SUBJECT: Request to Use City Property by
Heritage Festival
Ed Barder, chairman of the Heritage Festival, has submitted a request to the
City Council to use the city's vacant lot located on the corner of King and
Main during the Heritage Festival. As Mr. Barder indicates in his letter,
they would use the lot for the children's games during the festival.
The council recently approved a request from the Arts Council to use the
same location for the Arts Soup Festival that was held in June. The minutes
regarding that approval are attached for your review.

If the council should decide to allow the use of this site, I would suggest that
an informal policy be adopted regarding the use of city property. A
suggestion would be to allow only community events to use city property
upon council approval. Community events would be classified as the Arts
Soup Festival, the Heritage Festival, the 4th of July activities at Lake Orono,
etc.
Mr. Barder will be present to discuss this issue on Monday evening.

The 1999 Great Elk River Rendezvous and Heritage Festival is approaching. I also wish to
thank you on behalf of the committee for your continued help and support. We are still
looking at other ideas and additional support both financially and through volunteers. We
would appreciate any promotion you could provide through your daily contact with the
business and community.
Enclosed is a tentative schedule of he planned events for your reference.
At this time we are also requesting the use of the vacant lot across the street from DehT's
. Funeral Home to use for the kid's games for the festival.

GREAT ELK RIVER RENDEZVOUS AND HERITAGE FESTIVAL
SATURDAY AND SUNDAY, SEPrEMBER 18-19,1999
Headquarters Hours: Sat. 8 AM - 5 PM, Sun. 10 AM - 4 PM
TENTATrvEEVENTSCHEDULE
As the chairman of the 1999 Elk River Heritage Festival I would like to update you on the
planned activities. The following major activities are planned with a number of additional
events and activities, all of which will be planned around the following:
· The festival is scheduled to run the weekend of September 18-19. This should work
well for family participation as all kids will be back in school.
· The Rendezvous is scheduled to begin Friday and run through Sunday. We are
working with local bus companies to arrange transportation for the kids to and from
school. We anticipate a large turnout from the kids and their families.
· A 5K Run is scheduled for Saturday morning. It will begin at the Pinewood Golf
Course and end at the downtown bridge. We anticipate this to run from 7 AM to 9AM.
We are anticipating appro,omately 300-350 participants.
· Thereafter, the Lucky Duck Race) the Walk A Bout and kids activities/games are
scheduled. Other activities and ideas for the kids include a fish pond) potato sack
races) 3 legged races, watennelon spitting contest, egg toss, dunk tank, balloon toss,
horse shoes, corn on the cob eating contest, frog jumping, face painting and anything
else we can come up with.
· Historical tours, bus rides, and the Administration Tent will all originate and be
located downtown. The Walk About is scheduled to run Saturday and Sunday along
with the Lake Orono Tours.
· Horse and trolley rides will all originate from the downtown.
· Vendors will be located all downtowntown.
· Saturday Night the Firemen' 5 Dance is scheduled which we are trying to coordinate
with.
· Sunday the Parade is scheduled and will start at the bridge at Lake Orono and end at
the bridge downtown. This is scheduled to run from 1 PM -2PM.
· An Ice Cream Social is scheduled as a mixer after the parade for all to join in.
Any questions regarding the concessions can be directed to myself or Char at the address
or number above.

7. Other Business
East Elk River Condemnation Process
City Attorney Peter Beck reviewed the status of the eminent domain process for
the eastern area project and distributed a resolution relating to the Eull property.
He noted that the Eull property was excluded from the original resolution which
was adopted by the council to begin the process.
COUNCILMEMBER DIETZ MOVED TO ADOPT RESOLUTION 99-32 AUTHORIZING EMINENT
DOMAIN AND ACQUISITION OF REAL PROPERTY IN ACCORDANCE WITH MINN. STAT.
117.042. COUNCILMEMBER THOMPSON SECONDED THE MOTION. THE MOTION
CARRIED 5-0.
Councl mem er Motin questioned whether the city had a policy regarding the use
of vacant city property. He indicated that he was referring to the request to have
a car show on the HRA King and Main property. He noted that this type of use is a
profit making endeavor and questioned if the city should be involved by allowing
the use of its land. Councilmember Thompson questioned what the city's liability
was regarding these types of situations.
Council discussion pursued regarding the use of vacant city property. It was the
consensus of the City Council not to allow any type of private or public use of the
HRA property at King and Main Street.
COUNCILMEMBER THOMPSON MOVED TO NOT ALLOW USE OF HRA OWNED PROPERTY
THAT IS CURRENTLY FOR SALE FOR ANY PUBLIC OR PRIVATE USE. COUNCILMEMBER
DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-1. Council member Farber
opposed.

Tony Darkenwald and David Raymond, representing the Art Soup Festival
Committee, asked the city to allow use of the King and Main HRA site for festival
activities. Ms. Darkenwald explained that two large tents would be placed on the
site to locate art demonstrations for various age groups. They also requested that
the city approve the closing of Jackson Avenue and King Avenue for the Art Soup
Festival on June 26 and 27th. Ms. Darkenwald explained that booths will be
located in the city parking lot and along Jackson. The "Energy" stage will be
located on city property between the Cinema building and the Sunshine Depot
featuring a variety of local talent.
Council member Dietz questioned why King Avenue is shown as being closed off on
their sketch. Mr. Raymond indicated that the committee felt it would provide a
safer situation for pedestrians going back and forth from the parking lot to the HRA
site exhibits.
COUNCILMEMBER MOTIN MOVED THAT, RECOGNIZING THE CITY COUNCIL'S
PREVIOUS MOTION TO PROHIBIT USE OF THE HRA SITE FOR SCHEDULED ACTIVITIES, TO
ALLOW USE OF THE MAIN AND KING FOR THE ARTS SOUP FESTIVAL ACTIVITIES ON A
"ONE TIME" BASIS, IN CONSIDERATION THAT TIME CONSTRAINTS WILL NOT ALLOW
CHANGING THE LOCATION. COUNCILMEMBER FARBER SECONDED THE MOTION. THE
MOTION CARRIED 4-1. Councilmember Dietz opposed.
City Acceptance of a Portion of County Ditch # 10
Building and Zoning Administrator Steve Rohlf indicated on a map the portion of
Ditch # 10 that Sherburne County will be turning over to the City of Elk River as part
of the Eastern Area Improvements. Staff recommends the Council officially accept
this transfer.
COUNCILMEMBER MOTIN MOVED TO ACCEPT THE TRANSFER OF THAT PORTION OF
SHERBURNE COUNTY DITCH # 1 0 TO THE CITY OF ELK RIVER, AS SHOWN ON THE
ATTACHED MAP, AND FURTHER, THAT THE COUNTY BE ALLOWED TO CONTINUE
OUTLETTlNG INTO THE REMAINDER OF COUNTY DITCH #10. COUNCILMEMBER FARBER
SECONDED THE MOTION. THE MOTION CARRIED 5-0.
Erosion Control for Sinale Familv Home Construction on Urban Lots
Steve Rohlf explained problems with the city's current policy for erosion control
during new construction. He reviewed the proposed revised policy, noting that
input was provided by developers, the Suburban Northwest Builders Association,
and the City Engineer. Steve indicated that staff is proposing to require 2 rows of
sod around the entire perimeter of new developments, and silt fencing and rock
driveways will only be required on lots with a steep grade to the street. He further
proposed that the city's public works department will sweep the streets on a
regular basis until a subdivision reaches 75% occupancy. The cost of sweeping the
streets will be paid by the developer. Steve indicated that the policy will be
