Purpose of the Ordinance Amendment
The City of Elk River (applicant) is requesting the ordinance amendment to allow Commercial Kennels in
the C-3 zoning district.
Public Benefit
Provides additional pet"day care" options for residents and employees in facilities near the core business
areas of Elk River.
Background/Discussion
During a City Council Open Forum, a business owner requested the City Council consider allowing
commercial kennels in the C-3 (Highway Business) district. The owner currently operates a dog
grooming business which is allowed but wants to offer the ability to kennel dogs for the day in the same
facility. The Council was supportive of the idea and directed staff to explore it.
A commercial kennel is defined as any premises where more than three animals over six months of age
are boarded, trained or bred for compensation or are offered for sale, except for animals being raised as
agricultural livestock, an animal hospital, a veterinary clinic or a pet shop.
Staff is proposing to amend the C-3 language to be consistent with the C-1 language as follows:
Sec. 30-1024— C-3 highway commercial district.
(d) Conditional uses. Conditional uses in the C-1 district are as follows:
(28) Commercial Kennel provided the following conditions are met:
(a) No long term boarding exceeding 14 days takes place
(b) No breeding for compensation or sale takes place
(c) The sale of animals shall not take place
The C-3 district has the largest businesses both in terms of size and traffic generation and recognizes the
need for commercial establishments on or with immediate access to major highways. In addition to retail

have considerable customer contact are acceptable in the highway commercial district. Commercial
kennels appear to meet the requirements for the city's most intensive commercial district. Each
business/proposal will be reviewed and approved/denied through our Conditional Use Permit public
hearing process.
On November 7, 2016, the City Council approved an ordinance amendment to allow commercial kennels
in the C-1 (Central Commercial) zoning district.
Staff is not recommending the C-2 (Office District) be amended to include commercial kennels. The
office district provides for the location and development of offices and other service and light
commercial uses. City staff believes commercial kennels are not compatible with the C-2 district.
Planning Commission
No one spoke for or against the request and staff has not received any comments since the Planning
Commission meeting.
The Planning Commission unanimously recommended approval of the request.

An Ordinance Amending Section, 30-1024, C-3 Highway Commercial District of
the City of Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That§ Section 30-1024 (d), C-3 highway commercial district of the City of Elk River
Code of Ordinances shall be amended to read as follows:
(d) Conditional uses. Conditional uses in the C-3 district are as follows:
(28) Commercial Kennel provided the following conditions are met:
(a) no long term boarding exceeding 30 days takes place
(b) no breeding for compensation or sale takes place
(c) the sale of animals shall not take place
SECTION 2. That this ordinance shall take effect upon adoption and be published as provided by
law.
