MEETING OF THE ELK RIVER CITY COUNCIL HELD AT SALK JUNIOR HIGH SCHOOL TUESDAY, APRIL 21, 1992 Members Present: Mayor Tralle, Councilmembers Kropuenske, Holmgren, Dietz and Schuldt(7:20 p.m.) Members Absent: None Staff Present: Pat Klaers, City Administrator; Sandra Thackeray, City Clerk; Peter Beck, City Attorney; Terry Maurer, City Engineer and Lori Johnson, Finance Director 1. Call Meeting To Order Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order at 7:05 p.m. by Mayor Tralle. 2. Consider 4/21/92 City Council Agenda COUNCILMEMBER HOLMGREN AGENDA. COUNCILMEMBER CARRIED 4-0. MOVED TO APPROVE THE 4/21/92 CITY COUNCIL KROPUENSKE SECONDED THE MOTION. THE MOTION 3. Westwood Area Assessment Hearing Terry Maurer, City Engineer, gave a brief history of how the Westwood project started. He indicated that improvements to the Westwood Area were discussed and considered by the City Council in September, 1985. Following City Council review of the 1985 feasibility study and discussion with property owners, the project was dropped in November, 1985. Terry Maurer stated that the project was reinitiated by the City Council in January, 1991. Terry Maurer reviewed the cost comparisons of the project from 1985 to 1992. The total estimated construction of the project according to the 1985 feasibility study was $529,400 as compared to the actual 1992 construction cost of $816,351. Terry Maurer explained that an estimated assessment for a 75 foot lot in 1985 was $6,049 compared to $7,371 in 1991. He further explained that an estimated assessment cost in 1985 for a 150 foot lot was $12,098 compared to $14,075 in 1992. Terry Maurer noted that with the City's contribution and the proposed assessment method for the project in 1992, the actual cost will be $6,315 for a 75 foot lot and $11,851 for a 150 foot lot. He explained that the assessment amounts are almost the same as they were seven years ago due to the City'S participation in the assessment costs. Terry Maurer reviewed the project costs for the different components of the project and noted that there will be some additions to the project which will be City funded. He further indicated that there were several additional overhead costs to this project which will also be City funded. Elk River City Council Minutes April 21, 1992 Page 2 . Terry Maurer stated that the City held three open houses to allow the residents to come in and discuss the five different assessment methods being considered by the City. Councilmember Schuldt arrived at this time (7:20 p.m.). Terry Maurer indicated that the City Council authorized a market study by Peter J. Patchin and Associates, Inc. The study appraised each parcel of property affected by the improvement project. A recommendation was made of each individual property as to what each parcel of property could bear for an assessment. Terry Maurer stated that after reviewing the study, staff's recommendation is that all properties in the project be assessed equal to or less than what the market study indicates the property can support for benefit. Terry Maurer stated that several issues were raised at the open house which have been brought to the City Council for their consideration. Terry Maurer indicated that it was suggested by some of the residents that a walkway be included. Terry Maurer stated that staff will be recommending to add a bituminous paved walkway in areas where no roads will be built. Terry Maurer also stated that the addition of street lights were mentioned by the residents. He indicated that the City will be working with the Municipal Utilities to have some street lights installed. . Terry Maurer informed the Council that another issue of concern of many residents related to wet basements. He indicated that the storm sewer improvement will not make a reduction in the water table level, therefore those basements that have water problems caused from the water table level will not see an improvement. He stated that the storm sewer improvement will be addressing the surface water issues and will improve those basements that are wet from surface water. Terry Maurer explained that there were a few property owners in the Westwood Area with more than one small lot. He stated that the City has a provision to allow these homeowners to combine their lots which would reduce the assessment. The City Engineer stated that another issue that was brought to the staff's attention was the two year time frame to hook up to sanitary sewer. Terry Maurer explained that the City Council considered this issue at its last meeting and took action to allow a total of four years prior to mandatory hookup to sanitary sewer if the private system could meet environmental standards. Terry Maurer informed the residents that a petition had been received from the residents of the project area requesting a five year time limit for hookup. . Terry Maurer reviewed the utility hookup costs. He indicated that there is a SAC charge of $1,300. He explained that there would be a charge to bring the sanitary sewer from the street to the home and this was the responsibility of the homeowner. He indicated that there would be a charge to the homeowner to abandon their existing septic tank. He stated there is a WAC charge of $300 and a water meter charge of $66. He informed the residents that there would also be a charge to bring Elk River City Council Minutes April 21, 1992 Page 3 . the water service suggested that some contractor to see if from of they the property the residents can get better line to the home. Terry Maurer get together and contact a rates as a group. Terry Maurer stated that another issue which was brought to the City's attention was partial prepayment of assessments. He indicated that the