Preliminary and Final plat Elk River Plaza 4th Addition, 2. Conditional use permit to amend the Elk River Plaza PUD to allow a 15,000 square foot retail buildings 3. Conditional use permit to amend the Elk River Plaza PUD to allow a 13,000 square foot Class I restaurant and retail space. Overview The owner of the Elk River Mall is proposing to demolish that portion of the mall north of the movie theaters, leaving an end cap adjacent to the theaters, and redevelop the site. The redevelopment plans consist of replatting the existing lot into 3 lots and developing each of the lots. The three components of the redevelopment plans are the construction of a medical clinic, construction of a retail building and the conversion of the end cap into a class I restaurant with on sale liquor and retail space. Scherer Company, current owner of the mall, will be developing the freestanding retail site and the restaurant/retail space. North Memorial Health Care will be developing the medical clinic site. This report will include a review of the plat for Elk River Plaza 4th Addition and the conditional use permits for the retail building and the restaurant! retail space. The clinic, even though it is a component of the overall redevelopment plan, is being brought forward by North Memorial Health Care and will be the subject of a separate report. The applicants, Scherer Company and North Memorial Health Care, will give a joint presentation to the Council. . Preliminary and Final pla t The preliminary and final plat for Elk River Plaza 4th Addition involves replatting Lot 4, Block 2, Elk River Plaza into 3 lots. Lot 1 is 1.7 acres, Lot 2 is 2.5 acres and Lot 3 is 4.1 acres. The existing drainage and utility easements are to remain in place. An additional 10 foot easement will need to be provided along the north property line of Lot 3 and the northwest corner of Lot 1. A 10 foot easement will also have to be provided along the south property line of Lot 3, along a portion of the east property line of Lot 3 and across Lot 2 to the north property line of Lot 2. No new access drives from Freeport are proposed. The project will utilize the existing drives from Freeport Avenue at the north end and middle of the plaza. Adequate parking is being provided on each of the individual lots. However, overall parking in the plaza does not meet the parking requirements for the existing and proposed uses. Cross parking and access easements will be in place to allow all tenants in the plaza, including the theater, use of the entire parking lot. . One is a 15,000 square foot freestanding retail building, the other is a 13,000 square foot restaurant/retail building which will be attached to the north end of the existing theater. The conditional use permits are required for an amendment to the current conditional use permit for the Elk River Plaza PUD. Building Lavout Drug Store The proposed freestanding retail building will be located on Lot 1, which is in the northeast corner of the plaza. A drug store has been identified as one of the tenants for this building. A drive through has been proposed along the north side of the building. Adequate stacking has been provided for that drive through. . The south side of the buildingl or front of the building which faces the restaurant, has facadel15 feet long without any windows. There are 3 brick columns which break up the wall somewhat. Staff would recommend some trees be planted and windows installed to provide a more friendlier appearance to the front of the building. The dumpster enclosure is proposed to be built into the northeast corner of the building. Resta urant/Retail The remaining endcap, which is located on Lot 2 adjacent to the theater, will be converted to a 200 seat class I restaurant, with on sale liquor and 6,500 square feet of retail space. Entrance to the restaurant will be from the northwest corner of the building, and the entrances to the retail space will be from the west side of the building. The exterior of the building will consist of materials and colors which match the theater. Existing dumpsters on the east side of the building will be utilized. Access and Parking There will be two main access points from Freeport Avenue, one at the north end of the plaza and one in the middle. Both drives are existing and will not . be changed. It will serve as the main access for the three new lots which make up this project. There is a driveway between Burger King and the drive through aisle for the retail building which should be closed. Parking is the main issue regarding the proposed redevelopment of the plaza. When the Council approved the theater expansion the plaza was 92 spaces short of meeting the parking requirements. With the proposed redevelopment the parking shortage increases to 279 spaces (1035 spaces required and 756 spaces provided). Parkin(! The proposed uses (clinic, restaurant/retail, drugstore) can meet the required parking. It is the theater, whose expansion was approved in 1997 that is short 348 spaces. When the Council approved the theater expansion in 1997 parking was an issue that received much discussion. It was noted that the key to developing the mall would be diversifying the mix of tenants so the peak parking demands will differ. The applicant has provided documentation supporting their assertion that the proposed uses are compatible with the theater, and, even though the parking requirements are not met, parking