COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE JULY 24, 1995, CITY COUNCIL AGENDA AS AMENDED. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 3. Elk River City Council Meeting July 24, 1995 Page 2 e 5.1. Consider Bids for Overlay Proiect City Engineer Terry Maurer stated that the city received seven bids for the 1995 overlay improvement projects. The low bidder was Master Asphalt at $195,062.60. Terry Maurer stated that the low bid came in at approximately 15 percent lower than the estimate. He indicated that this will reduce the proposed assessment amount to $1,300 per unit. Terry Maurer stated that no action is required on this issue as the Council will be considering a resolution to accept the low bidder at the assessment hearing to be held on August 28. 5.2. Consider Resolution Determinina Cost to be Assessed, Orderina Preoaration of Assessment Roll. and Settina Date of Assessment Hearina COUNCILMEMBER SCHEEL MOVED TO ADOPT RESOLUTION 95-48, A RESOLUTION DETERMINING ASSESSED COST OF IMPROVEMENT AND ORDERIN'G PREPARATION OF PROPOSED ASSESSMENT ROLL IN THE MATTER OF THE 1995 OVERLAY IMPROVEMENT. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 5.3. Presentation from Jim Mattson on Elk River 150 Year Celebration e Jim Mattson informed the Council that there are citizens who are interested in a possible celebration of the city's 150th anniversary. He informed the Council that preliminary steps have been taken to begin this process and indicated that the first step would be to organize a working committee of Elk River citizens to create a plan and provide direction for this celebration. Jim Mattson indicated that it would be a goal to reach out to other historical groups and individuals throughout the community and invite them to participate in programs organized around the events and historical themes identified by the Citizen Heritage Planning Committee. He indicated that the purpose of the celebration is to enhance the appreciation of the history of Elk River and to create a shared community heritage. COUNCILMEMBER SCHEEL MOVED TO ADOPT RESOLUTION 95-49, A RESOLUTION AUTHORIZING AND AFFIRMING THE CREATION OF A CITIZEN HERITAGE PLANNING COMMITTEE. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. 5.5. Consider Aoolications for Park and Recreation Commission Vacancy The City Clerk informed the Council that she has received letters of resignation from the Park and Recreation Commission from Clete Lipetzky and Sue Daleiden. She further indicated that the Council had authorized the advertisement for applicants to fill the vacancy. The City Clerk stated that she received seven applications plus had one application available from December of 1994. COUNCILMEMBER FARBER MOVED TO INTERVIEW ALL OF THE APPLICANTS FOR THE PARK AND RECREATION COMMISSION ON AUGUST 7, 1995, DURING THE CITY COUNCIL MEETING. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. e Elk River City Council Meeting July 24, 1995 Page 3 e 5.9a. Woodland Trails Park Phil Hals reviewed the Park and Recreation Commission recommendation to support the addition of concrete curb and gutter for the entrance road and parking lot at Woodland Trails Park. Phil Hals explained that matching grant funds could be used for the curbing. He further stated that if the money is used for the curbing, the total distance of trail that could be paved would have to be reduced. Mayor Duitsman indicated that he did not feel it would be a good use of funds to put in concrete curb and gutter in this area. He indicated he would rather spend the money on the trails. It was the consensus of the Council to use the funds for trails and not for curb and gutter. 5.9b. Slide Reolacement for Deerfield IV Park Street/Park Superintendent Phil Hals stated that the long slide located in the Deerfield IV Park is in need of repair. He stated that the slide has been dismantled for safety reasons. Phil Hals stated that the total replacement cost for the slide would be $4,537. Phil Hals indicated that this price would pay for a tube slide. e Councilmember Scheel questioned the warranty on the slide. Phil Hals indicated the slide comes with a one year warranty. Councilmember Scheel suggested taking the slide in during the winter months in order to preserve the material. COUNCILMEMBER HOLMGREN MOVED TO AUTHORIZE THE PURCHASE OF A TUBE SLIDE AT $4,537 FOR DEERFIELD IV PARK. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. 