Background/Discussion The applicant is proposing a preliminary plat for 36 single family lots. The property is zoned R1-c (Single Family Residential). The minimum lot size for lots in the R1-c district is 11,000 square feet with a minimum lot width of 80 feet (100 feet for corner lots) and a minimum lot depth of 130 feet. The proposed preliminary plat meets all the dimensional requirements. Analysis Comprehensive Plan The property is identified as a residential land use. Urban Residential includes land for residential use in areas that are currently served by municipal sanitary sewer system. Urban Residential land uses include single family detached housing and attached housing in the form of duplexes and townhomes. The use will be consistent with the comprehensive plan. Transportation/ Circulation The plat will be accessed by Baldwin Street from the west and by 195th Avenue from the north. A through street connection will be created with the extension and intersection of Baldwin Street and 195`h Avenue. There will be two cul-de-sacs (Carson Court and 195th Circle) off of these two streets. Utilities The 36 lots will be served with municipal services. Stormwater/Grading/Drainage The proposed development is still being reviewed in accordance with the Stormwater Ordinance Sections 78-503 and 78-504 Environmental Wetlands are present on site and are delineated on the plans. As you indicated, I received a Notice of Public Hearing in the mail for this development(Case No. P 17-15). Unfortunately I am unable to make it to the Planning Commission public hearing tonight. With that in mind I wanted to provide some comments that I hope you can pass along. Here are my comments: • When I purchased my home a few years ago I contacted the City planning department. I was made aware that this area could be developed at some point in time. Obviously it would be great if this property remained undeveloped (we really like the quietness and privacy)but at the same time I realize that development is probably inevitable. • One of the nice features in this neighborhood is the mature trees. These are great to have in our yards as well as between houses/streets. A lot of neighborhoods are built on old farm fields and don't get this opportunity. Looking at the map provided on the back of the Notice of Public Hearing,it looks like there are a fair number of trees in the proposed development area,particularly around the cul-de-sac on Baldwin Circle(where I live). The majority of these trees are not on our property(or anyone's on the cul-de-sac)but it would be greatly appreciated if they could keep as many of these trees as possible. This will maintain the feel/appearance of the neighborhood that so many of us appreciate. In addition, I think people who purchase homes in the new development would like these trees and it would increase their property value. • With this in mind I would like to request that the developer prepare a tree preservation plan as part of the plat process. While I realize some trees may need to be removed for construction, I believe it is in everyone's best interest to maintain as many trees as possible. Thank you for taking this into consideration. I have spoken about this development with my neighbors on the Baldwin Circle cul-de-sac and we all share in these concerns. If it helps, I would happy to obtain signatures from my neighbors who are in support of the comments included in this email. Landscaping requirements for permitted single-family uses in all districts are as follows: (1) Applicability of requirements. All permitted single-family properties shall comply with the requirements of this subdivision when new developments or expansions are to occur on these properties. (2) Minimum requirements.All open areas of a lot which are not used and improved shall be landscaped with a combination of overstory trees,ornamental trees, coniferous trees, shrubs, flowers,and turf or permitted ground cover materials. The minimum number of trees in the front yard is two. a. Location of required front yard trees. 1.One tree must be located in the boulevard area and shall be an overstory type tree. 2.A second tree shall be located in the front yard area. (2) The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans, including, but not limited to, the city's comprehensive development plan. The proposed subdivision does not conflict with any city,county,or regional plans,including the Comprehensive Plan. (3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. Case #V 17-06—Parent Builders Variance 1. The property owner has submitted a Wetland Conservation Act (WCA) application for proposed impacts to the wetlands on site including a delineation of the site. The proposed driveway location will impact approximately 120 square feet of Type 2 wetlands.This will fall under the de-minimis exemption and will not require any replacement plans.The Technical Evaluation Panel has already visited the site and is in support of the discussed driveway location. Staff will support the variance request as the location will result in the minimum amount of wetland impacts. The WCA Decision will be noticed once the finalized site plan is received and approved by staff. 2. Case# CU 17-18—Swan Companies/Coborns 1. No concerns or issues with the application as proposed. 3. Case # P 17-13—Doug Warneke DHJ Plat 1. No concerns or issues with the application as proposed. 4. Case# Regenscheid/Robert Stuttgen—Trace Heights Second Addition 1. No concerns or issues with the application as proposed.The applicant also submitted a delineation for the site which shows two wetlands on the 56.4 acre parcel. The applicant is requesting a wetland type confirmation and delineation concurrence for the Type 3 shallow marsh and Type 1 seasonally flooded basin via WCA. These will be reviewed by the Technical Evaluation Panel later in August and a decision will be made regarding the wetland boundaries after that.There are currently no proposed impacts to the wetlands or 45 foot buffer setback. 5. Case # LU 17-04,ZC 17-06, CU 17-19—Stars Hollow/Quintus 3D 1. This site has a wetland basin on the north edge of where the applicant plans to build their facility. The site was reviewed by a Board of Water and Soil Resources (BSWR) Wetland Specialist and a conservative boundary was determined for the approximate edge of the wetland and the 45 foot setback was determined off of that. Staff recommends putting that wetland area into an easement to ensure the wetlands are not impacted.There was no delineation required as this area was a conservative estimate to ensure all possible wetlands are protected. The applicant may qualify for energy efficiency rebates for use of LED bulbs and energy efficient items. No other concerns or issues with the application as proposed. 6. Case # OA 17-09—City of Elk River Ordinance Amendment 1. No concerns or issues with the application as proposed. 7. Case# P 17-16—City of Elk River Simple Plat—Outlot B, Parkview Addition 1. This site is located within the Wild and Scenic River District which limits impervious surface to 25% and has strict design criteria to visual conceal structures from the river view, set forth by the Minnesota Department of Natural Resources. DNR Area Hydrologist for Sherburne County discussed this site with staff and agreed that the development could occur and meet the goals of the District,as long as visual concealment is maintained.
