Overview
Bridgeland Development is requesting final plat approval for Preserve Estates, a 27
lot single-family residential development on 74.7 acres. The final plat is being
requested immediately after preliminary plat and is contingent on the approval of
the rezoning to PUD (Planned Unit Development), the conditional use permit and
preliminary plat.

Final Plat
The final plat conforms to the preliminary plat.
Eng-ineering- Issues
Terry Maurer, the City Engineer, has reviewed the Grading/Drainage and Erosion
control plans and has only a few minor concerns (See Howard R. Green
Memorandum).
DNR Review
Typically, lots within Shoreland PUD's are required to utilize a clustered septic
system. The DNR has preliminarily agreed to allow individual septic systems if
under a homeowner's association maintenance agreement, subject to DNR review
and approval. The DNR has review the documents and suggested two changes (See
letter from DNR dated September 27, 1999). The final language of the homeowner's
agreement will need to be approved by the DNR prior to releasing the final plat for
recording.
Homeowners Association
As part of the development, a homeowners association shall be created with
mandatory membership within the plat. The homeowners association shall hold
and protect the conservation easement and be responsible for maintenance of all
commonly held land and maintenance and inspection of individual septic systems.
The homeowner's association documents shall require City Attorney review and
approval prior to releasing the plat for recording.
Landscape Plans
The developer has not yet provided a landscape plan indicating locations of street
and yard trees as required. The landscape plan shall be provided prior to releasing
the plat for recording.
Park Dedication
The Park and Recreation Commission recommended cash dedication to meet the
Park dedication requirements.
Recommendation
Staff recommends that the City Council approve Resolution 99-_ granting Final
Plat approval for Preserve Estates.

Dear Mr. Knaeble:
We have reviewed the most recent submittals for the Preserve Estates project. Based on our
review we would offer the following comments:
A. Gradina Plan
. The trail easement along Tyler Street will need to be supplied to the City in a separate
document from the plat.
. Driveways for Lots 1 & 2, Block 3, Lot 8, Block 1 and Lot 4, Block 4 appear to be flat.
They should be reviewed relate to the proposed house elevation.
. Just south of Lot 8, Block 3 the private trail again crosses the wetland. There is no
indication if this is also one of the locations that a bridge will be built. If these are to be
part of the construction, the trail should be detailed on the plan and the bridge crossings
of the wetland should also be provided on the plans. If not, then note them as such.
. There is a low area in Lot 2, Block 2 that is being drained by storm sewer pipe. Has this
low area been analyzed to ensure that ponding water will not flood the adjacent
drainfield site?
. The easements that connect wetlands 6 & 7 and 5 & 8 should have an emergency
overflow elevation called out on the grading plan.
B. Plans and Specifications
. All riprap should be noted as Class 4.
. The radius of the cul-de-sac should be noted as 45-feet. Spot elevations should be
shown around the cul-de-sac for drainage patterns.
. The eco-systems engineering report indicated that Lot 9, Block 1 needs a mound
system. The plans do not appear to be changed to reflect a mound system on that
particular lot.

Once the grading plan issues have been revised we will need 3 copies of the grading plan for
final approval. They will be stamped and signed indicating City approval. A copy will then be
returned for your files. As we discussed previously, the construction plans will need to be
signed by me indicating City approval. Please arrange a time for this to take place. Once the
final plat is approved by the City Council and the developers agreement is signed and the
proper security is placed with the City we can have a pre-construction meeting on this project
and then construction can proceed. We will require that provisions be taken to protect the
drainfield sites during site grading.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Preserve Estates
Case No. P 99-10
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on October 11, 1999; and
. WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms to all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.

The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and

type and density of development and uses contemplated.

The proposed subdivision makes adequate provision for water

damage.
F.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
G.
The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
4. The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire one year from the date of this
resolution if the final plat is not recorded within that time.