should not be a problem. Signage Wall signs are proposed for each of the tenants in the freestanding building. The drug store located at the east end of the building is asking for 2 wall signs, one on the south end and one on the east side facing Highway 169. Wall signage for the restaurant is proposed for the north and west sides of the building. The retail tenant will have a wall sign on the west side of the building. . Individual letters are being proposed for wall signs. The exact size will be established in the pun agreement. It is likely wall signs will be similar to the multi-tenant buildings at Elk Park Center and Hillside Crossing. Two freestanding monument style signs are proposed. A 19 foot tall multi tenant sign is proposed along Highway 169 and a 8 1/2 foot tall multi tenant sign is proposed along Freeport. The drugstore, restaurant and clinic will have space on the monument signs. The sign along Highway 169 will have 80 square feet of sign space and the sign along Freeport will have 48 square feet. Grading, Drainage and Utilities The City Engineer will be addressing grading, drainage and utilities in his memo. Landscaping The landscaping plan is acceptable with minor modifications such as additional trees in the parking islands and along the south and east sides of the drug store building. . Commission Meeting- At the Planning Commission meeting held on June 8th, no one spoke at the public hearing. The Planning Commission focused their discussion on parking. The developer presented documentation, which has been included in your packet, supporting their claim that the new uses are compatible with the theater and the complementary peak hours will not result in a shortage of parking spaces. The Commission felt the new uses would complement the theater and, even though the plaza does not provide the parking spaces required by the Zoning Code, adequate parking has been provided. Internal traffic circulation was also discussed. The Commission asked that the developer approach the theater owners about the possibility of adding a right turn lane to the center drive leading out to Freeport Avenue. The Commission asked the developer to modify the exterior of the drug store building so it more closely resembles the clinic. They felt the boxy, windowless exterior should be coordinated more with the clinic than the theater and restaurant. Recommenda tion The Planning Commission and staff recommend the City Council approve the preliminary and final plat, the conditional use permit for the freestanding retail building and the conditional use permit for the restaurant, with on sale liquor/retail building with the following conditions: Preliminary and Final Plat 1. Drainage and utility easement be shown on the plat per Elk River Utilities recommendation. 2. All comments of the City Engineer be addressed. 3. All necessary cross parking and access agreements be approved by the City Attorney and recorded with Sherburne County. Conditional Use Permit Freestanding Retail Building 1. Windows and trees be provided along the front facade. 2. The access between Burger King and the drive-thru aisle be eliminated and landscaped. The Elk River Plaza PUD agreement be amended to allow a 15,000 square foot retail building and signage as shown on the approved site plan. 5. All wall signs shall require a sign permit and comply with the Elk River Plaza PUD agreement. 6. The landscape plan be approved by the City. 7. Coordinate the facade of the drug store with the clinic. Conditional Use Permit for the Class I Restaurant/Retail Building 1. The Elk River Plaza PUD agreement be amended to allow the 200 seat class I restaurant with on-sale liquor and 6,444 square foot retail space as shown on the approved site plan. 2. The monument sign be installed as shown on the approved site plan and receive the required sign permit. . 3. All wall signage comply with the Elk River Plaza PUD sign agreement and receive the required sign permits. 4. All comments of the City Engineer be addressed. 6. The submittal package was prepared by RSP Architects Ltd. Based upon our review and comments received at the staff review meeting, we offer the following comments: 1. Retail Space A, which is proposed to be the drug store, shows a drive-thru around the east and north sides. The left-hand turn at the northeast corner appears to be very tight. In fact, it appears that the building slightly encroaches into the utility easement at that point. The design in this area needs to be reviewed. This drive-thru needs to be provided with adequate signing that it is one-way. On the north side of the building, there is an existing driveway from the Burger King to the north that leads into this drive-thru. This could lead to some very confusing traffic patterns. We recommend that this driveway be closed as part of the remodeling project. 2. The way the parking is laid out and the lot splits are shown, Retail Space A ends up with a single row of parking at their south property line. This is in the middle of a large parking area for Retail Space A and Restaurant Space C, which is primarily double rows of parking. Single rows of parking without islands to delineate them tend to lead to confusion. We suggest that the parking area be reworked slightly and an attempt be made to get a small median along the south side of this row of parking to clearly delineate that it is a single row of parking. 