04-28-1994 CC MIN e MEETING OF THE ELK RIVER BOARD OF REVIEW HELD AT THE SHERBURNE COUNTY ADMINISTRATION BUILDING THURSDAY, APRIL 28, 1994 Members Present: Mayor Duitsman, Councilmembers Dietz and Farber Members Absent: Councilmember Scheel and Councilmember Holmgren (Councilmember Holmgren's position as assessor for Sherburne County prohibits him from participating on the Board of Review) Staff Present: Sandy Thackeray, City Clerk; Ty Bischoff. Assessor; John Cullen, Residential Assessor; Jerry Kritzeck, Commercial Assessor Pursuant to due call and notice thereof. the meeting of the Board of Review was called to order at 6:00 p.m. by Mayor Duitsman. Ty Bischoff explained the procedure of hearing each individual appeal. Each citizen is heard by the Board of Review on an individual basis depending on the order of the sign- in sheet. Mr. Bischoff also explained the purpose of the Board of Review. e 1. Opportunity Workshop - 75-429-0340 and 75-432-0242 The City Clerk entered a letter dated January 7, 1994, into the minutes regarding a misclassification by Gerry Biese, President of Opportunity Workshop. Ty Bischoff indicated that the Board of Review had no authority to take action on the letter. 2. Timothy Wick - 75-522-0338 Total Valuation $173,300; Land $25,900: Buildina $147,400 Mr. Wick indicated that his valuation increased by $8.400 from 1993 to 1994. He further stated that the surrounding homes were larger, more expensive and all paying less property taxes than him. He further indicated that there is standing water on his lot. Assessor John Cullen indicated that there has been a change in the market value during the past year which has increased the valuation of all property in Elk River by 10 - 15%. It was the consensus of the Council to lower the valuation by $1,800 to compensate for the standing water in his yard. COUNCILMEMBER DIETZ MOVED TO LOWER THE TOTAL PROPERTY VALUATION FOR PARCEL 75-522-0338 TO $171,500. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. It 2. GeorQe Voita - 75-532-0116 Board of Review Minutes April 28, 1994 Page 2 e Total Valuation - 92,100: Land - $21.500: Buildina - $70,600 Mr. Vojta stated that his property valuation raised significantly since 1991. He stated that he is having problems with a retaining wall that was installed by the developer. He further indicated that his lot is unfinished and that the basement is unfinished. City Assessor, John Cullen, indicated that Mr. Vojta has begun constructing another garage on his lot which has an affect on the property valuation. Mayor Duitsman and Councilmember Farber commented that the home was assessed at a fair market value, however, they felt a slight reduction in the land value would compensate for the problems resulting from the retaining wall. MAYOR DUITSMAN MOVED TO DECREASE THE MARKET VALUE OF THE LAND FOR 75- 532-0116 TO $19,900. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. 3. Timothy Klinobeil 75-532-0104 Total Valuation $135,500, Land $21,500, Buildina $114,000 Mr. Klingbeil stated that there was an error in the square footage of his home. Assessor John Cullen confirmed this and stated that a correction will be made. e 4. Daniel Graham - 75-53:-0134 Total Valuation $91,000, Land $21,500, Buildina $69,600 Mr. Graham indicated that he paid $73,900 for his home two years ago. He believes the property is appraised too high. He further indicated that he cannot receive FHA financing for the property and also indicated that he is having problems with retaining walls causing washing away of dirt in his yard. He also indicated that he is having trouble with dampness in his basement. Due to the problems Mr. Graham is experiencing with his property and home, the Council felt it was appropriate to lower the valuation of the property by $8,000. MAYOR DUITSMAN MOVED TO LOWER THE VALUATION OF PARCEL 75-532-0134 TO $83,000. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. 5. Larry SwedaI75-484-0315 Total Valuation $144,900: Land $22.700: Buildina $122,200: Mr. Swedal questioned the reason for the increase in his property valuation. Mr. Cullen indicated that all home is Elk River received an increase in property value, plus Mr. Swedal added an addition to his home in 1993 which increased the property value e Board of Review Minutes April 28, 1994 Page 3 e COUNCILMEMBER DIETZ MOVED TO LEAVE THE PROPERTY VALUE AT $144,900 FOR PARCEL 75-484-0315. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. 6. R.D. Elliott 75-132-1211 Total Valuation $153,300: Land $48,900: Buildina $104,400 Mr. Elliott indicated that one year ago his home was appraised at $150,000 by an independent appraiser. He further indicated that the value of his home has increased by $20,000 since 1992. COUNCILMEMBER DIETZ MOVED TO LOWER THE PROPERTY VALUATION OF PARCEL 75-132-1211 TO $151,700. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. 7. Brian Hipsao 75-523-0160 Total Valuation $118.200: Land $27,500: Buildina $95.700 Mr. Hipsag indicated that he received a 15% increase in valuation to his buildings. Assessor Cullen indicated that a similar increase was received by all Elk River residents. He reviewed comparable properties that have sold in the $118,000 price range. e COUNCllMEMBER DIETZ MOVED THAT THE PROPERTY VALUATION OF $118,200 REMAIN THE SAME FOR PARCEL 75-523-0160. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. 8. Darryl Branham 75-532-0256 Total Valuation $132,500; Land $21,500: Buildina $111,000 Darryl Branham stated that he felt his property was appraised too high. He indicated that he had received two separate appraisals; one at $122,000 and another in December of 1993 at $125,000. Mr. Bischoff reviewed the $125,000 appraisal and indicated that the appraisal was not accurate. Assessor John Cullen reviewed some comparable homes that have sold in the price range of $132,500. COUNCILMEMBER DIETZ MOVED TO lOWER THE PROPERTY VALUATION OF PARCEL 75-532-0256 TO $130,000. COUNCllMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. 9. William Jensen 75-431-0434 Total Valuation $92,900: Land $18,800: Buildina $73, 100 e Mr. Jensen indicated that he purchased his home one and a half years ago for $83,500. He stated that there has been damage to his home due to leaky pipes. He further indicated that the home has increased in value by $10,000 and does not feel that the home would sell for $92,900. It was the consensus of the Council that it was too early to determine if the mall would have a positive or negative affect on surrounding property. COUNCILMEMBER DIETZ MOVED TO AUTHORIZE THE CITY ASSESSOR TO INSPECT THE PROPERTY FOR WATER DAMAGE FROM THE LEAKY PIPES AND TO REPORT BACK TO THE COUNCil WITH HIS ASSESSMENT OF THE HOME. MAYOR DUITSMAN SECONDED THE MOTION. THE MOTION CARRIED 3-0. 10. Guardian AnQels - Carol Mills Carol Mills indicated that the valuation of Evans Park has increased by 55%. Ty Bischoff explained that the increase was due to a classification change. The classification change was due to an error. Evans Park was incorrectly classified as a subsidized building and has since been removed from that classification, therefore, increasing the valuation of the building. Jerry Kritzeck suggested that Guardian Angels check into the possibility of receiving subsidy for Evans Park. Carol Mills stated that the taxes on Outlot C were $1,866. She indicated that this was high considering there was no road to access Outlot C. e Carol Mills indicated that the taxes on Outlot D were $2,528 which was high considering that this parcel is an un buildable lot. She indicated that the parcel is merely a buffer between the Fairview Health Care and Guardian Angels. It was the consensus of the Council to take no action on the Evans Park parcel or on Outlot C. However, the Council felt it was appropriate to lower the value of the land on Outlot D to $1.50 per square foot. MAYOR DUITSMAN MOVED TO LOWER THE VALUATION OF OUTLOT D TO $1.50 PER SQUARE FOOT. COUNCllMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 3-0. 11. Robert and Chyeral Stohlman 75-484-0375 Total Valuation $106,400: Land $21,100: Building $85,300 Mr. Stohlman indicated that his property value increased by 15%. City Assessor, John Cullen, indicated that this increase was in line with other property owners in Elk River. COUNCILMEMBER DIETZ MOVED THAT THE PROPERTY VALUATION OF PARCEL 75-484- 0375, REMAIN AT $106,400. COUNCllMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. 12. Robert Dilley 75-458-0120 e Total Valuation $115,900: Land $42,900: Bui/dina $73,000 Board of Review Minutes April 28, 1994 Page 5 e Mr. Dilley stated that the valuation of his property has increased by $45,000 during the past seven years. He questioned whether property in Elk River would continue to increase. Assessor John Cullen indicated that Mr. Dilley's property increased by 15% due to the overall City increase in property valuation. COUNCILMEMBER DIETZ MOVED THAT THE PROPERTY VALUATION OF PARCEL 75-458- 1020 REMAIN AT $115,900. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 3-0. 13. Larry Toth - 75-422-0270 Total Valuation $98,000: Land $23,800; Buildina $78,300 City Assessor, Jerry Kritzeck, indicated that the land value increased by $2,000 due to the added cost for the well and septic system. He further indicated that the buildings have increased by 10%. Mr. Toth indicated that his home is in need of some repair to the roof. COUNCILMEMBER DIETZ MOVED TO DECREASE THE PROPERTY VALUATION OF PARCEL 75-422-0270 BY $2,000 ($96,000) TO ALLOW FOR DEPRECIATION OF THE ROOF. MAYOR DUITSMAN SECONDED THE MOTION. THE MOTION CARRIED 3-0. e COUNCILMEMBER DIETZ MOVED TO ADJOURN THE MEETING. COUNCILMEMBER FARBER SECONDED THE MOTION.
