Adopt,by motion, a resolution declaring certain property as dedicated for right-of-way and open to the
public.
Background/Discussion
The proposed resolution designates Outlot B of Cascade Industrial Park,which the city just acquired, as
public right-of-way so the northern portion of parcel 75-013-1412 will have access to a public street (163rd
Avenue) and the John Lenz plat (Elk River Screw Job) can be recorded.

Resolution 17-___
A Resolution Declaring Certain Property as Dedicated for
Right of Way and Open to the Public
WHEREAS, the 2003 approval of the Cascade Industrial Park plat, was on condition that
Outlot B of the plat be deeded to the adjacent property so that all properties have access to a
public street; and
WHEREAS, Montgomery Family Partnership LLP, a Minnesota limited partnership, has deeded
to the City of Elk River, Outlot B, Cascade Industrial Park, Sherburne County, Minnesota,
according to the recorded plat thereof; and
WHEREAS, the City desires to dedicate Outlot B to the public for right of way purposes as
part of 162nd Avenue N.W.;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota, as follows:
1. The City Council hereby dedicates Outlot B, Cascade Industrial Park, to the
public for right of way purposes and open to the public for travel as part of 162nd Avenue N.W.