5.10. Consider Fire Deoartment Reauests for 1996 Benefit Level and Minimum Contribution and Relief Association Reauest for City Contribution Assistant City Administrator Lori Johnson indicated that before August 1 of each year the Fire Relief Association is required to certify its benefit level and required city contribution to the City Council. She indicated that the Relief Association is not requesting an increase in benefit level for 1996, however, a city contribution is required in 1996. Lori Johnson indicated that the State Auditor's Office has notified the Relief Association that the schedules filed for 1995 were incorrect and that the corrected schedules require a city contribution. She indicated that the only mandatory contribution in 1995 is $663. Mayor Duitsman indicated that his recommendation would be to approve the minimum contribution and to hold off on other contributions until the Compensation Task Force has completed negotiations. Randy Sykes indicated that the fire department is opposed to receiving the minimum contribution instead of the budgeted $17,500. e Tom Dillon indicated that by holding back the $1 7,500 contribution, the fire department is back to a 1981 pay range. Tom Dillon expressed the fire Elk River City Council Meeting July 24, 1995 Page 4 e department's concern about not getting the total compensation package settled for the last two years. The City Council requested information on the status of the Compensation Task Force. Tom Dillon indicated that the last package approved by the City Council on April 3, 1995, was presented to the fire department for a vote and was turned down with a 27-1 vote to remain with a defined benefit plan. Mayor Duitsman indicated that a Task Force meeting has been scheduled for August 9. The City Council also indicated its frustration at the length of time it has taken to settle this issue. COUNCILMEMBER HOLMGREN MOVED TO APPROVE SCHEDULES 1, 2 AND 3 FOR 1996, AND. TO APPROVE THE MINIMUM REQUIRED CONTRIBUTION IN 1996. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 5.11. Reconsider Trainina Proposal from Trainina Networks, Inc. Mayor Duitsman indicated that he has concluded that he cannot support the expenditure of funds for the training proposal submitted by Training Networks, Inc. He indicated he supports the concept of the training for city staff, however cannot support the expenditure of funds. Council member Farber indicated he is in favor of the training and stated that it would enhance the city. e Councilmember Holmgren questioned whether the Mayor is willing to look at spending a portion of the funds for a portion of the training. Mayor Duitsman indicated that he would not be opposed to considering another proposal at a reduced cost. 6. Open Mike David Hauan indicated that he had recently received approval from the Council regarding a private road agreement on July 17, 1995. He stated that part of the motion required him to hard surface his property. He indicated that staff had informed him that the hard surface meant bituminous. Mr. Hauan requested the Council to clarify this as he was not under the impression the approval meant bituminous. It was the consensus of the Council that it was not intended for Mr. Hauan to be required to have a bituminous surface, rather a Class 5 material would be adequate. COUNCILMEMBER SCHEEL MOVED TO ALLOW CLASS 5 AS THE HARD SURFACE FOR MR. HAUAN. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0-1. Councilmember Dietz abstained. 7.1. Reauest for Preliminary Plat Approval by Lindauist/Mastley IWeatherwood Plat), P 95-01 e Assistant City Planner Gary Schmitz indicated that Jeff Mastley and Randy Lindquist are requesting preliminary plat approval to subdivide approximately 80 acres into 21 single family lots. The property is located east of Zebulon Street and Elk River City Council Meeting July 24, 1995 Page 5 e directly south of Fairhaven Hills. Gary Schmitz reviewed his staff report on this issue. Mayor Duitsman opened the public hearing. Curt Muller, 19815 Zebulon, indicated his concern regarding the distance of the road from his residence and the drainage problems that he is experiencing. Steve Ach indicated that the design of the curbs in the plat should eliminate the water problems Mr. Muller is experiencing. There being no further comments from the public. Mayor Duitsman closed the public hearing. Councilmember Holmgren addressed the condition regarding the requirement of the developer to repair the tile on Ditch 28. Councilmember Holmgren indicated that this may not be possible as the county is still responsible