River MEMORANDUM TO: Mayor & Council FROM: Sandy Peine, City Clerk DATE: September 8, 1999 SUBJECT: Consider Recodification Process of City Code PURPOSE: The purpose of this memo is to educate the Council on the recodification process of the City Code. It is also staffs intention to inform the Council of the proposals the City has received for the recodification of the City Code. . BACKGROUND: The City Code was originally adopted on May 3, 1982. Prior to adoption, the code was codified by the City's Attorney David Sellergren. Since that time the code has been kept up-to-date by incorporating the new ordinance amendments into the code. WHAT WILL RECODIFICATION ENTAIL? The City has budgeted to have the City Code recodified. Recodification of the code will include a legal review of the Code and subsequent ordinances against current state statutes and court decisions. The review will point out conflicts, inconsistencies and obsolete provisions in conjunction with current state statutes, as well as conflicts within the code itself. The Code will be reorganized and renumbered to enhance usefulness. TDD & Phone: (612) 441-7420. Fax: (612) 441-7425 . REQUEST FOR PROPOSALS: The City sent out RFP's for recodification to five companies. Four RFP's were received. (SEE ATTACHED RFP RESULTS CHART). . General Code Publishers - $16,800 . Lea e of Minnesota Cities/American Le . Sterling Codifiers, Inc. - $9,400 Michele McPherson and I reviewed the proposals. We each reviewed the proposals independently and came to the same conclusion. I did a more thorough review by conducting a telephone interview of each company and checking the references of our top two choices. . Michele and I are recommending that the City hire Municipal Code Corporation to recodify its city code. The main reason for this recommendation has to do with the legal review process. The RFP required that a legal review be provided. Sterling Codifiers, Inc., came in the lowest in price however, the review process is done by publishers because there are no attorneys on staff. Municipal Code Corporation has several Attorneys on their staff to provide the legal review process. REASONS FOR RECOMMENDING MUNICIPAL CODE CORPORATION (MCC): . There are several attorneys on staff . Legal review of code provided by attorneys . Conference with MCC Attorney, City Attorney and Department Heads is part of the process which allows for much City participation . Reference Checks - Chanhassan - Has been working with MCC since 1984 and is very satisfied with their service and process . MCC works with 30-40 Minnesota Cities including St. Paul, Minneapolis, Blaine and Eagan . Kent Suelm of the LMC indicated that the League went through this same RFP process and MCC was the League's 2nd choice. ACTION REQUESTED: . Council approval to hire Municipal Code Corporation at $13,700 to recodify the city code.
