1. Call Meetina To Order
Pursuant to due call and notice thereof, the meeting of the Elk River City Council
was called to order at 6:00 p.m. by Mayor Duitsman.

Project
COUNCILMEMBER FARBER MOVED TO APPROVE THE SEPTEMBER 25, 1995, CITY
COUNCIL AGENDA AS AMENDED. COUNCfLMEMBER HOLMGREN SECONDED THE
MOTION. THE MOTION CARRIED 5-0.
3. Administration
3.1 Consider Resolution Authorizina the Submission of the Miahtv Ducks Grant
Request for Prooosal (Ice Arena)
Pat Klaers, City Administrator handed out a Resolution of Application Authorizing
Rling of Application and Execution of Final Agreements with the Minnesota
Amateur Sports Commission (MASC) to Construct a Sport Facility Under the
Provision of the State Capital Bonding Fund.
COUNCILMEMBER FARBER MOVED TO ADOPT RESOLUTION #95-64, A RESOLUTION
OF APPLICATION AUTHORIZING FILING OF APPLICATION AND EXECUTION OF FINAL
AGREEMENTS WITH THE MINNESOTA AMATEUR SPORTS COMMISSION (MASC) TO
CONSTRUCT A SPORT FACILITY UNDER THE PROVISION OF THE STATE CAPITAL
BONDING FUND. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE
MOTION CARRIED 4-0-1. COUNCILMEMBER SCHEEL ABSTAINED.

3.2 Consider Ordinance Amendina Section 1302.06121 user Charaes for Normal
Domestic Strenath Users
Lori Johnson, Assistant City Administtator updated the Council on an ordinance
amendment relating to the billing s~ction of the sewer ordinance. The current
ordinance is based on quarterly metered water usage during the first quarter of
the calendar year and are billing on monthly metered water usage. The City
would like to amend the ordinance to use an average of metered water usage
for the months of November, December, January, February and March instead
of the first quarter average. This will allow a more accurate average from all
residents including the people who leave for a month or so.
COUNCILMEMBER HOLMGREN MOVED TO ADOPT ORDINANCE #95-25, AN
ORDINANCE AMENDING SECTION 1302.06(2), USER CHARGES FOR NORMAL
DOMESTIC STRENGTH USERS, OF THE CITY OF ELK RIVER CODE OF ORDINANCES.
COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0.
3.3 Consider Council Participation in the September 29.1995. Homecomina Parade
The Council stated that they plan on their families joining them in riding in a City
fire truck for the homecoming parade on Friday, September 29, 1995 at 6:00 p.m.
3.4 Mayor Update
Mayor Duitsman gave Steve Rohlf a letter from the Minnesota Pollution Control
Agency.

Mayor Duitsman had some questions regarding the Mike Wallen issue. Steve
Rohlf indicated that he will discuss this item later in the meeting.
Mayor Duitsman had two voice mail messages from concerned citizens
regarding the movie "Showgirls" at the Elk River Theater.
Mayor Duitsman indicated that John Lynn called and indicated the new
overlayed road stopped 15 feet from his driveway. Phil Hals had spoken to him
last week. The Mayor stated that Mr. Lynn is paying two assessments.
3.5 Update on ECM Proposal
Bill Rubin, Economic Development Coordinator updated the City Council on the
ECM proposal. Bill Rubin handed out an outline addressing a variety of
financing and incentive programs that the City will alert ECM Publishers of
relative to the acquisition and renovation of the County Administration building
as well as a possible TIF district for adjacent property at King Avenue and Main
Street.

Considerations to help facilitate the transaction for the county building are: 1)
supplemental micro-loan at a reduced interest rate for the renovation
component of the County Administration building; 2) supplemental block grant
micro-loan at a reduced interest rate for the renovation component of the
County Administration building; 3) outright redevelopment grant from TIF
Districts No.1 and No.3 - requires a TIF Plan amendment.

Regarding a King and Main TIF project, a debt of $275,000 can be retired in
seven years with reimbursements credited to the developer under a pay-as-you-
go TlF District: project debt of $275,000 divided by annual tax increment of
$40,294 equals 6.8 years.
Mayor Duitsman indicated that the Council would like to see this project
located downtown Elk River.
COUNCILMEMBER HOLMGREN MOVED TO SUPPORT THE PROPOSAL, AS PRESENTED
ALONG WITH A CITY COMMlTTMENT TO COMPLETE A DOWNTOWN FOCUS STUDY.
COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 5-0.
3.6 Consider Chanqe Order for Elk Hills Drive/Dodqe Avenue Improvement Proiect
City Engineer, Terry Mauer indicated that a request has been made by REMAX
and Goodyear for a change order to the Elk Hills Drive/Dodge Avenue
Improvement project. The City Engineer indicated that Gary Santwire,
representing REMAX and Goodyear, has indicated that the property owners are
willing to sign a petition and waive their rights to appeal an assessment for the
Dodge Avenue Improvement. The City Engineer indicated that the requested
Dodge Avenue Improvement will be an estimated $40,000 change order (300
feet additional road).

COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE CHANGE ORDER TO THE
ELK HILLS DRIVE/DODGE AVENUE IMPROVEMENT PROJECT CONTINGENT UPON THE
PROPERTY OWNERS SIGNING THE PETITION AND WAIVER Of THEIR RIGHTS TO
APPEAL THE ASSESSMENT. COUNCILMEMBER FARBER SECONDED THE MOTION. THE
MOTION CARRIED 5-0.

Worksession to Review Status of Capital Improvements and Miscellaneous City
Proiects
East Hiahway 10 Presentation on Assessment Benefit Analysis by Mike Amo of St.
Cloud Appraisal, Inc.
Mike Amo, St. Cloud Appraisal, Inc. reviewed an Assessment Benefit Analysis with
the Council. The report outlined the benefits of trunk sewer and water
installation within District 1, and Phase$ 1 and 2 of District 2 of the Urban Service
Area Study Map.
The Benefit conclusions are as follows:

The Mayor requested that the Council have one more worksession on this
project before a public hearing is held.

Update on the Riverview HeiQhts Neighborhood Meetina, Letter, and Survey

Terry Mauer, City Engineer stated he and Pat Klaers had discussed sending out a
sewer and water questionnaire/informational letter to get feedback from
residents. If there is any sign of interest for an improvement project, an
informational hearing will be scheduled.
Update on the Comprehensive Plan, City Lono Ranoe Transportation Plan, and
Sherburne County Transportation Plan
Terrry Mauer, City Engineer discussed the issues and options related to the City
Long Range Transportation Plan. The Council stated that it would like a staff
recommendation on transportation issues as part of the Comprehensive Plan.
The Council discussed scheduleing a Comprehensive Plan public hearing for
November 27, 1995.
Update on the Status of the UPA Sewer Bills
Lori Johnson, Assistant City Administrator updated the Council on the UPA sewer
bill. UPA estimated 35,000 gallons to be used but the City had billed UPA for
50,000 gallons. The City then had a flow meter put in with a computer graph
and it was found that UPA had used 495,000 gallons per month. UPA had not
yet paid their summer bills.

Update on the Status of the Computer Software Proorams for the Plannino and
Buildino/Zonina Departments
Steve Rohlf, Building/Zoning Administrator updated the Council on the new
computer software which has been installed for the Planning and
Building/Zoning Departments and the employees have been trained. It appears
that the City is going to be able to use the County tax records to get the data
base. Mayor Duitsman would like to see a virus check done on the modem.
Steve Rohlf indicated he would like to see this up and running by December 1,
1995. Suggestion was made to have staff work overtime to input data or to hire
a software technician.
Update on the Status of Code Enforcement Activities
Kendra Lindahl, Zoning Assistant handed out a zoning code enforcement sheet.
Kendra will update this every month for the Council.
Update on the Inventory of City Owned Properties
Kendra Lindahl, Zoning Assistant handed out an index of City owned property
and updated the Council. Kendra has been working on a book pertaining to all
City owned property and reviewed a map showing the location of the City
parcels.
Update on the Environmental Status of the Custom Motors Operation

Steve Rohlf. Building/Zoning Administrator updated the Council on the phase II
environmental audit for Custom Motors. Council recommends that we help
Custom Motors relocate if possible.

Update on lake Orono Committee

Steve Rohlf noted that the City of ~Ik River's role in this project is to help facilitate
the evaluation of environmental i~sues at lake Orono. On October 10, 1995 at
7:00 p.m. there will be a lake Orono meeting and Councilmembers are invited.
Update on the Recreation Field land Proposal
Pat Klaers, City Administrator stated that the property owner have had some
recent inquiries but nothing has changed regarding the selling price. The City
Administrator forwarded an appraisal and the soil borings to the property
owners. The appraisal price is at $2,5oo/acre.
The Building/Zoning Administrator stated the existing wells are being tested. The
City Administrator stated that before the City purchases the land the City needs
to have a public hearing.
Update on the Tom Hartman Property and the Joplin Avenue Frontage Road
North of Hiahway 10

Pat Klaers, City Administrator updated the Council on some more work that Mike
Amo, St. Cloud Appraisals has done for the City regarding the Tom Hartman
property north of Highway 10 near Joplin Avenue. The City is hoping to identify
a site on the north side of Highway 10 at the signal lights where the City could
have a westbound liquor store in the future. The City is looking for 1 1/3 to 1 1/2
acres. M-. Hartman may be asking if the City is willing to exchange some of the
assessments for land. According to the appraisal the value would be around
$98,OOO/acre. Terry Mauer, City Engineer has recently made a presentation to
Guardian Angels regarding the cost and timetable for a frontage road. Mr.
Hartman would like to see a frontage road system installed in 1996.
