7.8. SR 07-17-2017City of Elk az — River Request for Action To Item Number Mayor and City Council 7.8 Agenda Section Meeting Date Prepared by Public Hearinj 17, 2017 Zack Carlton, Planning Manager Item Description Reviewed by Zone Change, Conditional Use Permit, and Chris Leeseber , Senior Planner Reviewed by Preliminary Plat: The Pines of Elk River Cal Portner, City Administrator Action Requested Adopt, by motion, an ordinance amending the City of Elk River Zoning Map to rezone certain property from Business Park to Planned Unit Development (PUD), with the following conditions: 1. A PUD agreement must be approved by the City Council prior to recording the Zone Change. Approve, by motion, the Conditional Use Permit (CUP) establishing a residential PUD, with the following conditions: 1. A PUD Agreement shall be developed and signed by both parties prior to issuance of a building permit. 2. Landscape Plan must follow all standards described in Sec. 30-994 (h). 3. Continue to work with the city to ensure compliance with fire lane access requirements. 4. Update utility and grading plans to include grading elevations, emergency over flows, and additional storm sewer at the existing curb line of 183Td Circle and the private street entrances. 5. Update final plans with current engineering details and standards. 6. Submittal of building plans to verify a garage size of at least 584 square feet or through a combination of garage and storage areas. 7. Approval of a parking diagram illustrating a minimum of 1 off-street (Public ROW) parking space per two units. 8. A homeowners association must be established, subject to review and approval of the city attorney, and shall be responsible for all exterior building maintenance, landscaping, snow clearing, and regular maintenance of private drives and driveways. 9. Submit elevations of townhome exteriors which demonstrate variation in building materials. Twenty-five percent of the front building facade shall have an exterior finish of brick, stucco, or natural/artificial stone. 10. All mailboxes shall be clustered. Approve, by motion, the Preliminary Plat for The Pines at Elk River. Background/Discussion Case Nos. ZC 17-05, CU 17-17, & P 17-09 The applicant, Roger Derrick with the Pines at Elk River, LLC, purchased two adjoining parcels on 183Td Circle NW and proposes to develop both parcels as 26 detached townhome units. The project will be similar to the West Oaks project, which was also developed by Mr. Derrick. Some units will have the P a w E R E U 6 Y NaA f RE] option for a walkout basement. Kliever Lake Fields and Miske Meadows have also included detached townhome units similar to those proposed with this project. Comprehensive Plan The plan guides the area as Mixed Use allowing a mixture of housing, jobs and/or retail services uses within close proximity to each other. The area also provides another setting for high density residential land uses. The proposed use and rezoning is supported by the comprehensive plan. The applicant had hoped to develop the area with higher density residential uses, but the road network does not support the traffic generated by such a use. Site Plan The 26 townhome lots are laid out along two private streets (Xavier Circle and Yale Circle), both of which access 183rd Circle NW. The parcels and placement of the homes have been planned to minimize impacts to existing trees on the site, buffering the homes from view along Twin Lakes Road and 183rd Circle. Each home will have driveway access to a private street, and no additional access points to public rights-of-way are proposed. Townhome standards require one-half guest parking space per unit in an off-street parking lot or private drive. The private streets appear to provide this standard, but an exhibit demonstrating compliance must be submitted. The existing drainage pond on the south side of the site will be utilized for the development. The wetland was not delineated as there is not any proposed development south of the drainage pond. Engineering and Utilities In conjunction with the tree preservation goals, minimal grading to the site has been proposed. Most of the grading will take place in the center of the site, and the perimeters will be minimally changed. Properties are graded to direct runoff to the private streets, which collect stormwater via catch basins, and to the rear of the property. Stormwater collected in the streets is directed to the existing stormwater pond which was constructed as part of the previous plats. All homes will be served by city sewer and water. Landscaping The proposed landscape plan shows a number of trees along the private streets, and between the townhomes. An updated landscaping plan demonstrating compliance with Sec. 30-994 (h) must be submitted. Parks Park dedication was satisfied with previous plats in this area, and will not be collected as part of this project. Applicable Regulations Zone Change In reviewing a proposed amendment, consideration shall be given to existing conditions witbin the area directly and indirectly affected by the proposal, the conservation ofproperty values, the use to wbicb the property affected is being devoted at the time, and relevant provisions, if any, in the land use plan. N:\Public Bodies\Agenda Packets\07-17-2017\Final\7.8 sr Pines at ER.docx The proposed use complies with the guidance provided in the land use plan. Conditional Use Permit/PUD The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. mill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the city. The residential use will not detrimentally affect the use and enjoyment of adjacent properties. 