SUBJECT: Request to Authorize Bids for Ice Arena
Bleachers
The council has been updated a number of times, either at meetings or
through articles included in the monthly informational memo, about the new
bleacher safety law. This law went into effect August 1, 1999, and the city is
required to certify compliance by January 1, 2001.

This law will require almost every city, county, and school district in the
state to do remodeling on newer bleachers, more substantial work on older
bleachers, and to simply remove and replace very old bleachers. The cost of
this work will be substantial and limited state funds are available for this
state mandate. Many local officials expect modifications to this law next year
or additional funding to be provided by the state.
The outdoor bleacher issue for the city relates to the softball fields and the
indoor bleacher issue for the city relates to the ice arena. The city will work
on the outdoor bleacher issue at the end of this year and in 2000, and on the
ice arena's new bleachers and the bleachers upstairs in the Barn either this
fall or next year.
The real issue at this time are the bleachers downstairs at the Barn. Now
that the city has requested the building official to inspect the bleacher
situation, the building official has advised me that these bleachers must be
brought up to code immediately or be removed. Furthermore, the building
official, street superintendent, ice arena manager, and bleacher "consultant"
have all advised me that these bleachers cannot be economically repaired or
restored into a condition that would meet code and, therefore, should be
removed and replaced. As I understand the situation, these bleachers never
complied to any code, state or local, when they were installed in the 1970's
and therefore have no "grandfathered in" rights. Additionally, now that the
city is aware of a potential dangerous situation, it has an obligation to
respond.

Bleachers were reviewed in the capital improvement program material that
was part of the June 28, 1999, City Council packet. The plan noted that
some bleacher work will need to be done this year and the funding source
suggested for this expenditure is the NSP reserve. Rich Czech has discussed

this issue with bleacher consultants and it is believed that new bleachers can
be installed for somewhere in the $30-35,000 range. The project can be
completed in 9-10 weeks from the date of ordering, and the new bleacher
capacity will be in the 200 range versus the existing old bleachers holding
270 spectators.
We would like to advertise for bids for new bleachers as soon as possible in
order to have them installed for the upcoming season. Additionally we would
like to request proposals for the removal of the old bleachers as a separate
item. We may be able to have the bleachers removed at no cost depending on
the scrap value of the materials involved (or we may actually make some
money on this bleacher removal). Furthermore, we are evaluating whether
or not it is cost effective to have our city street crew remove these bleachers
and have these materials available for re-use by our street/park department.

Recommendation
It is recommended that the City Council authorize going out for bids for new
bleachers in the Barn (old ice arena section) and that the city also does a
request for proposal for the removal of the old bleachers.

SUBJECT: Ice Arena Bleacher Review
Since the final approval ofHF787 for bleacher safety, Rich Czech and I have done
numerous inspections to the existing bleachers at the Elk River Ice Arena for code
compliance. In my findings the majority of the bleachers can be brought into compliance
with the new safety codes for bleachers prior to the January 1,2001 deadline. I will be
working with Mr. Czech for the completion ofthese corrections. My biggest concern
however, is the lower bleachers in the old ice arena. When reviewing an existing
structure or bleachers, you would use the code in which it was constructed. The lower
bleachers do not comply with any code for that time of construction. The following are
the corrections needed to be in compliance.

. The structural frame work is not in compliance with the codes, a structural engineer
will need to design the corrections for the lower bleachers .
. The toe board spacing is in excess of 4".
. The rise and run of the stairs for the bleachers are not in compliance with the code.
With the design of the existing bleachers and the space needed for the stairs it would
be very difficult, if not impossible, to design the stairs for these bleachers.
. The guardrails on the ends of the bleachers have spacing in excess of 4". They shall
be finished offto have a maximum space of 4". This design ofthe guardrail shall
restrict climability. The height ofthe guardrail shall be a minimum of 42".
. Handrails shall be required for all stairs with three or more stair treads.
. The head room for all walking areas shall be 7' minimum.
With the corrections needed I am requesting the lower bleachers not be used by
occupants of the building until they are brought into compliance with the 1997 Building
Code. Because of the corrections needed to bring the bleacher into code compliance my
recommendation will be the removal of the existing bleacher and the purchase of new
bleachers for the lower level.

Bids were opened for the Barn bleachers last Friday August 27, 1999 (please
see bid package). Three companies came out to look at the bleachers,
however only one, Earl F. Anderson made a bid on the project. Obstacles
such as low head clear~ce, multi level floors, and limited space made it
impossible-for companies to come in with a standard model that they could
just install. Companies wishing to bid on the project had to spend some time
considering all the obstacles when designing the bleachers, companies
without strong engineering could have found it difficult to proceed with the
project.
I have. checked several references for Earl F. Anderson and have found them
to be well respected. I also have checked references on Aluminum Seating,
which will be manufacturing the bleachers and have also found them to be a
respectable company as well.
The insulation of the bleachers is projected to take nine to ten weeks, thus
putting completion date around the middle of November. Games for the High
School Boys begin late November so it is important that a decision be made.

The preliminary plans that I have reviewed with the company representative
comply with the Uniformed Building Code of 1997 as well as the Minnesota
amendments for 2001. Cliff Skogstad, City Building Official, and myself will
be monitoring the construction of the bleachers making sure all codes are met.

With the front of the walkway being fifty inches high, the existing Plexiglas .
will not fully protect people walking along that area or people in the first row.
The Plexiglas will have to be seventy eight inches. or higher in order to
completely protect these areas. Twenty eight pieces will have to be replaced
at a cost of about $2,600. The existing supports will need to be extended in
order to support the extra height of the glass. I am hoping the High School
metal shop can accomplish this relatively inexpensive.
I am working with Phil Hauls Streets Superintendent and the S.T.S. (Sentence
to Serve) program supervisor for the removal of the existing bleacher. I feel
that within a week that the existing bleachers could be removed. The metal
would be scraped. The price of scraped metal is low at this time, so we do
not expect a large amOl.tht of money from it. The wood would be stored at the
Street department and would be used for general projects.
I recommend that the council approve Earl F. Anderson for the installation of
the new bleachers for the Barn.

Bid specifications for bleachers in thc Barn
The following specifications are intended to specify the requirements for furnishing and
installing new (unused) bleachors along the eastsidc of the Barn side at the Elk River
Arena.
1) General:
Bleachers must comply with the Uniform Building Code of 1997 (UBC97), and
Minnesota amendments for 2001.
Bleache.rs should utilize the eastside of the Arena for maximum seating. Specifications
should include seating capacity. The area behind the bleachers should be utilized for
standing room for spectators when possible. Bleachers must be installed by qualified
personal.

2) Labels and WarniDS!s
Equipment shall comply with the National Safety Council recommended practices for
signs and warnings. .
3) Guarantee
The bleachers shall cafry a minimum of a one-year warranty on labor, and a three _
years warranty on parts.
4) 'References
The bidder shall furnish the names of ten (10) locations where they have furnished
and installed bleachers. Along with the names of the locations, bidc;ler shall furnish
complete addresses, telephone numbers and contact persons. Bidders failing to
furnish this information may be disqualified.
5) Time Table
The completion date for the insulation of the bleachers should be within 9 (nine)
weeks (63 days) from the award of the contract