for the ditches. Gary Schmitz indicated that staff is working with the county on this issue. Councilmember Holmgren further indicated his concern with Condition # 13. Redistribution of the Ditch Assessment Prior to Recording the Plat. Council member Holmgren indicated that this may hold up the recording of the plat. e COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE PRELIMINARY PLAT OF WEATHERWOOD SUBDIVISION TO SUBDIVIDE APPROXIMATELY 80 ACRES INTO 21 SINGLE FAMILY LOTS BASED ON THE FOLLOWING CONDITIONS: 1. A DEVELOPMENT AGREEMENT BE PREPARED OUTLINING THE TERMS AND CONDITIONS FOR PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS. 2. COMMENTS OUTLINED IN THE CITY ENGINEER'S MEMO DATED JUNE 21, 1995, BE ADDRESSED AND INCORPORATED INTO FINAL PLANS FOR THE DEVELOPMENT. 3. A SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF FINAL PLATTING BE PAID PRIOR TO RECORDING THE PLAT. 4. PARK DEDICATION FEES BE PAID BASED ON THE PER LOT RATE AT THE TIME OF FINAL PLAT APPROVAL. THIS FEE SHALL BE PAID PRIOR TO RELEASE OF FINAL PLAT. 5. ALL OF THE APPROPRIATE PERMITS TO FILL AND MITIGATE WETLANDS. BE APPROVED PRIOR TO FINAL PLAT APPROVAL. 6. A TREE PRESERVATION PLAN BE SUBMITTED WITH EACH BUILDING PERMIT WHERE HOMES ARE CONSTRUCTED IN WOODED AREAS. 7. UPON COMPLETING ALL THE IMPROVEMENTS AND HAVING THEM ACCEPTED BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE IMPROVEMENT COST SHALL BE SUBMInED WITH THE CITY FOR A ONE YEAR PERIOD. 12. 199TH AVENUE AT THE INTERSECTION WITH ZEBULON STREET BE SHIFTED TO THE NORTH TO PROVIDE A 50 SETBACK FROM THE SOUTH EDGE OF THE ROAD TO THE EXISTING HOME. 13. SOIL BORINGS BE REQUIRED ON LOTS THAT ARE QUESTIONABLE FOR SUPPORTING A SEPTIC SYSTEM. THIS INFORMATION MUST BE SUBMInED FOR REVIEW PRIOR TO FINAL PLAT APPROVAL. 16. TROY STREET BE EXTENDED THROUGH THE FAIRHAVEN HILLS PLAT AND UPGRADED TO CITY STANDARDS AT THE DEVELOPERS EXPENSE. 17. STREET LIGHTS BE INSTALLED AS REQUIRED BY ELK RIVER UTILITIES. - 18. ALL DRIVEWAYS WITHIN THE PLAT BE IMPROVED WITH EITHER A BITUMINOUS OR CONCRETE SURFACE FROM THE EDGE OF THE STREET TO TEN FEET WITHIN THE PROPERTY LINE. 19. DEVELOPER PAY A SEALCOATING FEE IN THE AMOUNT DETERMINED BY THE CITY ENGINEER PRIOR TO RELEASING THE FINAL PLAT FOR RECORDING. 20. A DEVELOPMENT PLAN ILLUSTRATING TYPE OF HOME AND FINISHED FLOOR ELEVATIONS BE APPROVED BY THE CITY ENGINEER PRIOR TO ISSUANCE OF A BUILDING PERMIT. 21. A PERMIT FROM SHERBURNE COUNTY HIGHWAY DEPARTMENT FOR WORK WITHIN COUNTY RIGHT-OF-WAY WILL NEED TO BE OBTAINED. 22. DEVELOPER COORDINATE WITH THE POST OFFICE FOR MAILBOX LOCATIONS. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 7.2. Ordinance Amendment Request (Subdivision) by City of Elk River. Public Hearing. Case No. OA 95-6 e City Planner Steve Ach indicated that the City of Elk River is requesting to amend the subdivision ordinance. He indicated that the Planning Commission met on several occasions to study this ordinance and he further stated that staff has held a meeting with local developers regarding the proposed amendments to the Elk River City Council Meeting July 24, 1995 Page 7 e subdivision ordinance. Steve Ach reviewed the noticeable changes in the ordinance at this time. The City Council held discussion regarding proposed changes to page 4.2 regarding park dedication. Steve Ach reviewed the advantages and disadvantages of requiring the developers to install trails. Councilmember Holmgren indicated that the Council has yet to see the park comprehensive plan at this time. He further indicated that the City Council has not indicated that it is in favor of linking plats with trails. Councilmember Holmgren indicated that he is not in favor of trail construction linking the entire community. Steve Ach distributed a letter from John Oliver and Associates with suggestions regarding the proposed amendments to the subdivision ordinance. Steve Ach indicated that all of John Oliver's comments will be incorporated into the ordinance. Mayor Duitsman opened the public hearing. Marly Glines suggested that trails be provided through the park dedication process and credit be given if developers must install trails. e Rick Foster suggested that the burden of ensuring that trees are provided on each property be the responsibility of the builder. City Planner Steve Ach indicated that it would be difficult for the city staff to enforce this issue with the builders and require trees at time of certificate of occupancy without some escrow system. Council member Scheel