Purpose of the Ordinance Amendment
The proposed amendment removes language from the ordinance stating a Planning Commission Work Session will
be held the second Tuesday of each month.
Public Benefit
Provides clarification to the public regarding meeting dates and time.
Background/Discussion
City ordinance section 2-299 states:
The planning commission shall meet regularly on the fourth Tuesday of each month to take action on its official business,
including planning-related items. The commission will meet on the second Tuesday of each month in work session. No action can
be taken at a meeting designated as a work session unless the meeting has also been called as a special meeting. Special meetings
may be held at any time upon the call of the chair. Notice of the time and place of a special meeting shall be communicated to the
members and publicly noticed at least three days prior to the meeting except in the event of an emergency. A majority of the
commission members shall constitute a quorum. All commission meetings shall be open to the public. Except as provided in this
article, the commission shall be governed by and operate pursuant to Robert's Rules of Order, Newly Revised (ninth edition).
Including the work session in the city code requires preparation of a meeting cancellation notice when the meeting
is not held. A work session on the second Tuesday of the month has not been held for over five years. To
eliminate unnecessary work for city staff, and confusion when the meeting is not cancelled and posted on the city’s
website, staff proposes removing the underlined section of the ordinances from Sec. 2-299.
If a work session is required in the future, staff will post the notice accordingly and within all statutory time frames
required of special meetings.

An Ordinance Amending Section, 2-299, Meetings and rules of procedure, of the
City of Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That § Section 2-299, Meetings and rules of procedure, of the City of Elk River Code
of Ordinances shall be amended to read as follows:
Sec. 2-299. – Meetings and rules of procedure.
The planning commission shall meet regularly on the fourth Tuesday of each month to take

second Tuesday of each month in work session. No action can be taken at a meeting designated as
a work session unless the meeting has also been called as a special meeting. Special meetings may