2. mill be consistent with the comprehensive plan. The property is guided for mixed use where residential uses are permitted. The use will be consistent with the comprehensive plan. 3. mill not impede the normal and orderly development and improvement of surrounding vacant proper y. The use will not impede the normal and orderly development and improvement of surrounding vacant property. 4. mill be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and server systems, parks and schools; and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. The use will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. 5. mill not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. The proposed residential use will not involve uses, activities, processes, materials, equipment, or conditions that will be detrimental to other properties. The applicant has reviewed the proposal with staff for traffic impacts and fit within the transportation plans for the area. 6. mill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. Grading is proposed to create minimal impacts to natural areas, and the use will not result in the destruction of scenic or historic feature of major importance. 7. mill fully coVywith all other requirements of this Code, including any applicable requirements and standards for the issuance of a license orpermit to establish and operate the proposed use in the city. The use will fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city. Additionally, Sec 30-1564 describes the standards for establishment of a PUD district. 1. Land will be Zoned into the PUD Zoning district only upon approval of a concept plan for the PUD, pursuant to the procedure set forth in this section. A PUD will be authorized on land in a PUD Zoning district only upon issuance of a conditional use permit, pursuant to the procedure set forth in this section. A Conditional Use Permit will be issued in accordance with the above standards. N:\Public Bodies\Agenda Packets\07-17-2017\Final\7.8 sr Pines at ER.docx 2. The uses allowed in a PUD shall be limited to land uses consistent with the city's comprehensive plan and land use map, and to those uses identified in the conceptplan for the PUD Zoning district and the conditional use permit for the PUD. The comprehensive plan and land use map guide this area for mixed use, which includes residential uses. 3. The area of land to be included in a PUD shall be in uniform control of the applicant. The applicant will be in control of all parcels prior to recording the CUP and plat. 4. A PUD shall be designed to form a desirable unified environment within its proposed boundaries, including uniform design elements, landscapin figbting and signage. The PUD is designed as one project with uniform design elements throughout the project area. 5. A PUD shall not cause undesirable impacts on adjacent lands and land uses. In particular, uses on the PUD perimeter shall be compatible with adjacent uses outside the PUD. Adjacent land uses include single-family residential, commercial development, a senior facility, and developable vacant land. All parcels are within the mixed use are guided by the comprehensive plan. The PUD will not cause undesirable impacts on adjacent lands and land uses. 6. A PUD shall be served by adequate transportation, water, sanitary sewer and drainage ystems. The project area will be served by public services, and will not adversely impact transportation networks within the area. 7. A PUD shall not adversely affect existing or proposed parks, schools, streets or other public facilities. Existing public facilities are not impacted by the proposed project. 8. The council may establish varied and reasonable lot area, frontage, sideyard, and setback requirements for a PUD and may authorize a density which it determines to be appropriate under the circumstances. Any permitted density shall be consistent with the city's comprehensive plan and not adversely affect the public health, safety and welfare. The proposal is consistent with densities described in the comprehensive plan, setbacks from public rights-of-way, and design standards for similar developments within city code. 9. More than one principal building may be constructed on a lot within a PUD if authori.Zed by the council. Unless otherwise permitted by the council, a PUD shall comply with the schedules of dimensional regulations set forth in this article, except that individual lots shall have no less than 80 percent of the minimum area for similar uses. The project does not conflict with standards described in city code. Preliminary Plat City ordinance section 30-375 outlines the required findings for approval of a Preliminary Plat. 7. The proposed subdivision is consistent with the honing regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the honing regulations and this article. We are proposing to develop the property into 26 detached townhome lots. The Pines will be similar to West Oaks in that each townhome will be detached and will offer buyers a choice of the Bridgeport or Wellington designs, with and without sunrooms. Buyers can also choose their homes to be slab -on -grade or have walk -out basements. The property is heavily wooded with towering pines. We have designed several lot plans in an attempt to limit the number of trees that must be removed for construction. That effort has reduced our original 31 lot plan to 26 lots. This allows us to keep the development on the flat part of the property, away from the hillsides, and limit the amount of roadway needed. We are all very excited about The Pines development and believe it will be a valuable asset to the community. Thank you for considering our proposal. Infiltration area shall be staked off during construction to restrict heavy equipment troffic from compacting native soils. 