Klinzing Mayor, City of Elk River 13065 Orono Parkway PO Box 490 Elk River, Minnesota 55330-0490 INFORMA.T/ON Re: Biosolids Violations Dear Mayor Klinzing: I recently conducted a compliance monitoring survey at the City of Elk River's wastewater treatment plant. The treatment plant was found in compliance for the items I inspected. Since that time, Agency staff have reviewed the City's 1999 biosolids annual report and found that the . City land ~pplied bios()lids with highJ.11olybdenum. . According to Minnesota Rules 7041.1100, the ceiling concentration for molybdenum is 75 mglkg. The molybdenum concentration in the City's land applied biosolids was 105 mglkg. This is a significant violation. Because this is a first time occurrence, we will not be taking further enforcement action. If there is another violation involving the biosolids land application program, we will enhance enforcement action. In addition, the City is considered a major NPDES permittee. As such, the US Environmental Protection Agency (EP A) has final authority over its biosolids management program. The EP A is reviewing the NPDES major permittee biosolids annual reports and may act on this occurrence at some future time The MPCA does not wish to duplicate enforcement action for this violation. Re: Bio-Solids Violation ~ Dear Ms. Lindlief; The Bio-Solids that the City of Elk River land applied in October and November of 1998 exceeded the ceiling limit for Molybdenum. The Bio-Solids were applied before . the analysis were received and reviewed. The following steps are being taken to prevent any future violations: 1) No Bio-Solids will be land applied before lab analysis have been received and reviewed. 2) A sampling program IS being started to identify the source of the molybdenum. 3) Once the source has been identified, steps will be taken to eliminate the problem.
