Adopt,by motion, a resolution granting Final Plat of Tall Pines PUD with the following conditions: 1. All conditions of approval for the Conditional Use Permit (CUP) establishing the PUD for this development shall be satisfied. (Case No. CU 17-17) 2. All conditions of approval for the Preliminary Plat of The Pines at Elk River PUD shall be satisfied. (Case No. P 17-09) 3. A utility easement over all of Outlots B and C must be added to account for access to small utilities (gas, electric, telephone). 4. Surface Water Management Impact Fee be satisfied in the amount required by the city when the Final Plat is released for recording (currently$233/lot). 5. Water Availability Charge shall be satisfied in the amount required by the city when the Final Plat is released for recording (currently$345/ plumbing unit). 6. Development Plan shall be approved by the city engineer prior to issuance of building permits. 7. All necessary permits shall be secured from the city and Elk River Municipal Utilities prior to commencing construction. 8. Any item or condition found that indicates the site is likely to yield information important to pre- history or history shall be reported to the city immediately. Further, the city reserves the right to stop work authorized in its approval until the site is appropriately investigated and work is authorized. Background/Discussion Case Nos. EV 17-05 & P 17-18 The applicant,Roger Derrick with the Pines at Elk River, LLC,purchased two adjoining parcels on 183Td Circle NW and proposes to develop both parcels as 26 detached townhome units. The project will be similar to the West Oaks project,which was also developed by Mr. Derrick. Some units will have the option for a walkout basement. Kliever Lake Fields and Miske Meadows have also included detached townhome units similar to those proposed with this project. City Council approved a Zone Change, Conditional Use Permit to establish a Planned Unit Development, and the Preliminary Plat of The Pines at Elk River PUD on July 17, 2017. The applicant is seeking final POWERED 6T A IR plat approval to begin construction of the project,which has been re-branded as Tall Pines PUD. The submitted final plat is consistent with the preliminary plat,but satisfaction of all previous conditions of approval must be satisfied before releasing the plat for recording. Easement Vacation Approval of the final plat also requires the vacation of all existing drainage and utility easements on the site. New easements will be recorded when the Final Plat of Tall Pines of Elk River is recorded,but the recording needs to happen at the same time. Staff does not have any concerns with the proposed easement vacation.