City Council also considered this request at its last Council meeting and authorized partial prepayment prior to certification of the assessment to the County. He indicated that this is as lenient as a City can be because of what is allowed by State law. Terry Maurer informed the residents that an error was made in the assessment schedules that were mailed to the residents regarding payment of interest due and payable with the first installment. He explained that the first year of the assessment only shows one month of interest and should show 13 months of interest. Terry also informed the residents that the entire assessment may be paid without interest until it is certified to the County. Pat Klaers, City Administrator, explained that the interest shown on the assessment schedule mailed to the property owners is 8.25%. He explained that state law used to limit cities to charging no more than 1.5% over the bond sale interest, however, this law has been repealed. He stated that the City of Elk River's policy has been to stay at the 1.5% interest rate over the bond rate. He stated that the City must charge enough to cover expenses but not to make a profit. He further explained that the 1.5% charged over the bond sale interest is used to pay for delinquent assessments, to cover costs of deferrals and also to cover costs such as minor project changes and cost overruns. He stated that if there is any money left from the 1.5%, the money is then transferred into the Capital projects Fund and used to pay for other projects or components of the ongoing project. The City Engineer indicated that the City has received some questions regarding the Western Area project and the fact that the existing rural lots are not paying for trunk water main or trunk sewer main costs. Terry Maurer explained that the City Council is treating the Westwood Area in the same manner as there are no trunk sewer or water charges being charged to the Westwood residents. . Terry Maurer concluded that the recommendation made by staff for the assessment method, after looking at the five scenarios and after talking to the residents at the open house, was Assessment Method #1 which assessed properties on a front footage basis. Terry Maurer explained that after reviewing the market value appraisal by Peter PatChin, there were six properties that were assessed slightly more than the market value could support and requested the City Council to reduce these assessments to a limit at which the market value could support. Elk River City Council Minutes April 21, 1992 Page 4 . Peter Beck, City Attorney, reviewed the assessment appeal process. Peter Beck informed the residents that in order to preserve their right to appeal, they must submit a written objection signed by the property owner prior to the conclusion of the assessment hearing. He further indicated that the property owners also have the right to take their appeal to the district court. He stated that in order to preserve this right the property owners must then serve a notice on the City within 30 days of the adoption of the assessment roll and file notice with the district court within 10 days after the 30 day time frame. The City Attorney encouraged those people wishing to appeal to submit a signed statement at this time. Mayor Tralle opened the public hearing. Yvonne Hetland, 18810 Boston street - Ms. Hetland indicated she had some questions she would like to ask prior to appealing her assessment. She stated her questions revolved around the street portion of the project in front of her home. Terry Maurer, City Engineer, indicated that he would be speaking to the Hetland's regarding closing off this street, however, he was unaware that this matter would be a determining factor as to whether or not they wish to appeal their assessment. He suggested that the Hetland's submit an objection to the assessment at tonight's meeting in order to keep open their right to appeal. . Ken Case, 12951 Meadowvale Road - Mr. Case stated that he did not agree with the City's form of assessment on a front footage basis. He stated he would like the City to consider assessing property on a unit basis. He stated that he has a pie shaped lot and the frontage is mostly in front of his home. He indicated that the assessments have been calculated in an unfair manner. He stated he would like the Council to consider assessing the four properties in the Rohlf Addition on a unit basis due to the size of their lots and due to his lot being an unusual shape. Mr. Case indicated that he would be disappointed if the City's bond rates came in at 8 to 8.5% with the way the market is today. He indicated that he checked with St. Francis who has the same bond rating as Elk River and who has recently sold bonds for a sewer and water project. He stated that their bonds came in a 6.5%. Mark Davis, 18846 Zumbro - Mr. Davis stated that he was told by staff that he would save approximately $800 if he removed his lot line and combined his two lots. He stated that according to the assessment schedule he received he was not saving any money by removing his lot line and further stated that after reviewing the other lots in the neighborhood, he feels he is being assessed unfairly. . Marvin Weaver, 12815 Meadowvale Road - Mr. Weaver stated that he signed a petition in opposition to the project and indicated he did not receive a response to the petition. Roger Eull, 18880 Boston - Mr. Eull questioned whether the entrances or curb cuts to the extra lots would be provided. . . . Elk River City Council Minutes April 21, 1992 Page 5 Joyce Nichols, 18967 Concord - Ms. Nichols stated she understood that the project was originated because of wet basements. She questioned why the City would be