SUBJECT: WETLAND CONSERVATION
ACT DECISION - PRESERVE
ESTATES - WCA 99 - 6
Bridgeland Development is proposing to fill portions of two wetlands to accommodate
the residential development of Preserve Estates. The locations of the two wetlands to be
filled, labeled "Impact Area", are identified on the attached map as is the "Replacement
Wetland Area".
To accommodate a future road connection to the north of this plat, 4,070 square feet of
Type 7 wetland is proposed to be filled. The Council will note on the attached map,
terrain and numerous wetlands in this area make it impossible to totally avoid wetlands.
. To the south, 1,350 square feet of Type 2 wetland is proposed to be filled to connect the
road system for this plat in with the city's existing road system. This connection is also
impossible to make without filling some wetland.
Normally up to 5,000 square feet of Type 2 & 7 wetland can be filled for a project as an
exemption to the Wetland Conservation Act called the de minimis amount. However, in
this case, the property is located in a shore land district and the de minimis amount is
reduced to 400 square feet.
FINDINGS
Kjolhaug Environmental Services Company prepared a Wetland Delineation Report for
the property, dated August 17, 1999.
The Technical Evaluation Panel was convened on this issue on 8/26/99.
On site sequencing was performed on September 1, 1999 by Stephen Rohlf and Paul
Kjolhaug.
On September 1, 1999, the city sent out combined notification of the proposed filling and
replacement plan to the necessary agencies.

No negative comments were received by the city on the proposed wetland plan.

RECOMMENDATION
Staff recommends approval of the proposed filling and mitigation plan for this
project with the following stipulations:
1. That a restrictive covenant and drainage and utility easement be recorded on the
mitigation areas.
2. That the Developer's Agreement for the project includes language that places
the responsibility for the success of the wetland mitigation on the developer.
3. That the letter of credit covering the public improvements associated with
the project also include the cost of the mitigation work.
4. That the developers submit a written monitoring report on the replacement
wetlands one year after this mitigation work is completed and that this report be
approved by city staff prior to the release of the letter of credit.
