A Resolution of the City of Elk River to Vacate Drainage and Utility
Easements
WHEREAS, application has been made by the property owner to vacate the drainage and
utility easements described in Exhibit A attached hereto; and,
WHEREAS, vacation of the easement is appropriate as the properties are being re -platted
and new drainage and utility easements will be established with the recording
of the final plat of Tall Pines PUD (Case No. P 17-18); and
WHEREAS, a public hearing was held on September 18, 2017, before the City Council of
the City of Elk River on such request after published and posted notice had
been given, and all persons interested were given an opportunity to be heard
at the public hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows:
1. The petition to vacate the drainage and utility easements described in Exhibit A is
hereby granted; and,
2. Vacation of the easements described in Exhibit A shall be effective at the time of
recording of the document.

All of the 5 and 10 foot drainage & utility easements along the lots lines of Outlot A, as
dedicated on the plat of THE PINES TOWN OFFICE PARK THIRD ADDITION,
Sherburne County, Minnesota, according to the recorded plat thereof;
and
All of the Drainage & Utility Easements within Block 2 of THE PINES TOWN OFFICE
PARK, Sherburne County, Minnesota, according to the recorded plat thereof.
