ORD 17-24ver Ordinance 17 - 24 Saikethfougbs to be removed Underlines to be added An Ordinance Amending Chapter 38, Legalized Gambling, of the City of Elk River, Minnesota, City Code The City Council of the City of Elk River does hereby ordain as follows: SECTION 1. That § 38-164, Restrictions on issuance of premises permit of the City of Elk River Code of Ordinances shall be amended to read as follows: (a) The city reserves the right to disapprove a premises permit application for individual bingo occasions, raffle games, and pull -tab operations for any of the following reasons: (1) Violation by the applicant of any statute, rule, regulation or ordinance relating to gambling. (2) Failure to make reports required by any applicable ordinance, rule, regulation or statute. (3) Any reason which would justify the state gambling control board in denying an application for a license. (b) No premises permit will be approved unless: (1) The organization is conducting the lawful gambling on the premises of a church or a fraternal, veterans', or other nonprofit organization, or on the premises of an on -sale liquor license of the city. (2) The physical site for the organization's headquarters or the registered business office of the organization is located within the city's trade area. (3) Preference shall be given to organizations located in the City of Elk River that meet all the requirements of the state and city gambling laws. (c) Only one premises permit shall be allowed per premises for lawful gambling operations. Up to two three premises permits shall be allowed per organization for lawful gambling operations in the city. SECTION 2. That this ordinance shall take effect upon adoption and be published as provided by law.