2. Install appropriate temporary erosionControl devices to prevent sediment from leaving or entering the pr.ctice during construction. 3. Construct and vegetate bioretenti.n device following stabilization of contributing tlroinoge are.. 4. Grading of the infiltration basin shall be accomplished using IDw—impost earth—moving equipment to prevent compos lion of the underlying soils. Small hacked dozers and bobcats with runner tracks are recommended. 5. Excovole the infiltration basin to the specified depth (elevation). It is recommended that all sub material below the specified elevation shall be undisturbed. 5. In the event that sediment is introduced into the bmp during or immediately following ovation, this material shall be removed from the practice prior to continuing construction. 7. Remove temporary erosion control devices after the contributing drainage are. is .tlequ.tely vegel.ted. Down gradient silt fence ontl sediment log installations are to be inplace prior to the cam mentem enc of any earthwork operations. Topsoil is to be windrowed "long the construction limits and placed os slope dressing immediately following completion of the grading operations, os the grading operations proceed. Topsoil placement along the embankment slopes though the wetlontls are. is to be spread by o low impact c ..ler tractor operating up and down the slopes so as to provide track prints parallel with the contours. Installation of Mn/DOT Category 3 Erosion Control Blanket along the embankment Slopes adjacent the wetlontls are.. All temporary soils stockpiles will require an effective m of sediment control such o n erosion control Dl.nkel Lovering or silt fenced nstallation along the toe of slope. a All completed ditch slopes and bottoms not draining towards the wetlontls area ore to be stabilized within 7 days. Temporary stabilization will be required in are.. here grading operations are suspended or ceased for o period of 7 day. or greater. A rock construction entrance for sediment control is to be provided .t the project drive..ys. Street s eeping of the paved surfaces will be required as directed by the Engineer. Tracked sediments must be removed from II paved surfaces, adjacent roodwoys, and other off—site areas within 24 hours of discovery. TIMING EROSION CONTROL Silt fence will be installed prior to construction Riprop and tiller blanket will be placed at the outlets within 24 hours of the outlet placement. The contractor must stabilize the all exposed soil areas mediately following construction wherever Construction will not occur for o period greater than or equal to 7 days. Stabilization work must be complete within 7 c.lender tloys after the construction work in that are. hos temporarily or permanently ce.sed. Arensthat o within 2DD ft o7 o Public Water must be stabilized within 24 hourrs of completing construction during periods of "Work in water rest riclions" for time periods declared by the DNR. The Contractor is esponsible to maintain the disturbed .re. until vegetation in established. Once vegetation is established and construction is complete, the silt fence and any other temporary erosion control that is not biodegradable shall be removed. Street sweeping 'Il be provided on as directed by the Owner The City may require the Owner to provide Street s eeping. If so the Sireet sweeping must occur within B hours of of notice from the City. Applying mulch, hydr.mul.h, t.ckifier, p.1y.cryl.mide or similar erosion prevention practices is not acceptable stabilization in any port of o temporary or permanent drainage ditch or ...Ie. INSPECTION AND MAINTENANCE ACTIVITIES The Contractor isto provide o trained intlivitluol responsible Tor the implementation, inspection and maintenance of the eros n ontl setlimenl control BMP on the project. That individual is to be identified at the pre—construction c onterence and listed in the minutes thereof. The appointed individual is to perform o routine inspection of the entire site .t least once every seven days during construction operations and within 24 hours otter o rainfall event greater than 0.5 inches in 24 hours. A recommended inspection form will be provided to the Contractor of the pr—construction conference. Any deficiencies in the erosion and sediment control BMPs are to be noted on the inspection form and corrected by the end of the next business day. Perimeter control devices are to be repaired or replaced when they are no longer effective or when the sediment reaches one—half the height of the device. POLLUTION PREVENTION Fertilizers are to be applied only in the amounts as specified and worked into the soil to minimize exposure to stormwoter runoff. Onsite refueling operations o e to be conducted with c Any inodvertenl spillage of to el or chemicals is to be immediately cleaned up, removed from the site ontl disposed of in accordance to State and Local Regulations. Major spills are to be reportedto the MPGA 24 Hour Notification network at 800 422 0798. All vehicles nsite o e to be monitored for leaks and subject to routine preventive maintenance efforts to reduce the likelihood of leakage and or spills. Portable sanitary waste facilities are to be provided onsite and emptied on o bi—weekly basis. Concrete botch trucks will not be .11—cl to discharge drum ontl chute ..shout directly on the ground. A portable ..shout receptacle is to be provitletl by the Contractor .t the location as provided by the Owner. FINAL STABILIZATION Final Stabilization Cc n o re when 70 percent of the pervious area is covered with uniform, permanent vegetation.
