1. Call Meetinq To Order
Pursuant to due call and notice thereof, the meeting of the Elk River City Council
was called to order at 6 p.m. by Mayor Klinzing.

COUNCILMEMBER MOTIN MOVED TO APPROVE THE NOVEMBER 15, 1999, CITY
COUNCIL AGENDA AS PRESENTED. COUNCILMEMBER THOMPSON SECONDED THE
MOTION. THE MOTION CARRIED 4-0.

Consider Consent Aqenda
COUNCILMEMBER THOMPSON MOVED TO APPROVE THE CONSENT AGENDA AS
FOLLOWS:
3.1. 11/8/99 COUNCIL MINUTES - APPROVED
3.2. REQUEST BY DYNAMICS, LAMM & DEHRER FOR PRELIMINARY PLAT (WINDSOR
PARK), CASE NO. P 99-12 - POSTPONED TO 12/20/99
3.3. REQUEST BY DIRK AND JANE BARRETT FOR REZONING, PUBLIC HEARING CASE
NO ZC 99-9 - WITHDRAWN
COUNCILMEMBER MOTIN SECONDED THE MOTION. THE MOTION CARRIED 4-0.
4.1 . Utilities Update
Councilmember Dietz updated the council on issues discussed at the October and
November Utilities Commission meetings.
4.2. Community Recreation Update
Councilmember Motin updated the council on issues discussed at the Community
Recreation Board's November 15,1999, meeting. Councilmember Motin
distributed a handout entitled "What Program Delineations Can We Identify, U
which was discussed at the board meeting.

Northstar Corridor Update
Senior Planner Scott Harlicker presented the City Council with a proposed site plan
of the location for the rail station in Elk River, Scott indicated that the Planning
Commission met with the consultants for the NCDA for a presentation and
discussion on station layout and land use policy. He noted that the commission
had a concern about safety at the at-grade crossing of 171st Avenue,

Street/Park Superintendent Phil Hals reviewed the modifications in the city's Snow
and Ice Control Policy,

Consider Resolution in Support of Anoka-Hennepin Technical ColleQe

City Administrator Pat Klaers noted that the mayor of Coon Rapids is requesting
support from northwestern communities to keep the Anoka-Hennepin Technical
College (AHTC) from potential closure, He noted that the Minnesota State
Colleges and Universities (MNSCU) has targeted the AHTC for closure. It was the
consensus of the City Council to adopt the resolution in support of the college
staying in operation and further to request the city administrator to keep the
council updated on the situation,
COUNCILMEMBER THOMPSON MOVED TO ADOPT RESOLUTION 99-84 IN SUPPORT OF
ANOKA-HENNEPIN TECHNICAL COLLEGE. COUNCILMEMBER DIETZ SECONDED THE
MOTION. THE MOTION CARRIED 4-0.
5, Open Mike

6,1, Request for Final Plat Approval by Merit Development, L,L,P, (Hidden Creek 2nd
Addition), Case No, P 99-13
Senior Planner Scott Harlicker indicated that Merit Development Company is
requesting final plat approval for Hidden Creek 2nd Addition, which involves
subdividing Outlot A of Hidden Creek Addition into four single family lots. The
location of the development is the southeast corner of 193rd Avenue and
Meadowvale Road, Scott Harlicker reviewed the staff report on this request.

APPROVAL FOR HIDDEN CREEK 2ND ADDITION, CASE NO. 99-13. COUNCILMEMBER
MOTlN SECONDED THE MOTION. THE MOTION CARRIED 4-0.

6.2.
Request by City of Elk River for Ordinance Amendment to Allow Liquor Stores Selling
Packaaed Goods as a Conditional Use in the C3, Hiahway Commercial District,
Public Hearing Case No. OA 99-15
Director of Planning Michele McPherson indicated that the city is requesting that
the C3, Highway Commercial District be amended to allow off sale liquor stores as
a conditional use. She noted that the Planning Commission reviewed this request
and recommended approval. She further indicated that a public hearing has
been conducted and that no testimony was received at the public hearing.
Following council discussion it was the consensus that it was not necessary to act
on this request at this time.
COUNCILMEMBER MOTIN MOVED TO POSTPONE THIS REQUEST INDEFINITELY.
COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0.
6.3.
Request by City of Elk River for Ordinance Amendment to Allow Clustered
Subdivisions in the R1 a and A 1 Zonina Districts, Public Hearinq Case No. OA 98-3

City Planner Steve Wensman stated that the City of Elk River is requesting an
ordinance amendment to allow single family residential cluster development in the
Rl a and A 1 zoning districts as a permitted use. Steve Wensman indicated that the
City Council held a public hearing on this issue on October 26 and requested staff
to incorporate revisions to the ordinance that were requested by the council.
Steve Wensman reviewed the revisions that were included in the ordinance.
Mayor Klinzing opened the public hearing.
Dick Gruys, 22347 Monroe Street, talked about his concerns with enforcing the
cluster ordinance relating to absentee homeowners and people filing bankruptcy.
There being no further comments, Mayor Klinzing closed the public hearing.
MAYOR KLINZING MOVED TO ADOPT ORDINANCE 99-32 AMENDING SECTION 900.08,
900,12, AND 1008.20 OF THE CITY CODE OF ORDINANCES ESTABLISHING OPEN SPACE
PRESERVATION PLATS AS A PERMITTED USE IN THE RI1 AND A 1 ZONING DISTRICTS AND
ESTABLISHING STANDARDS FOR THEIR CREATION, CASE NO. OA 98-3.
COUNCILMEMBER MOTlN SECONDED THE MOTION. THE MOTION CARRIED 4-0.
7.1. Consider Resolution in Support of County Road 12 Improvements
City Engineer Terry Maurer indicated that in order to move ahead with the County
Road 12 improvements, the city must enter into a cooperative agreement with
Sherburne County for the reconstruction of County State Aid Highway 12. Terry
Maurer noted that the city's share of the construction cost should be between
$150,000-$200,000. Discussion was held regarding the county cost sharing policy.