indicated her opposition to the city indicating where trees are to be planted. Council member Farber indicated that he feels there are too many fees and responsibilities to the developers. He indicated that he cannot support the issue of the developer being responsible for the trees. Council member Farber indicated his concern regarding changing the administrative subdivision requirements from four lots to two lots. He indicated that the platting process to go through a preliminary plat with four lots is much more expensive than going through an administrative subdivision. Council member Farber suggested that staff make no change to this portion of the ordinance. The City Council concluded that no decision would be made on the trail issue until the comprehensive plan has been completed. There being no further business, Mayor Duitsman closed the public hearing. COUNCILMEMBER FARBER MOVED TO ADOPT ORDINANCE 95-15, AN ORDINANCE AMENDING SECTION 1008 OF THE CITY OF ELK RIVER ZONING ORDINANCE WITH THE FOLLOWING CONDITIONS: 1. TO ELIMINATE NUMBER 3 OF SECTION 1008.18 RELATING TO TRAILS AND SIDEWALKS. e Elk River City Council Meeting July 24, 1995 Page 8 2. THAT THE ADMINISTRATIVE SUBDIVISION DEFINITION BE AS FOLLOWS; A SUBDIVISION INVOLVING THE CREATION OF FOUR OR FEWER TRACTS OR LOTS. e 3. TO INCORPORATE JOHN OLIVER'S COMMENTS INTO THE ORDINANCE. 4. THE SECTION PERTAINING TO THE ESCROW REQUIREMENT FOR TREES BE REVISED BY THE CITY ATTORNEY AND RESUBMITTED FOR COUNCIL CONSIDERATION. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-1. Council member Scheel opposed. Councilmember Dietz indicated that the Park and Recreation Commission has looked at a trail system and stated that he did not feel that the city's trail system should be done in a piecemeal fashion. He felt it would be appropriate to l1'ave the developer put the trails in as part of the plat and that the developer be credited on the park dedication for the trails. 7.5. Consider Initiatina Land Use Plan Amendment Rezonina, and Plat for City Prooertv e City Planner Steve Ach stated that the city currently owns property located at the northwest corner of 193rd Avenue and Highway 169. He indicated that the current zoning of the property is R 1 c, Single Family with a land use designation of MR, Medium Density Residential. Steve Ach indicated that the Steering Committee has recommended that commercial development continue north on Highway 169 to the 194th Avenue alignment which would include the city owned property on the west side of Highway 169. He indicated that in order to prepare the city owned property for commercial development purposes, the property should have its land use designation changed to Highway Commercial. rezoned to Commercial, and platted to reflect the appropriate easements and right-of- ways. These actioris would place the property in a saleable condition. COUNCILMEMBER DIETZ MOVED TO INITIATE A LAND USE PLAN AMENDMENT, REZONING, AND PRELIMINARY PLAT APPLICATION FOR THE CITY OWNED PROPERTY AT THE NORTHWEST CORNER OF 193RD AVENUE AND HIGHWAY 169. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-1. Councilmember Scheel opposed. CouncilmemberScheel indicated that she feels that becauSe the city owns this property an exception is being made which would not be made for private property owners. 7.3a. Enaineerina Update Items · CounciJmember Dietz questioned the engineer regarding the turn lanes on Jackson A venue and Highway 1 69 · Council member Dietz indicated that he received a complaint regarding salt damage to trees on Mr. Heasley's property located on School Street. e Elk River City Council Meeting July 24, 1995 Page 9 e · Council member Farber indicated his concern regarding the traffic and pedestrians at Freeport and Jackson A venues. The city engineer suggested putting a pedestrian crossing sign at the location. 7.3. Ordinance Amendment Reauest (PUD) by City of Elk River, Public Hearina, Case No. OA 95-6 City Planner Steve Ach indicated that the City of Elk River is requesting to amend sections of the Zoning Ordinance pertaining to Planned Unit Developments. Mayor Duitsman opened the public hearing. There being no one for or against the matter, Mayor Duitsman closed the public hearing. COUNCILMEMBER HOLMGREN MOVED TO ADOPT ORDINANCE 95-16, AN ORDINANCE AMENDING SECTION 900.12(16), PLANNED UNIT DEVELOPMENT, OA 95- 6. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. 