STREET TREE AND 1 FRONT YARD TREE; CORNER LOTS SHALL RECEIVE 1 STREET TREE AND 1 FRONT YARD TREE PER STREET FRONTAGE. THAT THE DEVELOPER PROVIDE A PEDESTRIAN AND MAINTENANCE VEHICLE CORRIDOR TO OUTLET F FROM STREET N AS PER CITY ORDINANCE TO BE COORDINATED WITH A SEWER AND WATER CORRIDOR TO THE EAST OF THE PLAT. FRONT SETBACK OF 25 FEET FROM THE PROPERTY LINES ON ALL STREETS EXCEPT STREETS A, F, J, 0, RAND S. SIDE YARD SETBACKS SHALL BE 10 FEET, 5 FEET ON THE GARAGE SIDE ALL COMMENTS OF THE CITY ENGINEER SHALL BE INCORPORATED INTO THE PLANS. PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS A DEVELOPMENT PLAN BE SUBMITTED OUTLINING STYLE OF HOUSE AND FINISHED GRADES ON EACH LOT. ALL STREETS BE BUILT TO CITY STANDARDS WITH THE EXCEPTION OF STREET A WHICH WILL BE LARGER. A DEVELOPERS AGREEMENT AND PUD AGREEMENT SHALL BE SIGNED AND RECORDED PRIOR TO RECORDING THE PLAT. PARK DEDICATION FEES BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 10. SURFACE WATER MANAGEMENT FEES BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. 11. HOMEOWNERS ASSOCIATION DOCUMENTS SHALL BE REVIEWED BY THE CITY PRIOR TO RELEASING THE PLAT FOR RECORDING. 12. STREET LIGHTS SHALL BE INSTALLED PER ELK RIVER UTILITIES RECOMMENDATIONS. 13. Horton, Inc. for the Trott Brook Development. The first phase of the development consists of four individual plats, Trott Brook Farms, Trott Brook Farms 2nd, Trott Brook Farms 3rd, and Trott Brook Farms 4th additions. We find all four plats to be acceptable with two minor exceptions: 1. The final plats are missing offi~al street names. I believe that the Building and Zoning Department recently provided the developer's engineer with the information necessary to determine the street names for these plats. 2. In comparing the final grading plan with the final plats we have asked the developer's engineer to provide some additional drainage and utility easements for drainage that will cross lot lines. They are currently reviewing this request to determine if they can revise the grading plan or just provide the additional easements on the final plats. With these two conditions we would recommend approval of all four final plats for the Trott Brook Farms development. MEMORANDUM TO: Park & Recreation Commission FROM: Pat Klaers, City Administrator DATE: June 4, 1999 SUBJECT: Trott Brook Farms Since the beginning of the year, there have been a number of staff meetings with the Trott Brook Farms developers. We are now dealing with two developers as the original developer is selling part of the project to another developer. The discussions have concentrated on the developers obligations toward some of the public improvements in and around the plat, and park dedication requirements. Park dedication requirements have changed since the preliminary plat was approved last August. With one motion of the City Council, essentially the park dedication fees doubled from $650 per lot to $1,300 ($1,100 park + $200 trail). A $900 rate was also established for one year for proposals nearing the final plat stage. At that February 22, 1999, council meeting, Mr. Homer Tomkins, developer of Trott Brook Farms spoke to this issue. This issue to Trott Brook Farms is over $400,000 if the fees go from $650 per lot to $1,300 per lot and this is a significant impact on any project. At the February 22 meeting, Mr. Tomkins indicated he was working with the commission and the city on a "package deal" whereby he would be providing land and doing improvements in the park all at once, and then this would complete his park dedication requirements for the entire plat. Everyone seemed to understand that $900 per lot was an acceptable rate to live with and there were concerns expressed about whether or not going to $1,300 per lot for a project already in process was appropriate or fair. In general terms, the proposal that has been presented and which seems acceptable, is that Trott Brook Farms will be given credit for the high land in the park (approximately 8.5 acres) and the high land in the Trott Brook Trail corridor (assumed to be about 1.65 acres). The value of this land is estimated to be between $21,000 and $22,000 per acre. Accordingly, the value the land given to the city would be slightly under $220,000, whereas 600 lots in the total development times $900 per lot equals $540,000. Therefore, the city would receive $320,000 to complete park improvements and/or consider 13065 Orono Parkway · P.O. Box 490. Elk River, MN 55330. TDD & Phone: (612) 441-7420. For example, ownership of Outlot F has yet to be decided as this is in a future phase, and the need for another tot park in the northern part of the plat has yet to be resolved. Assuming that the above financial concept is acceptable, the other main purpose of this agenda item is to discuss the type and quality of improvements in the park. The park development concept has changed slightly whereby the city would get the money and complete the improvements versus having the developer complete the improvements with the city verifying the expenditures. By having the city do the improvements we are on better footing to get "what we want when we want it," to meet the ADA requirements, and to address liability concerns. Accordingly, we need to reach agreement with Mr. Tomkins on what type of improvements would be installed and when improvements would be done. The final plat is going to the City Council on June 21,1999. . . . RESOLUTION NO. 99 - CITY OF ELK RIVER A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR: TROTT BROOK FARMS Case No. P 97-8 WHEREAS, application has been made for final plat approval, pursuant to Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property legally described on attached Exhibit A and hereinafter referred to as "the Property"; and WHEREAS, the application for preliminary plat approval has been referred to the Planning Commission which has given its advice and recommendation to the City Council; and WHEREAS, a preliminary plat of the Property was approved by the City Council on August 17, 1998; and WHEREAS, the proposed final plat is consistent with the preliminary plat as approved by the City Council; and WHEREAS, the proposed final plat complies with each of the conditions set forth by the City Council in its approval of the preliminary plat of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELK RIVER, as follows: 1. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. G. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. 2. Final plat approval is hereby granted for the Property, subject to the conditions set forth in attached Exhibit B. 3. The officers of the City are hereby authorized, once the conditions set forth in Exhibit 8 are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. 4. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded. 5. This final plat approval shall expire one year from the date of this resolution if the final plat is not recorded within that time. THE CITY HAS NOT YET APPROVED THE EXTENSION OF SANITARY SEWER AND WATER SERVICE TO THIS AREA OF THE CITY. THEREFORE, APPROVAL OF THE PROJECT IS CONTINGENT UPON THE CITY ORDERING THE EXTENSION OF SANITARY SEWER AND WATER SERVICE TO THIS AREA OF THE CITY, AND THE DEVELOPER ENTERING INTO AN AGREEMENT WITH THE CITY FOR THE EXTENSION OF SANITARY SEWER AND WATER SERVICE TO THE PROJECT. . .