putting in storm sewers if the storm sewers would not eliminate the wet basements. She further commented on the market study the City had prepared and questioned how a market study could determine what each family could payor bear for an assessment. Eleanor Todahl, 18869 Boston Street - Eleanor Todahl stated that people with larger lots are charged a smaller fee per foot than the smaller lots. She stated that everyone should pay the same price per foot. Ms. Todahl informed the people that they should be aware of extra costs to each resident in order to actually hook up to the sewer and water. She indicated that her total additional costs would be approximately $5,357. She further indicated that the project will raise her real estate taxes $20 per month and she will also be paying a sewer and water bill of $15 per month. Cynthia Dahn, 18856 Albany - Cynthia Dahn indicated that she could not afford to pay for hook up charge and questioned whether this could be included in the assessment and payable on the real estate taxes. There being no further comments from the public, Mayor Tralle closed the public hearing. Mayor Tralle stated that staff would respond to the questions at this time. Terry Maurer informed Yvonne Hetland that he would meet with her individually at her property to discuss the road. Peter Beck responded to the question regarding the City assessing on a front footage basis versus a unit basis. He stated that the City is faced with legal requirements to not assess in excess of the benefit of the property and to assess all property uniformly. Mayor Tralle stated that the average bond rate is 6.78% and that the City would everything possible to keep the interest rate as low as possible. Terry Maurer responded to Mr. Davis' comment regarding removal of lot lines and his assessment amount. He indicated that the assessment notices sent were based on two assessment methods. He stated that the higher of the assessment amounts were sent to the property owners and stated that some of these assessment amounts would be reduced. Mayor Tralle stated that the Council will be taking formal action on the previously received petitions. Terry Maurer stated that the City will be installing for people that access their property regularly than their driveway. Mayor Tralle informed the residents that approximately $270,000 of the project is the City's contribution and will come from the Capital Projects Fund. Councilmember Holmgren indicated that the assessment will add to the assessed value of the lots. Peter Beck stated that any charges in excess of the original assessment such as SAC and WAC charges and bringing the lines from the street to the home are private costs and could not be made part of the assessment according to State law. Mayor Tralle indicated that he received a petition from the residents of Islandview Third Addition and Lundgren Homes area of the Westwood Area Improvement Project requesting that the Council consider excluding them from the project. Property owned by Lila and Gerald Schaefer should be assessed as follows: prD i 75-465-0570 Total Assessment $3,051.43 Mayor Tralle informed the property owners that each property owner will be notified of the correct assessment amount by mail. ~ Councilmember Schuldt stated that the Westwood Area has a long history of trying to develop a project. He stated that if the project is not done, some of the property in the area will greatly decrease in value. He indicated that the City has put as much money into this project as possible. He further stated that if the project is delayed and comes up again, the City may not have enough money to put into the project and the assessments could rise. He stated he is in favor of the project. Councilmember been put into stated that time that the project. Holmgren stated that much thought and consideration has this project by both Council and staff. He a majority of the people were in favor of the ~ Councilmember Dietz indicated he agreed with the other Councilmembers. He stated he appreciates all the input received from the property owners. He further stated that he felt the project would eventually be ordered and that the cost would never be any less than it is now and further that the project would never be done at a time which would be agreeable to everyone. He stated that the City has contributed approximately 30% to the project. Councilmember Dietz indicated he would vote in favor of the project. Elk River City Council Minutes April 21, 1992 Page 11 . Mayor Tralle indicated he concurred with the Councilmembers. He further stated that he would like to lower the assessment amounts if possible. He proposed a reduction on the total project cost of $25,000 to be deducted from the sanitary sewer assessment with the funds to come from the capital Improvement Project Fund. The City costs would be applied to the sanitary sewer lift station. The $25,000 reduction would be applied on a front footage basis to each property proposed to be assessed. This reduction would benefit all property owners by about $2.70 per front foot of sanitary sewer. Councilmember reduction. He the City may all projects. Resolution Awarding Bid for Westwood Area Improvement Project COUNCILMEMBER KROPUENSKE MOVED TO ADOPT RESOLUTION 92-33, A RESOLUTION ACCEPTING BID FROM NORTHDALE CONSTRUCTION COMPANY AND AUTHORIZING EXECUTION OF CONTRACT IN THE MATTER OF THE WESTWOOD AREA IMPROVEMENT OF 1992. COUNCILMEMBER SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 5-0. Terry Maurer stated that revised notices will be sent to property owners some time in May. He further stated that a letter will be sent to the property owners showing sample assessment spreads in time frames of 10, 15 and 20 years.