A COOPERATIVE AGREEMENT WITH SHERBURNE COUNTY FOR THE RECONSTRUCTION
OF COUNTY STATE AID HIGHWAY 12. COUNCILMEMBER DIETZ SECONDED THE
MOTION. THE MOTION CARRIED 4-0.

7.2.
Discussion on 175th Avenue Improvement Proiect and the Hirina of ELS for the
Acquisition of Riaht-of-Way
City Engineer Terry Maurer stated that staff is requesting authorization to hire
Evergreen Land Services to assemble the necessary right-of-way for improvements
along 175th Avenue. The city administrator noted that this is a 2001 project and
that staff will be discussing the proposed improvements with the council in more
detail at a future meeting.
COUNCILMEMBER MOTIN MOVED TO HIRE EVERGREEN LAND SERVICES TO INITIATE
THE RIGHT-Of-WAY ACQUISITION fOR THE 175TH AVENUE IMPROVEMENTS.
COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 4-0.
7.3. Update on East Elk River Sewer/Water and Street/Storm Sewer Proiects
City Engineer Terry Maurer updated the council on the sewer and water and street
and storm sewer projects taking place in the eastern part of the city.
7.4.
HighwaY 169/County Road 33 Temporary Signal- Consider Resolution in Support of
Preserving the Right-of-Way

City Engineer Terry Maurer indicated that MnDOT has approved a temporary signal
at County Road 33 and Highway 169. Terry noted that because Trunk Highway 169
has been identified as an inter-regional corridor, MnDOT will allow a temporary
signal system as an interim safety measure as opposed to a permanent signal.
Mayor Klinzing suggested that the city contact MnDOT representatives and request
a meeting with them to discuss the effect the inter-regional corridor will have on
Highways 169 and lOin the city of Elk River.
COUNCILMEMBER DIETZ MOVED TO ADOPT RESOLUTION 99-87 INDICATING THE CITY
Of ELK RIVER'S INTENT TO WORK IN PARTNERSHIP WITH MNDOT IN PRESERVING RIGHT-
Of-WAY ALONG THE TRUNK HIGHWAY 169 CORRIDOR. COUNCILMEMBER MOTIN
SECONDED THE MOTION. THE MOTION CARRIED 4-0.
7.5. Consider Resolution Approvina MnDOT Aareement for Construction of Business
Center Drive, Waco Street, and Hiahway 10 Improvements
City Engineer Terry Maurer indicated that the initial design on the Western Area
Phase IV improvements has begun. He explained that the improvements will
extend Business Center Drive to Waco Street, realign Waco Street with Trunk
Highway 10, signalize the new intersection, and close the existing Waco Street
intersection with Trunk Highway 10 and the Trunk Highway 10 opening at the
Sherburne County Government Center. He indicated that the project would also
include sanitary sewer, watermain, and storm drainage improvements, plus
improvements on the north side of Highway 10.

The city administrator indicated that the city has received a landowner petition for
local improvement requesting the extension of Business Center Drive from
Sherburne County Government Center to Waco Street with the extension of proper
utilities to service the development of this property. The city administrator further
stated that the city will begin working on a feasibility study for this project.

FOR THE EXTENSION OF BUSINESS CENTER DRIVE AND RELATED IMPROVEMENTS.
COUNCILMEMBER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 4-0.
COUNCILMEMBER DIETZ MOVED TO ADOPT RESOLUTION 99-88 APPROVING A LOCAL
INITIATIVE AGREEMENT WITH MNDOT FOR THE CONSTRUCTION OF BUSINESS CENTER
DRIVE, WACO STREET, AND HIGHWAY IMPROVEMENTS TO TRUNK HIGHWAY 10.
COUNCILMEMBER MOTIN SECONDED THE MOTION. THE MOTION CARRIED 4-0.
7.6. Highway 169 Pedestrian Bridge Update
City Engineer Terry Maurer updated the council on the pedestrian bridge over
Highway 169.
8. Other Business
Councilmember Dietz indicated that a student was hit by a car crossing School
Street from the Morrell parking lot area. Councilmember Dietz questioned the
requirement for Larry Morrell to have his parking lot fenced. Discussion pursued
regarding other requirements that were placed on the Morrell parking lot property.
It was the consensus of the council to have the director of planning contact Larry
Morrell regarding these issues and to provide an update to the City Council on
November 22.

Councilmember Thompson noted that the Boys and Girls Club will be opening on
November 29.
9.
Staff Updates
9.1. Police Union Update
The city administrator updated the City Council on the police union
negotiations process. He noted that the union has requested mediation
services from the State Bureau of Mediation Services. The city administrator
also informed the council that the four sergeants in the Elk River Police
Department have filed for establishment of a union.
10. Adiournment
There being no further business, Mayor Klinzing adjourned the City Council meeting
at 7:40 p.m.
