Re: City of Elk River vs. George E. Deschenes and Carol A. Deschenes
Dear Michele:
I send this letter to you as a follow up of our phone conversation of yesterday with
regard to Mr. Deschenes' platting of the residual parcel and subsequent construction and
relocation of his machine shop. As you are aware it is necessary and would appear to be
more expedient to include the entire "Hardfacing" parcel in the plat and simply create the
common boundary line between the Deschenes parcel and the residual Hardfacing parcel
within that platting process. This is acceptable both to George and to the Hardfacing
Corporation. However, it is necessary according to the City zoning regulations for the
complete platting process to occur which requires obvious extensive additional surveying
and the earliest that George can get a surveyor on site is four to six weeks out. Since this
will obviously delay the platting process George has made the decision that it is more
expedient to do the construction process next spring due to increased winter costs and the
difficulty of getting his contractors lined up over the winter for a fast track com;tmction
program. Thus, George has made the decision that he will lease another facility on a
short term so that he can abide by his agreement with the City to vacate in Mayas
previously agreed. The preliminary plat and requisite documentation and applications
and fees will be submitted to you probably in the month of December. The construction
platting process has placed time burdens on Mr. Deschenes that taken in conjunction with
his current workload he just cannot possibly complete the construction during the winter.
Thank you for your consideration and I will be in touch with you in four to six
weeks and will keep you apprised of his progress.
