Approve or Deny, by motion, an ordinance establishing a moratorium temporarily prohibiting the
approval of Conditional Use Permits and Zone Changes for properties within the Downtown Zoning
District.
Background/Discussion
On July 3, 2017, the City Council discussed the school district building and development plans for the
downtown zoning district. The school district building is currently for sale and the owners had received
two offers prior to the meeting. Council expressed interest in purchasing or redeveloping the site, and
noted that due to the increased momentum of the Mississippi Connections Plan, this may be a good time
to explore changes to the Downtown Zoning District.
To provide the city with the necessary time to review the desired uses and boundaries for the Downtown
Zoning District, city staff prepared a moratorium temporarily prohibiting approval of Conditional Use
Permits (CUPs) and Zone Changes within the district. A moratorium will provide the city with an
opportunity to review the current uses and boundaries of the district for consistency with the Mississippi
Connections Plan. Planning staff would work with the Planning Commission to bring forward
recommended changes once the review has been completed.

ORDINANCE NO. _________
AN INTERIM ORDINANCE TEMPORARILY PROHIBITING
THE ISSUANCE OF CONDITIONAL USE PERMITS AND CHANGES
TO THE BOUNDARIES OF THE DOWNTOWN ZONING DISTRICT
THE CITY COUNCIL OF ELK RIVER ORDAINS:
SECTION 1. INTENT: It is the intent of this ordinance to allow the City of Elk River
time to complete an in-depth study concerning changes in official controls within the greater
downtown area, and in the interim to protect the planning process and the health, safety, and welfare
of the citizens of the community.
SECTION 2. TEMPORARY PROHIBITION: Pending the completion of the above
referenced study and the adoption of appropriate official controls:
A. No conditional use permits shall be processed or approved and no application for
such approvals shall be accepted for conditional use permits in the Downtown
zoning district. This prohibition does not apply to proposed amendment to existing
conditional use permits.
B. No proposed changes to the boundary of the Downtown zoning district shall be
processed or approved and no application for such approvals shall be accepted
SECTION 3. EFFECTIVE DATE: This ordinance shall take effect from and after its
passage and shall remain in effect until the date of the adoption of the official controls contemplated
hereunder or for one year from the date of the enactment of this ordinance whichever occurs first.
