SUBJECT: Special Assessments
3.3.a 1999 Garbage Assessments
Each year the city assesses property owners who have delinquent
garbage bills as of September 1. The number of property owners and
the amount to be assessed both decreased this year, as they have for the
past several years. In 1999, 29 properties will be assessed $6,868.31 for
delinquent garbage bills, penalties, and interest. Attached is a list of
the property owners being assessed.

The City Council is asked to approve attached Resolution 99-_
Adopting and Levying Assessments for Unpaid Garbage Collection
Services as of September 1, 1999.
3.3.b/c Consider Resolutions for East Elk River Lateral Improvements
and Business Park Improvements
These two assessments relate to the improvements currently being
installed in eastern Elk River. The commercial property is being
assessed for water and sewer lateral improvements and the business
park property is being assessed for all internal improvements including
streets, storm sewer, and sewer and water laterals. The developers of
each of these parcels have requested the improvements and waived all
rights to a public hearing and to object to the assessment. The
assessments carry the same interest rate and term as the previously
assessed eastern area trunk water and sewer improvements.

Improvements
3.3.d Special Assessment Reapportionments
The final attachment to this memo is a listing of special assessments
that need to be reapportioned due to the subdivision of the parcel
originally assessed. Reapportionments are occurring due to the platting
of Hillside Crossing 5, Cherrywood Hills 2nd, Lafayette Woods 3rd, and
Lafayette Woods 4th subdivisions.
Action Requested
The City Council is asked to approve the special assessment
reapportionments as stated on the attachment.

RESOLUTION 99-
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ADOPTING AND LEVYING ASSESSMENTS
FOR UNPAID GARBAGE COLLECTION SERVICES
AS OF SEPTEMBER 1, 1999
WHEREAS,
Minnesota Statutes Section 433.015 authorizes the City
to annually levy an assessment equal to such unpaid cost
as of September 1 of each year for garbage collection
services at an interest rate not to exceed 6% and a penalty
not to exceed 10%; and,
WHEREAS,
the City's ordinance Section 602.12 Subdivision 3,
authorizes the City to levy an assessment against
property for garbage collection equal to the unpaid
charges as of September 1; and,
WHEREAS,
all customers and property owners with delinquent
balances as of September 1, 1999, have been given
adequate notice of this pending assessment and have been
given opportunities to pay prior to this assessment being
levied; and,
WHEREAS,
State law does not require a public hearing or notice
before levying such assessments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Elk River that the parcels and amounts listed on Exhibit A attached hereto,
are correct and made a part hereof, are to be levied at an interest rate of 6%
per annum with a 10% penalty, and are to be certified to the Sherburne
County Auditor.
Passed and adopted by the City Council of the City of Elk River this 8th day of
November, 1999.

WHEREAS,
upon due notice properly made as required by law, the Elk River City Council has
met and heard and passed upon all objections to the proposed assessment for the
1999 East Elk River Business Park improvements and has determined the amount to
be assessed against each individual property as the Council deems just;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1. Final assessment roll, a copy of which is attached hereto and incorporated herein by
this reference, is hereby accepted and adopted and shall constitute the special
assessment against the lands therein named. Each such tract of land in the
assessment roll is hereby found to be benefited by the improvement in an amount not
less than the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments, including both
principal and interest, amortized in such amount annually as is required to pay the
principal with interest as 6.52% over a period of fifteen years.

The owner of any property so assessed, may, at any time prior to certification to the
County Auditor of the assessment or the first installment thereof, pay to the City
Treasurer the whole of the assessment on such property, with interest accrued to the
date of payment; except that no interest shall be charged if the entire assessment is
paid within 30 days after the adoption of this Resolution. Prepayment may also be
made after the certification of the assessment or first installment thereof by paying
to the City Treasurer/Auditor the entire amount of the assessment remaining unpaid
with interest. In the case of a payment made before November 15, interest will be
calculated through December 31 of the next succeeding year.
4. The City Administrator shall transmit to the County Auditor a certified duplicate of
the attached assessment roll to be extended on the property tax lists of the County.
Such assessment shall be collected and paid over in the same manner as other
municipal taxes.
Passed and adopted by the City Council of the City of Elk River this 8th day of November, 1999.