3. There is no indication on the site plan of where the dumpsters will be located for each of the buildings, or where the loading areas will be provided. 4. The grading plan shows a catch basin in the center of the parking area just north of the clinic. The grade shown from the south curb line closest to the building in this area to the catch basin is 4~ %. Dear Mr. Everson: We have studied the Elk River site plan, tenant mix and tenant parking requirements to develop an estimate of the property's peak parking demands. The results are presented on the Time Vs. Parking Demand figure. You provided the parking requirements of each current or potential tenant. They are: Theater: Drug Store: Gym: Clinic: Retail: Restaurant: TOTAL: 631 stalls 75 stalls 40 stalls 140 stalls 33 stalls 55 stalls 974 stalls The potential available parking will be 845 stalls. Obviously there will be a parking shortfall if the development is considered a single-use site, Le. shopping center. This development is a mixed-use site because of the combination of medical office, retail, and entertainment. Our experience with mixed-use sites is each use may have a different peak parking day & time. For example weekday entertainment use peaks in the early evening after offices close. On weekends offices are typically closed by Saturday afternoon when theater parking increases. Consequently, mixed-use developments can usually reduce their parking capacity 85 to 95 percent of typical requirements, depending on the mix. This is the case at Elk River. The figure illustrates both weekday and weekend parking demands estimated by hour. Parking requirements for each tenant are very conservative. We estimate 100% parking usage for the gym, drug store, & retail, and 100% for the restaurant at peak lunch and dinner hours. AMENDMENT NO.4 to ELK RIVER PLAZA DEVELOPMENT AGREEMENT CITY OF ELK RIVER, SHERBURNE COUNTY, MINNESOTA THIS AMENDMENT NO. 4 is made effective the 21st day of June, 1999, by and between the CITY OF ELK RIVER, Sherburne County, Minnesota (the City), and ELK RIVER SHOPPING CENTER COMPANY, a Minnesota partnership, 9110 83rd Avenue North, Brooklyn Park, Minnesota 55445. WITNESSETH: WHEREAS, on December 24, 1984, the parties hereto entered into Elk River Plaza Planned Development Agreement, which agreement was amended by Amendment No.1 effective December 31, 1985, and by Amendment No.2, effective March 16, 1987, and by Amendment No.3, effective September 21, 1987; and WHEREAS, the City Council on June 21, 1999, approved the Replat of Lot 4, Block 2, of Elk River Plaza, as Elk River Plaza 4th Addition. WHEREAS, on June 21, 1999, the Elk River City Council approved an amendment to the Elk River Plaza Planned Development Agreement to permit the development of Elk River Plaza 4th Addition by the placement of the following improvements on the property: A 15,000 square foot retail building on Lot 1, Block 1, Elk River Plaza 4th Addition; the placement of a 200 seat Class I restaurant with on sale liquor, a 6,500 square foot retail building on Lot 2, Block 1, Elk River Plaza 4th Addition, and the placement of a 40,00 square foot medical office on Lot 3, Block 1, Elk River Plaza 4th Addition. NOW, THEREFORE, it is hereby agreed by and between the parties here as follows: 1.) The Elk River Plaza Planned Development Agreement IS hereby amended to allow the construction of the following improvements: (01) A 15,000 square foot retail building to be located on Lot 1, Block 1, Elk River Plaza 4th Addition; and (02) A Class I restaurant with on-sale liquor, and 6,500 square foot retail on Lot 2, Block 1, Elk River Plaza 4th Addition; and (03) A 40,000 square foot medical office building on Lot 3, Block 1, Elk River Plaza 4th Addition; and (04) A 19-foot tall monument sign on Lot 2, Block 1, Elk River Plaza 4th Addition, and an 8-foot tall monument sign on Lot 3, Block 2, Elk River Plaza as shown on the approved site plan. . . . (05) Wall signage as follows: 1. Free stan dine- retail buildine- on Lot 1 - Each tenant shall have no more than 1 wall sign except for the drug store at the east end of the building, which will be allowed 2 signs. Wall signage shall consist of individual letters. Capital letters shall be no larger than 32" high; lower case letters shall be no more than 24" high. Letters shall extend no closer than 3'-4' from projected lease line. 2. Attached restaurant/retail buildine- on Lot 2 - Restaurant shall have 2 wall signs and retail tenants shall have 1 wall sign. Signs shall consist of individual letters. Capital letters shall be no larger than 32" high; lower case letters shall be no larger than 24" high. Letters shall extend no closer than 3'-4' from projected lease line. 2.) It is further a condition of approval of the authorized development that the same shall be completed in conformance with the attached site plan approved by the Planning Commission and City Council and that all signage and lettering shall be consistent with the approved site plan and as outlined in this amendment. 3.) The words, phrases, terms, and conditions used herein shall be interpreted the same as those used in the Elk River Retail Center Planned Unit Development Agreement. 4.) All other terms and conditions of the Elk River Plaza Planned Unit Development Agreement, as amended, shall remain in full force and effect and shall be binding upon the parties hereto, except to the extent clearly inconsistent with the terms and conditions of this Amendment No.4.
