Adopt,by motion, an ordinance extending hours for the sale of intoxicating and 3.2 malt liquor until 4:00
a.m., each day during Super Bowl LII weekend, February 2 - 5, 2018.
Background/Discussion
The Legislature passed a special law allowing establishments serving on-sale intoxicating liquor or 3.2
malt liquor to remain open until 4 a.m., February 2 -5, 2018, subject to approval by the city.
Establishments must be issued a special permit from the city before they can participate in the extended
hours.
Staff contacted multiple establishments and only one expressed an interest in extending their hours;
however, a few others commented they would be interested if the Minnesota Vikings were to play in the
Super Bowl. Adopting the ordinance now allows staff ample time to put together an application,provide
notice to the establishments, and process any applications that may be received.
This ordinance will not change the city's code with regard to licensing. This action only allows the city to
issue a temporary permit for current liquor establishments to sell liquor for extended hours only during
the weekend of Super Bowl 2018.
Financial Impact
State law allows the city to charge an amount not to exceed $250. Staff feels $100 covers the additional
costs and staff time involved in issuing the special 4 a.m. permits.

An Ordinance Providing for Special Permits Allowing Extended Hours for On-Sale
Intoxicating/3.2. Malt Liquor During 2018 National Football League Super Bowl LII
SECTION 1. 2017 MN H.F. 1,Art. 11, §19,provides the authority for the city to issue special
permits to holders of on-sale intoxicating liquor licenses or 3.2. malt liquor licenses during the 2018
National Football League Super Bowl LII at U.S. Bank Stadium to allow for the service of alcohol
through extended hours until 4:00 a.m.
SECTION 2. The City Council of the City of Elk River does hereby ordain as follows:
The following conditions shall apply to the special permits described in Section 1.
a. Only holders of an existing on-sale intoxicating liquor license or 3.2. malt liquor license
issued by the city are eligible and shall only be issued upon approval of the city.
b. The license shall only be effective during the period from 8:00 a.m., February 2, 2018
through 4:00 a.m.,Monday, February 5, 2018.
c. At 4:01 a.m., February 5, 2018, the license shall expire and terminate with no further action
required by the city.
d. The license shall be subject to the conditions,prohibited acts, and penalties set forth in
Minn. Stat. Chapter 340A and City Code Chapter 6.
e. Application shall be on a form prescribed by the city with a license fee of$100.
SECTION 3. That this ordinance shall take effect upon adoption and be published as provided by
law.
