MEETING OF THE ELK RIVER BOARD OF REVIEW
HELD AT THE SHERBURNE COUNTY GOVERNMENT CENTER

Call Meetinq To Order
Pursuant to due call and notice thereof. the meeting of the Elk River Board of
Review was called to order at 6:00 p.m. by Mayor Duitsman.

County Assessor Ty Bischoff informed the audience that the purpose of the Board
of Review meeting is to review the assessment of individual parcels with the Board
of Review.
Ty Bischoff explained that the Board of Review would hear appeals on an
individual basis.
1. DuWavne Grussendorf - 75-413-0410
The City Clerk entered into the minutes a letter from DuWayne Grussendorf dated
May 1995. addressed to the Elk River Board of Review. The letter indicated Mr.
Grussendorf's concern regarding the continued increase in valuation of his
property (75-413-1410). The letter stated that his property value increased from
$68.600 in 1993 to $85.900 in 1995.
Ty Bischoff explained that land in the old village limits has received an overall
increase of $1.500 per parcel based on inflation.
MAYOR DUITSMAN MOVED THAT THE PROPERTY VALUE FOR PARCEL #75-413-0410.
REMAIN AT $85.900. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE
MOTION CARRIED 3-0.

Roqer Dickenson - 75-128-4305

The City Clerk entered into the record a letter of concern from Roger Dickenson
for parcel 75-128-4305. Mr. Dickenson has requested the Board of Review to
review the valuation of this parcel. stating that at least 50% of the property is low
land.
Jerry Kritzeck. Assessor, indicated that the parcel is actually three parcels of land.
but treated as one parcel. He further stated that the land is valued as
commercial property.

COUNCILMEMBER Dim MOVED THAT THE PROPERTY VALUE FOR PARCEL 75-128-
4305 REMAIN AT 43,600. MAYOR DUITSMAN SECONDED THE MOTION. THE MOTION
CARRIED 3-0.
3. Nancy Boyer - 75-432-0236
Nancy Boyer stated that her property was valued at $91 .900. She indicated that
this was very high and that she would not be able to sell the property for that
amount. She indicated that the location of her property affects the property
value. She stated that there is Section H housing across the street and duplexes
on both sides.
Jerry Kritzeck researched comparable slab home sales. Assessor Kritzeck also
informed Ms. Boyer that her assessment is based on square footage.
MAYOR DUITSMAN MOVED TO REDUCE THE ASSESSED VALUATION OF PARCEL 75-
432-0236 TO $90,000. COUNCILMEMBER Dim SECONDED THE MOTION. THE
MOTION CARRIED 3-0.

Tom Hiosaa -75-428-0610

Tom Hipsag stated that he felt the assessed valuation of his property was too high
($91.900). The Assessor indicated that the value of the building has remained
constant since 1990 and that the property has increased by $1.500 since 1994.
COUNCILMEMBER Dim MOVED THAT THE PROPERTY VALUE FOR PARCEL 75-428-
0610 REMAIN AT $91,900. COUNCILMEMBER SCHEEL SECONDED THE MOTION. THE
MOTION CARRIED 3-0.
5. Rolland and Marnette Barthel - 75-472-0145
Mr. and Mrs. Barthel questioned why the market valuation for their property has
increased. Assessor John Cullen indicated that the entire plat was totally
reassessed. He explained that due to the high amount of the reassessment, the
increase had to be split out over a three year period. He stated that the actual
total increase for 1995 was $2.000 for the lot.
COUNCILMEMBER DIETZ MOVED THAT THE PROPERTY VALUE FOR PARCEL 75-428-
0610 REMAIN AT $113,800. COUNCILMEMBER SCHEEL SECONDED THE MOTION. THE
MOTION CARRIED 3-0.
County Assessor Ty Bischoff updated the Board of Review on "This Old House" law.
He indicated that he would be contacting the City Building Department to
discuss implementation procedures.

Assessor Ty Bischoff updated that Board of Review on the Findings of Fact and
Order for Judgment for the following tax court cases:

After review of each of the above cases. It was the intent of the Board of Review
to increase the 1993 assessor's estimated market value of each parcel by 50% of
the increase given by the Minnesota Tax Court.
Allan Nadeau - 75-405-0470 - Assessor's estimated market value for 1993 =
$174.200. Conclusion by Judge McClung of the Minnesota Tax Court = $185.000.
COUNCILMEMBER Dim MOVED TO INCREASE THE 1995 ASSESSED VALUATION OF
PARCEL 75-405-0470 TO $179.600. COUNCILMEMBER SCHEEL SECONDED THE
MOTION. THE MOTION CARRIED 3-0.
Steven Johnson - 75-405-0250 - Assessor's estimated market value for 1993 =
$223.000. Conclusion by Judge McClung of the Minnesota Tax Court = $234,000.
COUNCILMEMBER Dim MOVED TO INCREASE THE 1995 ASSESSED VALUATION OF
PARCEL 75-405-0250 TO $228.500. COUNCILMEMBER SCHEEL SECONDED THE
MOTION. THE MOTION CARRIED 3-0.

Cyril Lenzmeier - 75-405-0245 - (Snyder Drug) - Assessor's estimated market value
for 1993 = $240.800. Conclusion by Judge McClung of the Minnesota Tax Court =
$290.000.
COUNCILMEMBER DIETZ MOVED TO INCREASE THE 1995 ASSESSED VALUATION OF
PARCEL 75-405-0245 TO $265.400. COUNCILMEMBER SCHEEL SECONDED THE
MOTION. THE MOTION CARRIED 3-0.
(It was determined that prior to increasing the market value of property. the Board of
Review must notify the property owner. Because this was not done. the above action
taken on the tax court cases was rendered null and void following the Board of Review
meeting. It was further determined that the property owners would be notified and that
the action to increase the 1995 assessed valuation of the above properties would be
done at the County Board of Equalization meeting.)
