Request by Marshall Concrete to Construct
a Storage Building, CU 99-17
The City Council tabled action on this request at its June 21,1999 meeting. Additional
information was requested regarding the "temporary" nature of mineral excavation
activities.
Previous Approvals in the ME. Mineral Excavation District
On March 15, 1999, the City Council approved a similar request by Plaisted Company
to allow a storage building on property at 11555 205th Avenue, within the reclamation
area. The building was approved with the following condition:

THAT THE BUILDING BE CONSIDERED TEMPORARY AND CAN BE
REMOVED FOR RECLAMATION OR ROAD CONSTRUCTION
PURPOSES ONCE THE MINERAL EXCAVATION HAS CEASED.
On November 18, 1996, the City Council approved a request on the subject property
(21566 Highway 169) for a ready-mix plant for Marshall Concrete with the following
stipulation:
THE OPERATION SHALL NOT INTERFERE WITH FUTURE
RECLAMATION OR OTHER RESTRICTIONS PLACE ON THIS SITE
ACCORDING TO THE EXISTING MINERAL EXCAVATION LICENSE
ON THE PROPERTY OR THE CITY'S ENVIRONMENTAL IMPACT
STATEMENT ON MINERAL EXCAVATION.
City Council Recommendation
Staff recommends that the City Council approve the request, CU 99-17 by Marshall
Concrete to construct a storage building with either of the above conditions added to
the following condition previously recommended:
1. THAT THE BUILDING CONFORM TO THE UNIFORM BUILDING CODE AND ANY
CONCERNS OF THE ELK RIVER BUILDING AND ZONING DEPARTMENT.
