Update on Morrell Parking Lot
Staff has been in contact with Mr. Morrell regarding the parking lot on Jackson Avenue.
He indicated that he had received the attached letter and had been "mulling it over".
Mr. Morrell was then informed of the Council's concerns regarding the most recent
accident in front of the parking lot on his property.
Mr. Morrell expressed the following concerns to staff regarding the required
improvements:

He wanted to know if other parking lots would be required to be fence. He
was told no.
He does not want to close the School Street entrance, as he is afraid that he
will "lose" it. He would prefer to close the parking lot if the Council is going to
require closure of the entrance from School Street. Staff suggested fencing
the School Street entrance; that was not a satisfactory option.
He believes that the student that was struck was a smoker and not someone
using the parking lot. Evidently, they have had a number of problems over
the years with students using their buildings as smoking havens. He does
not believe a fence will prevent illegal crossing of School Street.

Mr. Morrell stated that he had sent a letter to all of the participants reminding them of
the requirement to cross School Street at an approved crosswalk. In his letter, he
stated that failure to comply with this requirement would result in termination of the
parking area with no refunds.
Mr. Morrell has been reluctant to meet with staff regarding the conditions outlined in the
attached letter. During our last conversation on Thursday, November 18, 1999 he
indicated that he may attend the November 22, 1999 City Council meeting to discuss
the issues directly with the Council.

Dear Mr. Morrell:
On October 11, 1999 the City Council reviewed the options presented by staff for the
continuation of the commercial parking lot at 809 Jackson Avenue (please refer to the
attached staff memo and minutes). The City Council approved a General Planning Permit for
the 1999-2000 school year. Approval of the General Planning Permit included the following
conditions:

That the parking lot meet the ten foot setback from the property lines.
The entrance from School Street be closed and vehicular access to the property be
limited to Jackson Avenue.
The surface of the lot be Class 5.
Landscaping to be installed along Jackson Avenue and School Street be reviewed
in the spring.
Some type of economical fencing be install along School Street at least to the end of
the school year.
The applicant process an interim use permit for future years after the City amends
the ordinance for interim uses.
The City will process the interim use amendment to the Zoning Code. Once that has been
completed, I will contact you regarding that process for the 2000-2001 school year.
Please contact me at 441-4902 regarding the above conditions 1-5. We will need you to verify
the parking lot setbacks and determine how access will be gained internally to Jackson
Avenue.
