Adopt,by motion,resolution for Final Plat of Trace Heights Second Addition with the following conditions: 1. A Development Agreement must be signed by the city and developer prior to releasing the final plat for recording. 2. A Letter of Credit shall be provided to the city in the amount of 100% of the costs of the public improvements. 3. Upon completion of all improvements and acceptance by the city, a security or warranty in a form acceptable to the city engineer must be secured. 4. Development Plan shall be approved by the city engineer prior to issuance of building permits. 5. All appropriate grading permits must be obtained prior to commencing work on the site. 6. Grading and Erosion Control Plan be submitted and approved by the city engineer prior to the issuance of building permits. 7. Surface Water Management Fee be paid for 18 lots at the rate applicable at the time of Final Plat approval (currently$233). 8. Park Dedication shall be provided in the form of cash for 18 lots at the rate applicable at the time of Final Plat approval (currently$1,425.93). 9. A 10'wide bituminous trail, centered in a 20' trial easement, shall be installed in a location approved by city staff. 10. Any item or condition found that indicates the site is likely to yield information important to pre-history or history shall be reported to the city immediately. Further, the city reserves the right to stop work authorized in its approval until the site is appropriately investigated and work is authorized. Background/Discussion The applicant proposes to subdivide 53.77 acres into 18 parcels and one Outlot. The subject property is generally east of Auburn Street, south of 205th Avenue,west of Vance Street, and north of the 201st Avenue alignment. The property is zoned Single Family Residential (R1-a) with minimum lot sizes of 2 '/z acres. The proposed plat meets the dimensional requirements required by ordinance, and the Outlot is proposed to be used for stormwater collection. The Elk River Vision A PehoMing community 2a itb revolutionary and spirited resourcefulness, exceptional POWERED By service, and community engagement that encourages and inspires prosperity INAMIRE1 Analysis Comprehensive Plan The property is guided for residential land uses outside of the Urban Service Area (i.e.,not currently served by municipal sewer and water). The predominant land use in this area is single family detached homes. Transportation/Circulation Access to the site will be via two street connections,one at County Road 33 and another at 202nd Avenue/Zane Street. The proposed plat will have two streets (B & C on the preliminary plat) that will eventually extend into the parcel to the northeast of the subject site. During the April 17, 2017, City Council work session, Council indicated they would be supportive of not requiring a cul-de-sac on what is identified as Street B on the preliminary plat. Council also supported staff's recommendation that no site access to Lot 1, Block 2 be allowed from Street B, and this street will not be maintained at the developer's expense until it is extended in the future. As requested, a cul-de-sac easement has been provided on Street C as the applicant will install a temporary cul-de-sac. Landscaping The landscape plan dated September 7, 2017, satisfies the ordinance requirement of two trees per single- family lot. Environmental The applicant submitted a wetland delineation for the site which shows two wetlands on the 56.4 acre parcel. The applicant is requesting a wetland type confirmation and delineation concurrence for the Type 3 shallow marsh and Type 1 seasonally flooded basin via the Wetland Conservation Act (WCA). This was reviewed by the Technical Evaluation Panel (TEP) and there are no issues with the delineation. There are currently no proposed impacts to the wetlands or the required 45 foot buffer setback. Parks and Recreation The Parks and Recreation Commission recommended the plat of Trace Heights Second Addition pay a cash dedication for 18 dwelling units at the rate applicable when the subdivision is released for recording, with the following condition: 1. The applicant shall install a 10'wide bituminous trail, centered in a 20' trial easement, as shown in the exhibit titled"Recommended Trails". With the exception of the section along County Road 33, the grading plans have been updated to include the trails as shown in the "Recommended Trails" exhibit. The applicant shall install the trail in a location approved by city and county staff. Ongoing maintenance will be the responsibility of the city. Applicable Regulation Approval of a plat may only be ordered if the following findings have been made, as outlined in Section 30-375: (1) The proposed subdivision is consistent Pith the honing regulations (article VI of this chaptev) and confoa-ns in all N:APublic Bodies\Agenda Packets\09-18-2017\Final\7.6 sr.docx respects�a ith all requirements of this Code, including the honing regulations and this article. The property is zoned R1-a and the proposed subdivision is consistent with the zoning regulations outlined in the city code and approved plans. (2) The proposed subdivision is consistent Pith all applicable general and specialised city, county, and regional plans, including but not limited to, the city's comprehensive developmentplan. The proposed subdivision does not conflict with any city, county, or regional plans,including the Comprehensive Plan. (3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding and drainage are suitable for the type and density of development and uses contemplated. The site is suitable for the proposed development. (4) The proposed subdivision makes adequate provision for Pater supply, storm drainage, sen)age transportation, erosion control and all other services,facilities and improvements other�a ise required in this article. The subdivision has adequate provision for all of these facilities. (5) The proposed subdivision Pill not cause substantial environmental damage. All of the above services or improvements will be connected or constructed as part of the development. The project is consistent with all required findings for approval of the Preliminary Plat. If denial of should occur,it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-375. Planning Commission Meeting A few residents had questions regarding access to the development,what the developer's plans are for tree preservation, and what impact this proposed development would have on existing uses and Conditional Use Permits in the adjoining neighborhood. The applicant was not present at the meeting. Staff has not received any comments since the Planning Commission meeting. The Planning Commission unanimously recommended approval of the request.