7.4. Ordinance Amendment Reauest (Screened Outdoor Storaae) by City of Elk River. Public Hearina, Case No. OA 95-7 e Planning Assistant Gary Schmitz indicated that the City of Elk River is requesting an ordinance amendment which would amend Section 900.12, Permitted, Accessory, Conditional Uses by District. He indicated that the amendment would include changing screened outdoor storage areas from a permitted use to a conditional use in both the 11, Light Industrial and 12, Medium Industrial zoning districts. The amendment would also consist of requiring that outdoor storage areas be accessory to a principle use. Mayor Duitsman opened the public hearing. There being no one for or against the matter, Mayor Duitsman closed the public hearing. COUNCILMEMBER HOLMGREN MOVED TO ADOPT4lQRDINANCE 95-17, AN ORDINANCE AMENDING SECTION 900.12, PERMITTED, ACCESSORY, AND CONDITIONAL USES BY DISTRICT, OF THE ELK RIVER CODE OF ORDINANCES RELATING TO SCREENED OUTDOOR STORAGE AREAS, CASE NO. OA 95-7. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0. COUNCILMEMBER FARBER MOVED TO CALL AN EXECUTIVE SESSION OF THE CITY COUNCIL TO DISCUSS PENDING LITIGATION PERTAINING TO THE EARL HOHLEN PROPERTY. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0. The Council recessed at 8:45 p.m. and reconvened at 8:55 p.m. 7.6. Discussion on Housinq Maintenance Ordinance Proposal e The draft Housing Maintenance ordinance was presented by Building and Zoning Administrator Steve Rohlf, Building Official Cliff Skogstad, Fire Chief Bruce West, and Police Chief Tom Zerwas. The presenters of the draft ordinance reviewed issues of concern as listed in the memo to the Mayor and City Council dated July 18,1995. Elk River City Council Meeting July 24, 1995 Page 10 e 1. Rental Housing Inspection Program conducted by the Fire Department or Building and Zoning Department - It was the consensus of the Council that both the housing and apartment fire inspections be handled by one inspection. This inspection would be under the direction of the Building and Zoning Administrator. 2. Yearly License - It was the consensus of the Council that to be consistent, the inspections should be done on a yearly basis. 3. Hiring a Housing Code Inspector/Fire Inspector - It was the consensus of the Council that in order to implement the program an inspector would need to be hired. 4. Controversy - Steve Rohlf informed the Council that there would be some controversy from both the tenants and landlords regarding the proposed ordinance. 5. Disorderly Tenants - The Police Chief indicated that this section of the ordinance would work together with a program which is currently being developed in cooperation with local landlords called "Crime Free Multi- housing Program." He indicated that the purpose of this section of the ordinance is to work with landlords to remove disorderly tenants. 6. Tenant Lists - The Council discussed the pros and cons of the types of information that would be necessary to have for each tenant. e 7. Health, Safety, Welfare versus Aesthetics - It was the consensus of the Council that aesthetics and health, safety and welfare are all important issues and should be included in the ordinance. 8. Fees - Steve Rohlf indicated that it would not be realistic to expect to recover the entire cost of implementing the inspection program. It was the consensus of the Council to charge $20 per unit for the inspections. 9. Which Units are Priority - Discussion was held regarding the living units located on top of the buildings in the downtown area of Elk River. It was the consensus of the Council that these living units be inspected along with the apartment buildings. Rental single family dwellings and duplexes would be added at a later date. 10. Blank Sections - Steve Rohlf indicated that there are certain sections of the ordinance which have not been completed. He indicated that these sections will be drafted by the city attorney at a later date. 11 . Timing - The City Council concurred with the timetable as suggested for the inspection program which calls for licensing and inspections to begin in January, 1996. 8. Other Business e Elk River City Council Meeting July 24, 1995 Page 11 - The Mayor distributed a letter addressed to the Police Chief, Mayor, and School Board Chair from the City of Otsego Mayor dated July 12, 1995. The letter referenced Elk River's request to the City of Otsego for assistance in funding the Secondary D.A.R.E. Program. The letter indicated that the City of Otsego could not assist in funding, but suggested that civic organizations be asked to help fund the program. 9.
